SELECTMEN’S MEETING                    JULY 10,  2003                  6:30 P.M.    

A joint meeting of the Board of Selectmen, the Board of Assessors, the Board of Health, the Board of Park Commissioners, the Trustees of the Cemetery, the Planning Board, the Personnel Board, the Town Treasurer/Collector.  In attendance: James G. Mullen, Jr., Chair; Marion V. McEttrick, Secretary, Charles J. McCarthy, Member;  David Owen, Town Administrator;  Annemarie Fagan, Assistant Town Administrator; Kevin Sorgi, Treasurer/Collector; David A. Colton, DPW Director; Joseph Bartulis, Attorney, Murphy, Hesse, Toomey & Lehane; Barbara Brown, Chair, Board of Park Commissioners; Paul F. Dolan, Member, Joseph, Donovan, Member, Robert Mason, Member and Joseph M. Reardon, Chair, Trustees of the Cemetery; Therese Desmond Sills, Cemetery Superintendent; Kathryn Fagan, Chair, Board of Library Trustees; Michael P. Zimmer, Member, Planning Board; Jeremiah Lowney, Member, Board of Health; Stephen Hennessy, Chair, Paul Lyons, Member, John Pender, Member, Ann White, Member, Personnel Board; and Kathleen Heffernan, Chair, M. Joseph Manning, Member, Thomas S. Gunning, Member, Board of Assessors; Jeffrey d’Ambly, Chief Appraiser.

David W. Owen, Town Administrator, introduced the negotiating team which consisted of the Town Administrator, David Colton, DPW Director, Kevin Sorgi, Treasurer/Collector, and Joseph Bartulis, Attorney, Murphy, Hesse, Toomey & Lehane.  Mr. Owen gave a history of the negotiation process undertaken to recommend a clerical unit contract to the Board of Selectmen.  Mr. Owen then asked the Boards and Committees if they had questions or concerns and a discussion was undertaken.

Stephen Hennessy, Chair of the Personnel Board, addressed the Board with concerns about Article XXVIII of the collective bargaining agreement relative to reclassification requests as it relates to the Chapter 13 Personnel Bylaws.  

Boards and Committees in attendance questioned their role as it relates to employees under their jurisdiction.

The following motion was made and seconded:

“The following elected department heads and elected boards, Board of Assessors, Board of Cemetery Trustees, Board of Health, Board of Park Commissions, Planning Board, Town Clerk, Town Treasurer, who administer their own department, shall have the option of using the Personnel Board in place of the Town Administrator wherever Town Administrator is printed in this agreement.”

Following discussion, a vote was taken on the amendment as follows: Kathleen Heffernan, Chair, Board of Assessors voting no, Jeremiah Lowney, Member, Board of Health voting no, Joseph M. Reardon, Chair, Trustees of the Cemetery voting yes, Barbara Brown, Member, Board of Park Commissioners voting yes, Michael Zimmer, Member, Planning Board voting no, James G. Mullen, Jr., Town Clerk, voting yes and Kevin Sorgi, Town Treasurer abstaining.

The meeting was adjourned at 8:45 p.m.
