Minutes of Meeting September 21, 2015
A meeting of the Board of Health was held on Monday, September 21, 2015, at the Veterans Memorial Building, Room #213, Millis, Massachusetts. Present were Barbara Thissell, Director; Bonnie Hilton, Chair; Kathleen Lannon and Brian Hoell, Board Members; and Vickie Philben, Administrative Assistant.

Mr. Hoell moved to open the Millis Board of Health meeting at 7:00 p.m.
It was seconded by Ms. Hilton. It was voted 3-0 to open the meeting.

Approval of Minutes:
August 5, 2015 – It was moved by Mr. Hoell and seconded by Mrs. Lannon to approve the August 5, 2015 minutes. Mr. Hoell, Mrs. Lannon, and Ms. Hilton voted unanimously to approve the draft minutes.
Nurse’s Report: The monthly report of the Public Health Nurse was reviewed.

- Various Complaints Received:
- 120 Norfolk Road – A bat was found in house on August 5, 2015 and escaped through the window. The two parents and two children are being vaccinated.
- 19 Walnut Hill Road – Two unvaccinated cats were euthanized on August 15, 2015 due to exposure of a bat. The Rabies test was negative.
- 85 Ridge Street – A bat was found in the home, euthanized and tested negative for Rabies.
- 180 Village Street – A squirrel was found in the home, euthanized and tested negative for Rabies.
- 8/18 - 29 Exchange Street – cat and mold odor issues. Corrective Orders issued on August 31, 2015.
- 9/3 – Twist Bakery – housekeeping issues
- 9/3 – 54 Stoneybrook #8 – various issues including hearing accommodations requested.
- 41 Bullard Lane – manure storage of neighbor. Certified Letter was mailed September 16, 2015 requiring relocation of manure storage.

Other:
- Tobacco Coalition – Ms. Thissell met with Ms. Sarah LeRoux, Metrowest Tobacco Coalition, regarding the updated tobacco regulations for Millis. They visited the tobacco retail establishments and explained the tobacco regulations that go into effect on November 1, 2015.
Ms. LeRoux will attend the Clyde Brown Elementary Home School Association’s ‘Run Back to School’ event on September 27, 2015 with tobacco information for the students.
- Fall Town Warrant – The Millis Fall Town Warrant will close on September 25, 2015.
- West Nile Virus – The Board of Health office received a Mass Arbovirus Surveillance Program Report stating that a third human case of West Nile Virus was reported the week of September 14, 2015.
- Swimming Pool Fencing – Letters were mailed to 12 Crestview Drive and 265 Orchard Street to request the homeowners to inspect and repair, if necessary, the fencing around their swimming pools. Because Millis Police are responsible for enforcing the regulations, copies were sent to them.
- Tiki Tattoo – Ms. Thissell and Ms. Labonte inspected Tiki Tattoo on September 17, 2015.
- Thermometers for Temporary Events – The Board of Health office will lend thermometers to temporary event sponsors so that the food temperature can be properly tested and properly maintained. The Administrative Assistant will create a ‘Thermometer Sign Out’ spreadsheet.
- Health Fair – The Millis Health Fair and Flu Clinic is scheduled to take place on Saturday, October 17, 2015. An additional Flu Clinic is scheduled on Saturday, November 7, 2015.
- MAHB Annual Certificate Program – A draft of the 20th Annual Certificate Program from MAHB was distributed. The dates are November 7, 2015 at Holiday Inn in Taunton or November 14, 2015 at Holiday Inn in Marlboro.
Scheduled Public Hearings & Discussions:
211 Pleasant Street – Present were Mr. Jeffrey Crompton and Mr. John Crompton. Mr. Jeffrey Crompton is interested in purchasing 211 Pleasant Street. Director stated the existing septic system at 211 Pleasant Street has failed and the proposed septic repair meets State and local regulations to the extent practical. The Director further stated that she supports the local upgrade request of a reduction of groundwater separation from four feet to three feet. The Board discussed the request and agreed to approve the local upgrade request.
Mrs. Lannon made a motion to approve the septic local upgrade request from 310 CMR 15.405(h) to reduce the required 4’ separation between the soil absorption system and the water table to 3’ as depicted on the plan entitled “Holcomb – 211 Pleasant Street, Millis, MA, Septic System Repairs” dated 9/15/15 by Norfolk Engineering. Mr. Hoell seconded the motion. The Board voted unanimously to grant the upgrade request.
35/41 Bullard Lane – Present was Mr. George Sgourakes of 41 Bullard Lane.
Mr. Sgourakes called the Health Department on September 11, 2015 to express concern that his potable water well was being affected adversely by the storage of horse manure at 35 Bullard Lane. Mr. Sgourakes stated that his well recently tested positive for total coliform and that he believed that the storage of horse manure in an open-topped wagon less than 100-feet from the property line was the cause of the contamination.
Mrs. Lannon and the Director visited the Sgourakes property on September 14, 2015 and concurred that the location of the manure wagon appeared to be non-compliant with the ‘Millis Board of Health Manure Management Plan Guideline’. A Certified Letter was mailed to the property owners of 35 Bullard Lane on September 16, 2015. The letter directed the owners of the manure wagon to move the wagon immediately to provide the required setbacks.
The Director re-inspected the wagon location September 21, 2015. The wagon had been relocated to provide the required setback distances from the Sgourakes’ property line and well.
During the meeting, Mr. Sgourakes stated that he is very concerned with the quality of his well water and is currently boiling water prior to use. He believes the prior location of the manure wagon adversely affected his well. He stated that the wagon should be equipped with an impermeable liner with a lip to prevent waste from being washed off the wagon during rain events. He stated that the wagon should be topped with an impervious cover that prevents rainwater from entering the wagon. Mr. Sgourakes further stated that the horse fence should be moved away from his well to protect the well quality.
The Board stated that the detection of total coliform in well water, though not desirable, was not uncommon. Coliforms are naturally present in the environment. The presence of coliform does not indicate well contamination from the neighboring horse farm. Mr. Sgourakes’ independent lab report for the well on 41 Bullard Street showed no presence of E. Coli which could indicate fecal pollution.
Mr. Sgourakes said he would have another well sample analyzed. If the Sgourakes well tested positive for Total Coliforms again, the Board would continue the discussion.

At 8:23 p.m. Mr. Hoell moved to close the September 21, 2015 Board of Health meeting. Mrs. Lannon seconded the motion. The Board voted unanimously to close the hearing, 3-0.
