- Chair Wilson called the meeting to order at 7:39 pm in the Carol Blute Conference room.
- Chair Wilson recognized Tom Hurley, Chair of the Board of Selectmen and Annemarie Fagan, Town Administrator for an update of the following town matters which would possibly have an impact on the town’s budget: Wind Turbine; Legal bills; 131 Eliot Street; Governor Stoughton/Town Farm Property; and the Process of an Override.
- Chair Wilson thanked Mr. Hurley and Mrs. Fagan for their attendance and presentation of the above mentioned subjects.
- On a motion made by Member Genega and seconded by Member Hallisey the Warrant committee voted 10/0/0 that the town recommend to authorize the Board of Selectmen to petition the General Court to enact legislation in substantially the following form, provided that the General Court may reasonably vary the form and substance of the requested legislation within the scope of the general public objectives of this petition:
AN ACT AUTHORIZING THE TOWN OF MILTON TO ASSESS AN ADDITIONAL AMOUNT OF REAL ESTATE AND PERSONAL PROPERTY TAXES, IN EXCESS OF THE AMOUNT PERMITTED BY LAW, FOR THE PURPOSE OF FUNDING PAYMENT OF LEGALLY OBLIGATED MEDICAL EXPENSES INCURRED BY CERTAIN TOWN OF MILTON PUBLIC SAFETY PERSONNEL RESULTING FROM INJURIES SUSTAINED IN THE LINE OF DUTY
Be it enacted by the Senate and House of Representatives in General Court assembled and by the authority of the same as follows:
SECTION 1: Notwithstanding the provisions of section 21C of chapter 59 of the General Laws, or any other general or special law, the board of selectmen may seek voter approval for the town to assess an additional amount of real estate and personal property taxes, not to exceed five hundred thousand dollars ($500,000) in any given fiscal year, in excess of the amount otherwise permitted by law, for the purpose of funding paymentof legally obligated medical expenses incurred by certain town
of Milton public safety personnel resulting from injuries sustained in the line of duty, or for debt issued for that purpose.
SECTION 2: Prior to October 1 of each year the town shall notify the Director of Accounts in the Department of Revenue of the amount the board of assessors shall raise in the tax rate for that purpose.
SECTION 3: Such authorization shall remain in effect as long as there are outstanding legally obligated medical expenses incurred by certain town of Milton public safety personnel resulting from injuries sustained in the line of duty.
SECTION 4: The town is hereby authorized to create a special purpose fund,
maintained by the town treasurer, into which such additional assessed amounts shall be deposited. Interest earned by the proceeds of said fund shall remain with said fund. Such additional amount assessed each year shall be considered an amount approved under paragraph (i½) or (k) of section 21C of chapter 59 of the General Laws for purposes of calculating the “total taxes assessed” in paragraph (a), or the maximum levy limit in paragraph (f), of section 21C of chapter 59 of the General Laws.
SECTION 5: Money from said fund may be expended for payment of legally obligated medical expenses incurred by certain town of Milton public safety personnel resulting from injuries sustained in the line of duty, or for debt issued for that purpose, and for no other purpose. The proceeds of such fund may be expended by the board of selectmen without further authorization or appropriation.
SECTION 6: Said fund shall be maintained as long as there are outstanding legally obligated medical expenses incurred by certain town of Milton public safety personnel resulting from injuries sustained in the line of duty.
SECTION 7: When said fund is closed the proceeds of said fund shall be allocated by the town of Milton to reduce the tax levy in accordance with instructions received from the Director of Accounts in the Department of Revenue.
SECTION 8: Any question submitted to the voters pursuant to this act shall
be worded as follows: “Shall the town of Milton be allowed to assess an additional amount of real estate and personal property taxes, not to exceed $500,000 in any fiscal year, for the purpose of funding payment of legally obligated medical expenses incurred by certain town of Milton public safety personnel resulting from injuries sustained in the line of duty, or for debt issued for that purpose?

- On a motion made by Member Genega and seconded by Member Tougias the Warrant Committee voted 8/2/0 to recommend that the Town of Milton refer amending its General By Laws or Zoning By Laws to prohibit or regulate, with reasonable conditions, medical use of marijuana and/or growing of marijuana for medical use, including without limitation, limiting the location of a medical marijuana treatment center or the location where marijuana may be grown for medical use; and to act on anything relating thereto back to the Planning Board subsequent to receipt of state regulations
- On a motion made by Member Genega and seconded by Member Turner the Warrant Committee voted 10/0/0 to recommend that the Town re-vote to authorize the Blue Hills Regional Technical School District to establish a Stabilization Fund according to Chapter 71, Section 16 G1/2 of the Massachusetts General Laws.
- On a motion made by Member Hallisey and seconded by Member Turner the Warrant Committee re-voted 10/0/0 that the town that the Town vote to rescind the following borrowing authorizations:

- On a motion made by Member Genega and seconded by Member Turner the Warrant Committee re-voted 10/0/0 to recommend that the town accept article 43(ALRD) as written and printed in the May 2013 Annual Town Meeting Warrant.
- On a motion made by Member Tougias and seconded by Member Turner the Warrant Committee re-voted 10/0/0 to recommend that the town accept article 22 (Swift Hat Shop) as written and printed in the May 2013 Annual Town Meeting Warrant.
- On a motion made by Member Genega and seconded by Member Cahill the Warrant Committee re-voted 10/0/0 to recommend that the town accept article 45 (Traffic Commission) as written and printed in the May 2013 Annual Town Meeting Warrant.
- On a motion made by Member Turner and seconded by Member Genega the Warrant Committee re-voted 10/0/0 to recommend that the town accept article 49 (Survivor allowance Retirement Board) as written and printed in the May 2013 Annual Town meeting Warrant.
- On a motion made by Member Genega and seconded by Member Cahill the Warrant Committee re-voted 10/0/0 to recommend that the town accept article 50 (Benefit Increase to surviving spouse of disabled employees) as written and printed in the May 2013 Annual Town meeting Warrant.
- On a motion made by Member Genega and seconded by Member Turner the Warrant Committee re-voted 10/0/0 to recommend that the town accept article 51 ( Retirement Board Compensation ) as written and printed in the May 2013 Annual Town meeting Warrant.
