Minutes of Meeting August 19, 2013


A meeting of the Board of Health was held on Monday, August 19, 2013 at the Millis Town Hall Room #213, Millis, Massachusetts.  Present were:  Kathleen Lannon, Chairwoman; Bonnie Hilton and Cheryl Labonte, Board Members; and Scott Moles, Health Director. The Millis Board of Health meeting was called to order at 7:06 p.m.   Absent was:  Vickie Philben, Administrative Assistant.

Administrative Business:

Approval of Minutes:

        July 8, 2013:  The Board approved the Board of Health minutes for July 8, 2013.
                                Motion:  to approve Board of Health minutes for July 8, 2013.
                                Vote:       2-0.

        Nurse’s Report:  The monthly report of the Public Health Nurse was reviewed.   
Director’s Report:  The Director’s Report was not complete, however the highlights were discussed.  

        Old Business:

  • Quail Hill Pool Opening – The pool for Quail Hill was inspected on July 26th and finally opened.  The pool will be operated by Lion Heart Contracting for cleaning operations and life guard services.
New Business:  

  • Food Recalls – see attached.
  • Food Inspections – Kiwi Burst is still in process of getting ready for opening inspection.
  • Seasonal Flu – Suggested Clinic Dates:  Oct 19 + Nov 11, 2013 - At this time, Kathy Lannon indicated that she may not be able to attend the flu clinic.
  • Millis Used Auto:  EHIR – Millis Used Auto is renamed Pick’n’Pull.   On July 18, 2013, Mr. Moles conducted an onsite inspection with Ms. Thissell, Engineer, and Mr. Giampietro, Building Inspector.  At least 1000 cubic yards of fill material that was moved from 1465 Main Street to 1370 Main Street. The Board of Health are requiring an EHIR submittal as the threshold for earth removal of 175 cubic yards was exceeded.
  • Well #2 Update -   A public notice of drinking water users of Well #2 was sent from the DPW.   The well was shut down for seven days from July 11th to July 18th because a positive total coliform results was present in the raw water.
  • Farm Street Sewer Extension – The Health Director informed the Board that the Farm Street Sewer Extension plans have been approved by the Selectmen and therefore will be submitted to the State by the applicant’s Engineer, Dan Merriken.
  • 8 Larch Street (aka 242-244 Main Street) Inspection – At the request of a tenant of 8 Larch Street, a housing inspection was conducted on July 26, 2013 because the ceilings are leaking.  Mr. Moles wrote a letter to the homeowner, dated July 29, 2013 identifying sanitary code items to be addressed.  The owners of 8 Larch Street will submit a schedule to resolve the issues.
  • Town Meeting Warrant Open – The Board discussed the Town Meeting Warrant for FY14.  A Rabies Article has been submitted to Mr. Aspinwall, Town Administrator, which is being considered to be on the next agenda for the Finance Committee.
  • EEE West Nile Virus – The Board of Health is in receipt of the updated Mass DPH Arbovirus report.  WNV is endemic in Holliston and Medfield and is, within reason, also in Millis.  At this time, evening activities will continue as the risk category is still low.
Other:
 
  •  Waste Composters/Rain Barrels – The Board requested Mr. Moles to discuss Waste Composters and Rain Barrels with Mr. McKay, DPW Director, and Mr. Cantoreggi, Planning Board Committee and DPW Director in Franklin, MA.  
  • Food Composting Regulations – The Department of Environmental Protection is in the process of creating regulations for food composting within facilities, such as schools and supermarkets.  The Board will be updated with information as needed.
Scheduled Public Hearings & Discussions:  

13 Cedar Street: Local Upgrade Request – On behalf of Lawrence and Gail Burns, owners of 13 Cedar Street, and Faist Engineering, Wayne Carlson, Land Surveyor.  Mr. Moles read the letter dated July 10th from David Faist, Faist Engineering.  As presented by Mr. Carlson, the plans included requesting a local upgrade approval for the septic system.  The request is to allow a 3’ groundwater separation as opposed to the required 4’.  The Board was concerned of the condition of the tank sealant and therefore requested the tank be sealed with mortar. The septic system plan will be reviewed and approved by Con Com.  The Board approved the local variance request with the condition that the tank pipes be sealed with mortar.  A Perc-Rite System Pressure distribution system is proposed.  An O+M plan is required.

Motion:  to approve the septic system local variance request for the groundwater to be separated by 3’ as opposed to the required 4’, and the septic pipes be sealed with mortar for added water tightness.
Vote:  3-0


266 Pleasant Street; Local Upgrade Request – Present was Wayne Carlson, Land Surveyor.  Mr. Carlson discussed the local upgrade request for 266 Pleasant Street I to allow a 3’ groundwater separation as opposed to the required 4’.  The septic tank will be sealed and booted.  An O+M Plan is required.  The septic tank construction was discussed. The Board agreed to approve the septic system upgrade request subject to ConCom approval of the wetland delineation.  The proposed septic system is a Perc-Rite pressure dosed system. The septic tank will require concrete ballasts due to groundwater elevation.
        
Motion:  to approve the septic system local variance request for the groundwater to be separated by 3’ as opposed to the required 4’.
        Vote:  3-0 subject to ConCom approval.
