Minutes of Meeting September 16, 2013



A meeting of the Board of Health was held on Monday, September 16, 2013 at the Millis Town Hall Room #213, Millis, Massachusetts.  Present were:  Kathleen Lannon, Chairwoman; Bonnie Hilton, Board Member; and Scott Moles, Health Director. The Millis Board of Health meeting was called to order at 7:04 p.m.   Absent was:  Vickie Philben, Administrative Assistant (vacation) and Cheryl Labonte, Board Member.

Administrative Business:

Approval of Minutes:

        Nurse’s Report:  The monthly report of the Public Health Nurse was reviewed.   
Director’s Report:  The Director’s Report (July, August, and September) was reviewed.  

        Old Business:

  • Seasonal Flu Clinic:  October 19 and November 2, 2013.
  • Millis Used Auto; EHIR received – The owner of Millis Used Auto had moved at least 1000 cubic yards of dirt, and therefore applied for an EHIR as required for 1370, 1372, and 1465 Main Street.  An onsite inspection is scheduled with ConCom on September 21, 2013.  A septic tank had been found under the office trailer on the site.  Mr. Moles will inspect the situation and follow up with tank abandonment.
  • EEE; West Nile Virus Update – At this time, last Thursday a mosquito was found with WNV in Medway.  The outside activities for Medway and Millis will stay the same.  So far, within this area, the West Nile Virus has been found as follows:  two in Medway, one in Holliston, and one in Medfield.  The Board requested that the Health Department contact the schools to see if there are any West Nile or EEE concerns.  No activities are scheduled to be curtailed.
  • Medical Marijuana Update – MHOA is meeting this week regarding Medical Marijuana and Phase II applications. The procedure is to be posted by the State with the Phase II application deadline on November 7, 2013.  At this time, the Millis Town Clerk has received one inquiry to open a marijuana dispensary.  Currently Millis has a marijuana moratorium until June 2014.  
New Business:  

  • Food Recalls – see attached.
  • Food Inspections – Lilac House, Primavera, Millis Schools, and the Football Field Concession Stand.
  • VMB Gym; Lead Paint – There is lead paint primarily within the primer level of the ceiling in the gym.  Mr. Moles contacted Paul Hunter, Director of Childhood Lead Poisoning, regarding some concerns and followed up with a memo with recommendations.  The Board suggested to include a statement regarding wearing personal protection prior to remediation.
  • Mass DPH; Together We’re Ready – Mass DPH has weekly website videos for the public to view for public health emergencies.
  • Boston University; Health and Medical Coalitions – The DPH had hired BU to do a study regarding emergency management, health and medical coalitions.    It is being recommended by the study that the Emergency Public Health regions be more aligned with the hospital districts.
  • LEPC Meeting; September 26, 2013 – The next LEPC meeting is scheduled on September 26, 2013.  
  • South End Farm; Project update – There are four lots under development in the subdivision.  The lots have areas that need to stay undeveloped.  Boundary markers must be on the property, as required.  The Selectmen requested that markers be shown on the Foundation Plan for the Building Department.  Mr. Moles will request that the boundary markers be shown on the Septic As-Built Plan, as well.
Other:
 
  •  The Board requested that the Director work on a list of items and develop written procedures regarding office responsibilities, such as posting items on website, applying for permits, etc.  

Scheduled Public Hearings & Discussions:  

  •  69 Dover Road; local upgrade variance approvals discussionThe Millis Health Department is in receipt of a local upgrade request from Borderland Engineering for a septic system upgrade.  Mr. Moles read the draft approval letter dated September 17, 2013 that included the following variances:  (1) Allow 1’ reduction in the required separation between the bottom of the soil absorption area and the estimated high groundwater elevation; (2)  Reduction of a 12” separation between the inlet and outlet tees and estimated high groundwater; and (3)  A variance from the percolation rate due to the observed silt loam material, high groundwater influence observed and ability to perc observed medium sand layer.  Board requested a few revisions for approval. The system is an infiltration leaching area similar to Norfolk Road.  The Board discussed Title 5 requirements within a Zone II.  Upon plan review, placement of SAS at a higher elevation would have grading and potentially a breakout issue.
Motion:  To approve the three variances requested for 69 Dover Road as listed.
Vote:        2-0
