Board of Selectmen Minutes 03/23/2010

Stowell.  Town Manager Bob Spain, Finance Director Brian Turbitt, Treasurer/Collector Denise Marlborough, Asst. Town Clerk Judy Brink, DPW Director John McGarry, Mike O’Connor, Donald Gauthier, John Bartosiewicz, Edd Cote, Brian Ashmankus, Donna Boynton, Charlene Arsenault and concerned citizens.


Appointment of Special Police
Motion to appoint Kurt Richards as a Special Police for the Town of Millbury by Selectman Schold, seconded by Selectman King.  
Motion carried unanimously.

The Board signed the paperwork for the Water Pollution Abatement loan.

One Day Liquor License-Peppers Catering
March 28, 2010 at Asa Waters.
Motion to approve the one day license for Peppers Catering made by Selectman King, seconded by Selectman Schold.
Motion carried unanimously.

One Day Liquor License-Giuseppe Ritacco
March 27, 2010 at Asa Waters.
Motion to approve the one day license for Giuseppe Ritacco made by Selectman Coggans, seconded by Selectman King.
Motion carried unanimously.

Motion to accept the In-Line of Duty Policy from the Police Chief made by Selectman Coggans, seconded by Selectman King.
Motion carried unanimously.

Motion to accept the OPEB (Other Post Employment Benefits Trust) Policy made by Selectman King, seconded by Selectman Schold.
Motion carried unanimously.

Motion to accept the Fraud Protection Policy made by Selectman King, seconded by Selectman Schold.
Motion carried unanimously.

Previous Meeting Minutes
Motion made by Selectman King, seconded by Selectman Coggans to approve the minutes of the Tuesday March 3, 2010 meeting.  
Motion carried unanimously.

Motion made by Selectman Schold, seconded by Selectman King to approve the minutes of the Tuesday March 9, 2010 meeting.  
Motion carried unanimously.


Town Manager Report:
John McGarry, DPW Director updated the Board on the various projects that have been completed and are being done.  
Chairman Plante told Mr. McGarry that the cemeteries had better be spotless for Memorial Day.  Selectman Coggans inquired if they were going to get other proposals for the privatization of the transfer station, also asked why Polito did not fix the severed sewer pipe instead of having Fed Corp. fix it.  Mr. McGarry explained that they did not know Polito had broken it until Fed Corp was already into the project fixing it.
Selectman King inquired about the private road billing and who follows up on that.  Brian Turbitt will follow-up if the invoices are not paid.

Public Hearing:
A&D Pizza-Change of Manager, Transfer of Stock and New Officer/Director
The Board has voted on the Change of Manager to Christos Andrianopoulos and Transfer of Stock before but the ABCC has now asked for the New Officer/Director portion be approved.  This is still ongoing since George Andrianopoulos passed away.
Motion made by Selectman King to approve the transfer, seconded by Selectman Stowell.
Motion carried unanimously.

Charter Review Committee-Proposed Warrant Articles *see attached.
Mike O’Connor reviewed the changes to the charter that the Committee wants to put forth at Town Meeting.  The Charter Review Committee started meeting in September, 2009.  They met on a weekly basis and invited boards, committees, and department heads in for their input.  They have put forth seven changes that they believe are in the best interest of the Town.  Attorney Giorgio guided them for the correct wording.
Ms. Lewandowski asked questions and gave her input.  Selectman Coggans thought that the Board should appoint the Finance Director.
Chairman Plante wanted to thank the committee for all the work that was done.  Selectman King added that the committee worked well together and in the long run it all came out for the best of the town.

Vote to place questions on the Election Ballot, they deal with purchasing rescue squad fire apparatus and an aerial platform fire apparatus.  This has to pass both the ballot and town meeting.  

Motion made by Selectman Schold to place question 1 on the ballot, seconded by Selectman Coggans.
Motion carried unanimously.

Motion made by Selectman Schold to place question 2 on the ballot, seconded by Selectman Coggans.
Motion carried unanimously.

Chairman Plante mentioned that the fire dept. postponed them last year so that we could get rid of some debt first.

Town Manager Items
Joyce received the EGov Award with distinction from Common Cause for our website.  It is a way to have the people access things easier.  Mr. Spain would like to thank Joyce Ostrowski for that.

The cost of pulling from transfer station to Wheelabrator is $90.00.

National Grid-they believe they have a solution for the wires.  The lawyers have been in contact and there has been movement in that area.

Road Advisory Committee will be at the next meeting.

Cell tower on Butler Farm- There is an RFP out-the problem is that the wind and cell tower occupy the same space.

Selectman Schold asked about the gas tank-it is time to start planning for a new one.

Selectman King asked for an update on the police and fire false alarm fees and collection.  They are invoicing all false alarms-and they are in fact collecting most of them

Police have been fueling up on Route 20 because of the gas tank issue.  Thanks go out to Sutton again for stepping up for us.

Selectman Schold brought up there will be a need for more cemetery space soon.

Selectman Stowell  -“on a good note”--  Mike Scascia from the EMA received a trailer, generator, tires for the 5ton truck, underwater camera system, 8 portable space heaters, 2 water pumps and flat screen monitors at minimal or no cost.
They are doing a terrific job.

Mail:  

Letter from the Millbury Federated Church for their block party, September 18, 2010 from 12:00 pm-7:00 pm.   
Motion to close Main from Elm Street to Grove Street; Church Street, from Main to the Millbury Federated Church rear parking lot; and all of Farnsworth Court for the block party made by Selectman Schold, seconded by Selectman King.  
Motion carried unanimously.

Public notice for Central Cemetery clean up by March 31st.

Executive Session
Motion made by Selectman Coggans, seconded by Selectman King to move into Executive Session at 9:10 p.m. under Chapter 39, Section 23B, Paragraph 3 to discuss contract negotiations.

Chairman Plante stated that the Board will leave Executive solely to adjourn.
