Meeting convened at 2:00 p.m.
In attendance:  Russell Bressette, Chairman

The board signed a real estate abatement for property located at 134 Upper Palmer Road in the amount of $276.34.  This agreement was reach prior to the ATB appeal. The official withdrawal was recorded at the ATB with a copy on file.

The board was made aware of an issue with supplemental taxes on certain properties.  After consulting with the Bureau of Municipal Finance Law Department, Attorney Gary Blau explained that the law states any parcel with an improvement of more than 50% will receive a supplement tax bill based on the occupancy certificate date.  In the case of the new condo’s a supplemental tax bill should be sent to the owner and immediately apportioned.  The Municipal Finance Law Department is reviewing the law and will issue an opinion on the proper procedure when issuing supplemental tax bills for new condo complexes and parcels that subdivide subsequently build prior to the end of the fiscal year.  Blau will keep this office updated and will forward a copy of the opinion when completed.  

The board voted unanimously to issue the supplemental tax bill in accordance with the information provided by the Bureau of Municipal Finance Law Department.

Before the board was a topic which required executive session.  Under Section 6 of the Mass Gen. Laws Chapter 39 the members took a roll call vote to go into executive session.  Royce, Benoit  & Bressette all voted in favor.  The board also agreed not to reconvene after the executive session was adjourned.
