Minutes of Meeting October 19, 2015

         A meeting of the Board of Health was held on Monday, October 19, 2015, at the Veterans Memorial Building, Room #213, Millis, Massachusetts.  Present were Barbara Thissell, Director; Bonnie Hilton, Chair; Kathleen Lannon and Brian Hoell, Board Members; and Vickie Philben, Administrative Assistant.

Also present:   George Sgourakes; 41 Bullard Lane - well issue
Kelley Scolponeti; 6 Ryan Road – seeking Domesticated Foul or Rabbit permit
Dan Merrikin; Hickory Hills - stormwater discussion
                          
        Mr. Hoell moved to open the Millis Board of Health meeting at 7:01 p.m.  
        It was seconded by Ms. Hilton.  It was voted 3-0 to open the meeting.                                


Administrative Business:  


Approval of Minutes:

September 21, 2015 – It was moved by Mr. Hoell and seconded by Mrs. Lannon to approve the September 21, 2015 minutes, as amended.  Mr. Hoell, Mrs. Lannon, and Ms. Hilton voted unanimously to approve the draft minutes as amended.

Nurse’s Report:  The monthly report of the Public Health Nurse was reviewed.
 

New Business:  

  • Food Recalls – see attached.
  • Food Inspections – There have been no food establishment inspections since September 21, 2015.
  • Temporary Food Event Permits
  • Woodside Montessori; Fall Fair – October 3, 2015
  • Millis Girls Softball; Community Business Expo – November 1, 2015.
  • Millis Board of Health; Health Fair & Flu Clinic – October 17, 2015.
  • Millis Church of Christ; Fellowship Meeting – October 15, 2015.
  • Septic Improvements – Ms. Thissell summarized ongoing septic system improvements and/or inspections completed since September 21, 2015:
  • 9/21 - 57 Orchard Street – D-Box replacement, Disposal System Construction Permit (DSCP) approved.
  • 9/22 – Village Street, Map 40, Parcel 174 – Soil Testing completed.
  • 9/29 – 29 Frontier Lane – DSCP review comments to Engineer.
  • 10/5 – 186 Pleasant Street – Corrected Title 5 received and passed, incorrect bedroom count.
  • 10/13 – 29 Frontier Lane – Certificate of Compliance (COC) issued.
  • 10/19 – 29 Beech Street – COC issued
  • 10/20 – 149-151 Dover Road – Perc Test to be scheduled.
  • Various Complaints Received:
  • Sportsman’s Lounge – Repeated complaints received regarding the presence of a dog in the bar area.  A letter was issued to bar manager on October 6, 2015.
  • 29 Exchange Street – Dwelling re-inspection.  Corrections have been made.
  • 333 Village Street #1 – Dwelling with no heat – corrected.
  • Stoney Brook – Dwelling with no control over heat.  Inquiry only.
  • 333 Village Street #2 – Dwelling with no heat – corrected.
Other:  

  • ‘Millis Moves’ bags – The Board of Health supplied ‘Millis Moves’ bags to participants at the Clyde Brown Road Race on September 27, 2015.
  • Health Fair & Flu Clinic – The Health Fair & Flu Clinic was held on Saturday, October 17, 2015 and was successful.  The Millis Lions Club, MetroWest Physician Services, the Norfolk County Sheriff’s Office, Living Buddha Nature, Millis Police, Millis Energy Committee, HESSCO Elder Services, and the Council on Aging participated in the Health Fair.
  • Upcoming Flu Clinic – An upcoming flu clinic is scheduled for Saturday, November 7, 2015.  Families are welcomed.  Children aged 4-18 may receive the flu mist and those older than 8 may receive the flu shot.
  • Medical Reserve Corps – The Medical Reserve Corps will meet on Wednesday, November 18, 2015 at 6:00 p.m. for a CPR/Basic Life Support training session.   The Regional Coordinator will attend to photograph and create badges for the volunteers.
  • FY16 Business License Applications – The applications for FY16 Business Licenses have been updated and are prepared for mailing this week.
  • Permits for Domesticated Fowl or Rabbit – The Board approved the “Domesticated Fowl or Rabbit” permit that was created by Ms. Philben.
  • West Nile Virus (WNV) – On October 16, 2015, the Massachusetts Department of Public Health announced the ninth human case of WNV in Massachusetts this year.  In 2014, there were six human cases of WNV infection identified in Massachusetts, all in Suffolk County.
  • Waste Dumping – The Board received a letter, dated October 6, 2015, from Edward Shluzas of 84 Acorn Street.  The letter states that construction materials have recently been dumped illegally on a neighboring property belonging to the Dmytryck family.  The letter further states that the property has a history of illegal dumping.  Mr. Shluzas requests that the Health Department require that the illegal dumping activity cease.  The Board instructed the Director to contact the Dmytryck’s to request access to the site for an inspection.  
  • Solar Farm – A Solar Farm application has been submitted to the Planning Board.  It does not appear that an Environmental Health Impact Report (EHIR) filing will be made.  Ms. Thissell will review the application for health-related concerns and issue a memo to the Planning Board.
  • Upcoming Meetings
  • Ms. Thissell will attend the Massachusetts Health Officers Association Conference from October 21 to October 23, 2015.
  • Ms. Hilton, Mrs. Lannon and Ms. Thissell will attend the Mass Association of Health Boards (MAHB) on November 14, 2015.
Scheduled Public Hearings & Discussions:   

