Board of Selectmen Minutes 06/28/2011

Present:        Board of Selectmen:  Chairman E. Bernard Plante, Francis B. King, Kenneth I. Schold, Brian W. Stowell, Brian M. Ashmankas; Town Manager Spain, Donna Boynton, Tom Riley, Edd Cote, and concerned citizens.



Senator Moore FY 2012 Budget Discussion:  Senator Michael Moore addressed the Board regarding the Fiscal 2012 budget.  He stated that as of today it is in a holding pattern, but passed a temporary budget.  The new budget is balanced with no new taxes.  Revenues are up and hopefully the trend will continue.

Laurie Connors:  Jessica J Easement: Town Planner Laurie Connors spoke regarding obtaining the right of way we need to acquire on Jessica J Drive.  There are two ways that we could go about this; one is by eminent domain which is the easiest and cheapest and the other way is by deed which you would need a title search and get bank approval which is very expensive and involved.  Selectman Stowell inquired if the homeowners were aware.  There was a public hearing on this.
Motion made by Selectman Stowell to take by eminent domain, seconded by Selectman Ashmankas.
Motion carried unanimously.

7:25 National Grid Pole Petition   Public Notice was read into record by Selectman Schold.
Javier Morales spoke for National Grid who are attempting to place a pole on Maple Street.  Cindy Burr spoke asking which poles would be removed.  The Representative was unaware of pole removals and offered to resubmit petition.
Motion to close public hearing at 7:35 pm. made by Selectman Stowell, seconded by Selectman King.  Motion carried unanimously.
Motion to have National Grid resubmit the pole petition made by Selectman Stowell, seconded by Selectman Ashmankas.
Motion carried unanimously.

Selectmen Reappointments:
Motion made by Selectman Schold to reappoint Robert Simmarano to the Board of Appeals, seconded by Selectman King.
Motion carried unanimously.

Motion made by Selectman Schold to reappoint George D’Auteuil to the Butler Farm Re-Use Committee, seconded by Selectman King.
Motion carried unanimously.

Motion made by Selectman Schold to reappoint Kevin Woods as a Special Police Officer, seconded by Selectman King.
Motion carried unanimously.

Approve Fiscal 2012 Schedule:
Motion to approve schedule with the exception of taking the July 12, 2011 meeting off made by Selectman Stowell, seconded by Selectman Schold.
Motion carried unanimously.

Drain Layer Renewal:  Mitchell Cohen-Team Shovel
Motion to approve the drain layer renewal made by Selectman Schold, seconded by Selectman King.
Motion carried unanimously.

Drain Layer Renewal:  Gabriel Berthiaume-GJB Construction
Motion to approve the drain layer renewal made by Selectman Schold, seconded by Selectman King.
Motion carried unanimously.

One Day Liquor License-Creedon & Company-Asa Waters Mansion July 9, 2011
Motion to approve the one day license made by Selectman Schold, seconded by Selectman King. Motion carried unanimously.

One Day Liquor License-Marie’s Catering-Asa Waters Mansion July 16, 2011
Motion to approve the one day license made by Selectman Schold, seconded by Selectman King. Motion carried unanimously.

Alert Ambulance Contract:  Selectman Stowell recused himself at 7:40 pm.
Discussion regarding the Alert Ambulance Contract.  Chairman Plante wanted to thank the committee for their hard work.  Mr. Spain explained some of the highlights of the contract. It is a good deal for all three towns.
Motion to sign contract made by Selectman Schold, seconded by Selectman Ashmankas.  
Motion carried 4-0.
Selectman Stowell reentered room at 7:50 pm.

