Board of Selectmen Minutes 03/09/2010
March 9, 2010                                                                   7:00 p.m.

Present:        Board of Selectmen:  Chairman E. Bernard Plante, Joseph F. Coggans, Jr., Kenneth I. Schold, Francis B. King, Brian W. Stowell, Town Manager Spain.   
Edd Cote, Brian Asmankus, Donna Boynton, Charlene Arsenault and concerned citizens.


Change of Manager-TGI Friday’s-Attorney Al DiNapoli, spoke regarding the new manager, Jason Goodin.
Selectman Schold asked about the front door being overcrowded.  Selectman Stowell noticed a few TGI Friday’s are closing.   There are no issues at this time.  Business seems to be improving across the board.
Motion to approve the Change of Manager for TGI Friday’s made by Selectman Schold, seconded by Selectman Stowell.  
Motion carried unanimously.

Appointment of Sutton Police Specials
Motion to appoint Officer Michael H. McGee and Officer Jeffrey A. Simakauskas as Special Police for the Town of Millbury by Selectman Schold, seconded by Selectman King.  
Motion carried unanimously.

Drainlayer renewals Affordable Septic Services; R.E. Barrows Construction.
Motion to approve the renewals of Affordable Septic Services and R.E. Barrows Construction made by Selectman Schold, seconded by Selectman Coggans.
Motion carried unanimously.

First reading of In Line of Duty Death Policy from Chief Handfield.

Appointment to Butler Farm Re-Use
Motion by Selectman Schold to appoint Ernest Bernard and Karen Bott to the Butler Farm Re-Use Committee, seconded by Selectman Stowell.
Motion carried unanimously.


Previous Minutes:  
Motion made by Selectman Schold to approve the minutes of the Feb. 23, 2010 meeting, seconded by Selectman King.
Motion carried unanimously.
Motion made by Selectman Schold to approve the minutes of the Feb 23, 2010 executive session minutes, seconded by Selectman Stowell.
Motion carried unanimously.

The Board wanted to mention the High School basketball teams and what a tremendous job they have both have done.  The girls are continuing on and will be playing Wed. in Springfield.  We wish them luck!

Sewer Commission Presentation:    Mr. Spain wanted to thank the sewer commission for the work that they have done.  To have a project on time and under budget is fantastic.
Gary Nelson spoke regarding the 2005 approved project which included 4 areas of town.  They are here tonite to give a status update.  Completed on time and under budget; three million dollars under budget.   Commission would like to thank the contractors; P.Gioioso & Sons, JA Polito, and FedCorp., the Millbury Police, the engineers from AE Com, field??, project team, Joe, Marie and Dennis-they did a super job.  
Marie Cannon gave slide show presentation:  *See attached presentation.  Joe Boccadoro wanted to thank the DPW staff, the Selectmen, Town Manager, Finance Dept and Police Dept.  
Gary Nelson wanted to end with where Millbury stands.  There are about 6000 households in Millbury-4500 homes are sewered.  Another 2300 have to tie into the system.  Selectman Schold wanted to know how long they have to tie in.  The BOH mandates when they have to tie in.  They take it case by case.  
Chairman Plante wanted to thank them for coming in as it was very informative for the people of Millbury.


Town Manager Report:
Update on the gas tank-there will be another test on Friday and the DEP will be there.  If it passes or fails we will have to start planning to replace the tanks.  Mr. Spain wants to thank the Town of Sutton for stepping up and letting us use their tanks to fill up.

Monthly stats for Wheelabrator-still running about 24 tons above last year-still on pace to finish where we finished last year.

DPW Director met with Casella for an estimate on privatizing the transfer station.  Hopefully we will be able to have answers next meeting.

Update on budget:  Governor is talking about another 5% cut.  If that is the case we will then have some issues.  If we have to cut more then we will be losing services.  
There are about 20% of our roads that are structurally deficient.  If we wait any longer then more of our roads will be deficient.  If we do not use the money to fix them now, we will be worse later.  They are saying that 2012 will be the worst of the three years.  There will have to be serious changes on the way things will be done here.  
Selectman King asked what the total cuts would be if the 5% comes down.  About 1.2 million.

Old Business:
Selectman Schold wanted to know about the Prov. St. Bridge.  Going out to bid April 24-MA DOT hopes to have it finished by this year-but could be early 2011 spring.  Material is already there.  

Selectman Schold inquired about the cemetery expansion-moving right along and going well.   Chairman Plante mentioned that the cemetery not in good condition right now.  There are tracker marks.   Mr. McGarry stated that Henry Spicatelli is working there.  He works through the winter when permissible.  Used broken up ledge for Park Hill area.  Next phase is to compete the tossing of the soil near the maintenance building, then bring in gravel and loom to top off area.  Then they will hydroseed.  Completed it will expand the cemetery for 40,000 sq. ft. creating 400 additional spaces.  There are approximately 100 burials per year.    Chairman Plante wanted to know why it looks like it is so dug up in the old section- Mr. McGarry will look at it.  The frost heaves have been fierce this season.

Selectman King mentioned private roads; promised for next meeting.  We still have not heard anything from National Grid.  The bus stop-if it can’t be done let’s send it back.  The board voted to get it up and it has been going on for five years.  

Selectman King inquired about West Main Street-in attorney’s hands.  Brierly Pond?  We are as done as we can be for now.  
Selectman King wanted costs of pulling down to transfer station.

Selectman Coggans would like the Road Advisory Committee and DPW director in and give an update on what has been done and what the priorities are.  Each year the RAC meets they put together their list and we follow their recommendations.  Tomorrow is the first meeting for evaluations so they can get their list together.  

Selectman Stowell wanted to let us know that they spoke to Congressman Neal regarding the homeland security grants.  We got another contact and hopefully will move things along.