35/41 Bullard Lane – Present was George Sgourakes, owner of 41 Bullard Lane.   
Ms. Thissell updated the Board about Mr. Sgourakes’ well concerns.  During the September 2015 Board of Health meeting, Mr. Sgourakes reported that a water sample taken from his well had tested positive for total coliform.  Subsequently the Millis Department of Public Works took two samples from the Sgourakes home on October 1, 2015.  These samples also tested positive for total coliform.  E. coli was not found in any of the samples tested.
Mr. Sgourakes stated that he believes that his neighbors’ horse pen is located too close to his well so that the proximity of horses to his well is adversely affecting the water quality of his well.  Mr. Sgourakes requested that the Board support his allegation.  
The Board stated that Total Coliform is present throughout the environment and that there is no evidence that the Total Coliform reported in the Sgourakes’ well is due to the neighbors’ horses.  The Board suggested that Mr. Sgourakes chlorinate his well.
Mr. Sgourakes provided two documents that he would like added to his to his file.  These documents are amended to the meeting minutes.  Mr. Sgourakes also provided the Board an invoice dated September 23, 2015 from GeoLabs for the well testing.  Mr. Sgourakes stated that he believes that the Board should pay for the testing because he said the Board required the test.

6 Ryan Road – Present was Kelley Scolponeti, owner of 6 Ryan Road.  Ms. Scolponeti has filed an application to raise seven female chickens.  Letters dated October 13, 2015 regarding the intent to raise the chickens were mailed to the direct abutters of 6 Ryan Road:  4 Rose Lane and 4 Ryan Road.  Copy of abutters list is on file.  There have been no comments received.  Ms. Hamelin, Animal Control, inspected the property and found it in good order.  Ms. Thissell inspected the property on October 19, 2013 and reported no concerns.

Mr. Hoell made a motion to issue a “Domesticated Foul or Rabbit Permit” for 6 Ryan Road.  Ms. Hilton seconded the motion.  The Board voted unanimously to issue the permit.

Hickory Hills Subdivision – Present was Dan Merrikin, P.E., Merrikin Engineering, representing Hickory Hills Subdivision.
Mr. Merrikin stated that the developers of the Hickory Hills Definitive Subdivision would like to be allowed the option of installing subsurface stormwater systems on each lot in lieu of installing rain gardens on each lot.  Mr. Merrikin stated that the three rain gardens that have been installed are not functioning as designed due to the sloping nature of the site.  The rain gardens are constantly receiving unintended overland runoff.
Mr. Merrikin further stated that he is finding that property owners do not want rain gardens.  The Director stated that she has reviewed the stormwater calculations and the proposed underground systems are designed to work hydrologically.  The Director added that if the subsurface stormwater systems are allowed, all references to rain gardens in the homeowners’ documents and Stormwater Operations and Management (O&M) plan should be revised accordingly.
After discussion, it was agreed that the subsurface stormwater systems would be reconfigured to 36’Lx36’Wx12”D.  Mr. Merrikin will revise the stormwater calculations to reflect the proposed configuration.  The revised calculations and Stormwater O&M plan will be reviewed by the Director prior to Board action.

At 8:31 p.m.  Ms. Hilton moved to close the September 21, 2015 Board of Health meeting.  Mrs. Lannon seconded the motion.  The Board voted unanimously to close the hearing, 3-0.