Rob McNeil- DPW Update
The Phase 1 required inspections for Singletary and Dorothy Pond Dams have been completed.  We have gotten a handle on the double pole issues saying that they are getting cleared up and working towards getting them done.  Park revitalization began with sprinkler installation.  West Millbury beaver problem is getting under control with 31 trapped.  Cemetery expansion has pinned 312 plots, which are double plots.  They have started repainting the crosswalks.  The sweeper continues to be spotty; one is down for the count and one continues to need repairs.  Washington Park is the host for a baseball tournament.  Grafton Street pump station will be replaced and bids will be open next month.  Sewer is replacing faulty air relief valve on West Main Street.  Annual bids including asphalt bids will be open next week and that will determine where the money will be spent.  The RAC recommendation stand at Auburn Road and the Prospect Street neighborhood.  Mr. Stencel started and is working well at integrating in.  There are a lot of projects they would like to implement.
Selectman Schold asked about Mosquito Control.  Residence can call Mosquito control directly.  The spraying of the town is done automatically.  Mr. McNeil is trying to initiate a tire collection day through Mosquito control.  He also wanted to know if the parks have been sprayed for poison ivy.  Selectman King wanted to know when they were going to do the sidewalk in the center of town.  Got initial pricing, going to get two more prices; hopefully within the next month for engineering and done by end of fall.  He also wanted to know about Greenwood St. Bridge.  He does not have an answer from DOT.  Issues with McCracken Road won’t be forgotten.    What about oil and stone capping roads?  Mr. McNeil is a fan of it where it is applicable. It provides a very decent and very low cost alternative but not for heavy traffic areas.  Appletree residences want to know if there is assistance for tree removal from beavers killing the trees.  Not if it is on private property.  Selectman Ashmankas mentioned at 125 Grafton Street there is a huge pothole.

Town Manager Report
Appointment of William Wilkinson as Health Agent for the Board of Health Court appearances.
Motion made by Selectman Schold to concur with the appointment, seconded by Selectman Stowell.
Motion carried unanimously.

Reappointment of Bob Blackman, building inspector for a three year term.
Motion made by Selectman Schold to concur with the reappointment, seconded by Selectman Ashmankas.
Motion carried unanimously.

Reappointment of Liz Valero, library director for a three year term.
Motion made by Selectman Schold to concur with the reappointment, seconded by Selectman King.
Motion carried unanimously.

Standard and Poors has upgraded the town’s bond rating which is outrageous in these economic times!  This is a testament to the finance team in place.  Our borrowing rate will go down.  As a town we should be very proud.
Chairman Plante said this is a feather in our cap and it also puts us in good standing with the financial institutions.  

Wheelabrator tonnage correction is in and it puts us at a 55 ton difference.  We are running ahead of last year-we are in good shape to get a bigger check at the end of July.

Town meeting went well.  Kudos to Town Clerk for stepping in as moderator and getting votes certified.

DPW and Clerks contracts are all good for another year.  Police negotiations are going well.

Met tower will be put up as soon as the weather cooperates.


Old Business
Selectman King wants to know about the cell tower?  Mr. Spain is just about done with the lease.  
Selectman King wants to know what the pay scales are and if he got the job descriptions.  Mr. Spain will have them for the July 26th meeting as promised.
Selectman Schold wanted to know if we can separate out the police overtime in the annual report.

On a Good Note

Girls U-12 soccer team are the State champs. Congratulations to them!
Congratulations to the graduating class of 2011!

Selectman King wanted to add to on a good note; Thanks to everyone who went out to help for the threats of the tornados.  Alert and Brian Stowell went out to Spencer to help.  Many thanks to all and thank god Millbury was not affected.

Letter from Chief Handfield regarding No Parking on Church Street for fireworks on July 3 and 4 on the following streets from 6 pm to midnight:  Church Street, Canal Street, Maple Street (odd side), Pearl Street (odd side), Coral Street, Howe Ave, Atwood Ave (even side), Lincoln Ave.,(even side) Lincoln Ave. Ext., Hamilton Street and Miles Street (odd side).
Motion to approve no parking by Selectman Stowell, seconded by Selectman King.
Motion carried unanimously.

Letter from Fire Chief Matt Belsito acknowledging new recruits:  Troy Arcouette; Micheal Breault; Jake Hamilton; Jeffrey Kosiba; Donald Lizotte; and Nicholas Rinaldo.
Congratulations to all.

Planning Board Associate Member vacancy with Edd Cote’s term expiring.  The Planning Board would like to participate in the reappointment.

Letter from the Bicentennial Committee regarding donations in the amount of $51,367.60.
Motion made by Selectman Schold to accept the donations, seconded by Selectman King.
Motion carried unanimously.

Motion made by Selectman King, seconded by Selectman Schold to move into Executive Session at 8:40 p.m. under Chapter 39, Section 23B, Paragraphs 2,3 and 5.
