Minutes of Meeting April 13, 2015
A meeting of the Board of Health was held on Monday, April 13, 2015, at the Veterans Memorial Building, Room #213, Millis, Massachusetts. Present were Barbara Thissell, Director; Kathleen Lannon, Chairwoman; Bonnie Hilton and Brian Hoell, Board Members; and Vickie Philben, Administrative Assistant.
Also present: George Sgourakes, owner of 41 Bullard Lane, representing 41 and 35 Bullard Lane issue;
Jim Jackson and Kevin Witzell of CDR Maguire; Brian Main, Construction Supervisor for Town of Millis for the new Police Station; and Wayne Klocko, Chairman of Permanent Building Committee presenting the Environmental Health Impact Report (EHIR) application for the new Police Station; and
Brett Drake, Pool Supervisor for Glen Ellen Country Club, and William Farrell, Pool Supervisor for Quail Hill Condominiums.
Mr. Hoell moved to open the Millis Board of Health meeting at 7:03 p.m.
It was seconded by Ms. Hilton.
Administrative Business:
Approval of Minutes:
March 16, 2015 – It was moved by Mr. Hoell and seconded by Ms. Hilton to approve the March 16, 2015 minutes as amended. Mrs. Lannon, Ms. Hilton, and Mr. Hoell voted affirmative, 0 negative.
Nurse’s Report: The monthly report of the Public Health Nurse was reviewed. Three hundred doses of Trivalent Flu Vaccine have been ordered from Sanofi Pasteur for the Millis Fall Flu Clinic. Department of Public Health (DPH) will provide additional vaccine for residents under 19 years of age.

- Rabies Clinic – The Millis Rabies Clinic was on Saturday, April 11, 2015 and was a success. 85 cats and dogs were vaccinated.
- Flu Clinic/Health Fair – Ms. Thissell and the Board discussed dates and agreed to schedule the Flu Clinic on October 17 and November 7, 2015. The Health Fair will coincide with either date – depending upon the availability of sponsors and other factors.
- Summer Intern – Ms. Thissell informed the Board that Monika Drogosz will assist the Board of Health with the implementation of a Lyme Disease/Deer-Culling Program. Monika is available to start in May.
- Pure Genius Foods – Pure Genius Foods is currently growing hydroponic vegetables at 725 Main Street. They have requested a permit from the Board of Health to allow the storage of potentially hazardous materials used in conjunction with the hydroponic growing process. The growing process requires the discharge of used water containing chemicals. The Director determined the use and discharge of chemicals would be permissible so long as used water was discharged to the public sewer system. The Director stated that the on-site discharge of potentially hazardous chemicals would not be allowed. On April 2, 2015, the Millis DPW conducted dye testing to confirm the floor drains used to collect used water connect to the sewer system. The test was inconclusive. A letter was
mailed to Pure Genius Foods requiring the applicant perform additional testing to confirm waste water is not being discharged on-site.
- Hickory Hills – Sediment had been observed on Acorn Street and nearby wetlands. The Town Administrator, Board of Health, Conservation Commission, and Department of Public Works, representatives met with the developer on April 9, 2015 to discuss the issue. The developer is working to stop the current sedimentation problem.
- Facebook – Ms. Hilton presented the Town Social Networking Policy. Ms. Hilton will continue to explore the feasibility of creating a Board of Health Facebook Page.
Other:
- Mr. Sgourakes, Bullard Lane – Mr. Sgourakes attended the meeting to learn the Board of Health’s determination regarding the Board’s application of the Nuisance Law to require that Mr. Sgourakes’ abutter move a fence to provide a 100-foot separation between the neighbors’ horse fence and the Sgourakes’ well. The Board informed Mr. Sgourakes that the determination had been finalized at the previous meeting on March 16, 2015 and that there is not a health risk. Mr. Sgourakes stated that he is hiring an attorney regarding the matter.
- Millis Beautification Day – Ms. Hilton informed the Board that Millis Beautification Day is scheduled for Saturday, May 9, 2015.
Scheduled Public Hearings & Discussions:
7:30 p.m. – Millis Police Station, 1003 Main Street, EHIR (Environmental Health Impact Report) application – Present were: Jim Jackson and Kevin Witzell of CDR Maguire, Brian Main, Construction Supervisor for the new Police Station, and Wayne Klocko, Chairman of Permanent Building Committee.
It was moved by Mrs. Lannon to open the Public Hearing for the Millis Police Station EHIR and seconded by Ms. Hilton.
Ms. Thissell reviewed the draft EHIR permit and three variance requests. The variance requests are: (1) Section XII.1 that prohibits a decrease in the rate and volume of stormwater runoff from the site. The proposed stormwater management system is designed to provide on-site stormwater recharge which will reduce the rate and volume of stormwater runoff from the site in accordance with the current Massachusetts Department of Environmental Protection (DEP) stormwater regulations. (2) Section XIII.2.a that prohibits excavation to within 7.5 feet of maximum groundwater elevation to provide for potential subsurface sewage disposal systems. The proposed reduced groundwater separation is considered non-detrimental because, as noted into the record, it is proposed to service the new building with public sewer. (3)
Section XIII.2.b that prohibits any increase or decrease of surface water flow from the site. The proposed stormwater management system is designed in accordance with the current Massachusetts DEP stormwater regulations. The proposed on-site stormwater recharge will decrease surface water flow from the site.
Mr. Hoell moved to approve the variances. Ms. Hilton seconded the motion. Mrs. Lannon, Ms. Hilton, and Mr. Hoell voted affirmative to grant the three variance requests.
Mr. Hoell made a motion to approve the EHIR permit application for the Millis Police Station subject to the addition of property book and page information from the Registry of Norfolk County and the square footage of the facility being included in the permit. Vote 3-0.
8:00 p.m. – Public Pool Facilities – Present were: Brett Drake, representing Glen Ellen Country Club, and William Farrell, representing Quail Hill Condominiums. The Board informed Mr. Drake and Mr. Farrell that lifeguard qualifications must be submitted prior to opening and the pool applications must be complete prior to opening. Also, acceptable water quality testing must be provided to the Health Office a week before pool opening. Mr. Drake informed the Board that he has been a Pool Director in the past and is authorized to give lifeguard courses and exams to provide the appropriate certificates to the lifeguards. Mr. Farrell, Farrell Pools, has managed the pool at Quail Hill Condominiums for many years. He plans to open by mid-June. It was agreed amongst
the Board and the public pool supervisors that all paperwork will be complete and submitted at least one week prior to the desired pool opening.
Next Scheduled Meeting: Monday May 11, 2015 at 7:00 p.m.
At 8:32 p.m. Mr. Hoell moved to close the April 13, 2015 Board of Health meeting. Ms. Hilton seconded the motion. The Board voted unanimously to close the hearing, 3-0.
