MONSON BOARD OF HEALTH
WEDNESDAY, JUNE 4, 2003

The regular meeting of the Monson Board of Health convened at 7:30 p.m. in the Board of Health meeting room at 110 Main Street. In attendance were Dr. Richard Smith, Jane Jacobs, Robert Bator and Phyllis Klick.

The meeting minutes of May 21, 2003 were accepted.

Craig Jalbert, the Water/Sewer Superintendent, approached the Board of Health for a discussion regarding the proposed floor drain regulation. This meeting was a continuation of a prior meeting with Mr. Jalbert. At the previous meeting, Mr. Jalbert handed the Board of Health members a copy of the regulation. The Board of Health members agreed to invite Mr. Jalbert back once they had a chance to look this over. They have done that and have invited Mr. Jalbert back to discuss this.

Dr. Smith asked Mr. Jalbert if it was alright for existing facilities to have this drain into the regular sewer lines. Mr. Jalbert responded it would need an oil/water separator and he was under the impression it was going to be more strict. Mr. Jalbert stated they have no control over residential drains, this is just for industial/ commercial drains. Dr. Smith stated he felt it should be in the regulation that violators will be notified by certifies letters. Mr. Jalbert handed out brochures which showed pictures of the under ground ejection control. Mr. Jalbert stated the whole point is to have someone maintain these pumps. Every 90 days is what is stated for pumping the tanks. Mr. Jalbert said he felt every 90 days is too much and he was thinking in terms of once a year. He would like to see someone inspecting the tanks and if it looks like they are using it more, then they should have it pumped more often. It should be up to the discretion of the town. Mr. Jalbert stated the way this regulation would work is the paperwork would be submitted to the Board of Health. The Board of Health would call Mr. Jalbert and say this company isn’t getting their tank pumped out and Mr. Jalbert will then give the company a call or send a letter to tell them their tank must be pumped. If the company does not comply, a fine will be placed against them. Mr. Jalbert stated he is in a way, doing his own regulations in tandem with the sample regulation.

Ms. Klick asked Mr. Jalbert how many companies in town would be affected by this regulation. Mr. Jalbert responded there are approximately 7 or 8 companies in town with floor drains.

Dr. Smith asked Mr. Jalbert, under the penalties, what happens if a person refuses to pay the fine? Mr. Jalbert stated it would get enforced as a criminal matter, much like the tobacco fines do. Mr. Jalbert stated he doesn’t foresee any problems. Dr. Smith stated he would like to see everything spelled out in the regulation, making it as clear as possible. Mr. Jalbert agreed to not do anything half way and to make sure it is done right.

Ms. Klick asked how the town will know if a company has a floor drain that the town might not be aware of. Mr. Jalbert stated the Environmental Protection Agency is supposed to have all these companies listed in their file. Dr. Smith said the proposal the Board of Health and Mr. Jalbert come up with should be passed on through the DEP, EPA and Town Counsel.

Dr. Smith asked who would be doing the inspections? Mr. Jalbert stated since there aren’t that many companies to inspect, he could do inspections every six months. Mr. Jalbert would be the Board of Health appointed enforcement agent. Mr. Jalbert stated he wasn’t sure just how much it costs to have a tank pumped, but would guess it is somewhere between $150.00 and $200.00

It was agreed to set up another meeting with Mr. Jalbert and to invite Chip LaPointe and Town Counsel once Mr. Jalbert has everything all set. Mr. Jalbert still needs to clarify some points.

Christine A. Wilson approached the Board of Health regarding an application for a license to practice massage. Ms. Wilson stated she will be working for Dr. Smith. The Board voted unanimously to approve this application and to grant her a license.

Household Hazardous Waste Day was discussed. Dr. Smith stated the budget has $4,500.00 in it for this purpose. The last time the town held a Hazardous Waste Day, was two years ago. The Board of Health agreed unanimously to hold this on the second Saturday in September, which would be on the 13th. It was agreed to see if Arleen Miller would be willing to help out again as last time she went over everything with Mr. Klick. Ms. Klick said she would pull out all of Mr. Klicks notes. It was agreed to discuss this further at the next meeting and to finalize it.

The Board voted unanimously to assign all of Mr. Klicks' former Board of Health duties to Ms. Klick. These responsibilities include taking over the beavers, trash, Bulky Day and Hazardous Waste Day.

It was agreed to invite Dot Jenkins to the next Board of Health meeting to go over the Bulky Day system.

Dr. Smith said the Board of Health budget was level funded. This means there are the funds for the mosquito briquettes and to hold the Hazardous Waste Day. It was agreed to order the mosquito briquettes as soon as possible and to distribute them.

It was agreed to invite Lori McCool to the next meeting to see if she would be willing to do the tobacco sales inspections.

Correspondence was looked over and everything requiring signatures were signed.
