Board of Selectmen Minutes 01/12/2010

Present:        Board of Selectmen:  Chairman E. Bernard Plante, Joseph F. Coggans, Jr., Kenneth I. Schold, Francis B. King, Brian W. Stowell.

Chairman Plante opened with the Pledge of Allegiance

Auditors-Melanson & Heath; Scott McIntire
Audit went very well; no significant audit entries.  All records kept very well.
The Opinion is clean, and the Management Letter is short.
This is their 6th audit in Millbury and he is pleased to report that there are no significant deficiencies or material weaknesses in the Management Letter.  
Chairman Plante noted that this is one of the cleanest reports he has seen; he wanted to compliment the finance department - it is because of them that this report is so good.  Mr. Spain added that it was a priority of his to get the finances in order.  He thanked Brian Turbitt, Paula Aspinwall, Denise Marlborough and their staff who make this process happen.  

7:21 p.m. Public Hearing- New Liquor License-Feng Asian Bistro
Stephen Hennessy appeared for the Chen family.  They plan to open up late summer, lease begins in September.  They are subdividing an existing building right next to Red Robin.
Motion to approve the Liquor License for Feng Asian Bistro made by Selectman Coggans, seconded by Selectman Stowell.
Motion carried unanimously.

Mill Towne Tavern: Automatic Amusement License/Common Victualler License/Pool Table License:  These are the same licenses they had at that location.
Motion made by Selectman Schold, seconded by Selectman King to approve the licenses.
Motion carried unanimously.

DRAINLAYER RENEWALS
Motion to re-new the following Drainlayers made by Selectman Schold, seconded by Selectman Coggans:
Seaver Brothers Construction, D’s Enterprises d/b/a Standard Builders, Valente Backhoe Service, L. Paquette Site Prep., F & D Truck Company, Guaranteed Builders, Inc., Mitchell Associates, AF Amorello, GN Prunier & Sons, J.E. Amorello, Inc., MidState Sewerage, JA Polito and Sons, R.H. White Construction, Ricciardi Bros., Inc., Wall Construction, Inc., Knapik Builders, Inc., Robert J. Bernard, JA Kelleher & Sons, Longwood Development Corp., Busy Bee Nursery & Landscape and Jolin Paving & Excavating.
Motion carried unanimously.

The FEMA Grant needs to be signed by Chairman Plante so that we can receive the final payment for reimbursement of the ice storm.
Motion made by Selectman Schold for Chairman Plante to sign the grant, seconded by Selectman Coggans.
Motion carried unanimously.

Motion made by Selectman Coggans to disburse the Boat Excise Tax Funds between Ramshorn Watershed, Dorothy Pond Watershed and Lake Singletary Watershed in the amount of $864.83 each, seconded by Selectman Schold.
Motion carried unanimously.


Previous Meeting Minutes
Motion made by Selectman King, seconded by Selectman Coggans to approve the minutes of the Tuesday December 15, 2009 meeting.  
Motion carried unanimously.

Motion made by Selectman Schold, seconded by Selectman King to approve the minutes of the Executive Session Tuesday December 15, 2009 meeting.  
Motion carried unanimously.

Town Manager Report
The total Wheelabrator tonnage through November is 1202.6 tons.  That is 9 tons under last year.

Selectman King asked the manager to research changing the date of Town Meeting; it would take a new by-law to change it permanently but the Board of Selectman can vote to delay it but it must be completed by June 30th.  He is not recommending moving it at this point.  Selectman Coggans wants Mr. Spain to check with the Town Clerk and Moderator before making any decisions.  

We have received an application for a road crossing permit from National Grid.  We have a couple of issues still outstanding with National Grid, the aerial trespassing on the common and Matthew Circle; Mr. Spain’s recommendation to the Board is to try to have those issues resolved before we allow them their petition.  Chairman Plante agrees.

We need to appoint Sgt. Lewos as Liquor License Agent.  Motion made by Selectman Stowell to appoint Brian Lewos as a liquor license agent, seconded by Selectman Coggans.
Motion carried unanimously.

Selectman Schold read a letter from the Town Clerk requesting appointment of a Poll Worker.
Motion made by Selectman  King to appoint Doris Collette as a permanent Poll Worker and Donald Belliveau as a Substitute Poll Worker for the 2010 election year, seconded by Selectman Stowell.
Motion carried unanimously.

Update on the Providence Street Bridge; MA Hwy has filed a notice of taking the house there.  Chairman Plante added that MA Hwy will help the tenants relocate.  Construction should start up in the spring.

Negotiations are coming up for unions including the school.  Per M.G.L. Ch. 150E the Town Manager shall attend and vote as part of the school committee negotiations.  Motion made by Selectman Coggans to appoint the Town Manager, seconded by Selectman Schold.
Motion carried unanimously.

Mr. Spain asked the DPW Director to put together a progress report (or a “where we are”) on the budget.  Getting ready to declare a snow & ice emergency.  All costs have gone up.  We have to budget conservatively.  

Next meeting in Executive Session Mr. Spain would like to discuss strategy for the upcoming union negotiations.  He hates to be optimistic, but rumor has it that the Governor’s going to level fund state aid which would be a God-send.  Chairman Plante said that revenues have not been that bad.   Department head budgets are due on the 26th and the school is giving their preliminary budget on the 13th; should have Governors numbers on the 18th.  Chairman Plante added that the problem with our budget is the costs that we cannot control that automatically go up, electric, heat, insurance, etc.  We cannot count on free cash.

Old Business/New Business
Selectman King wanted an update on the roundabout - it is usually a 5 year run when they look into a project of this type.  Chairman Plante said for Town Manager to speak with Barry Lorian.  He also inquired about W Main Street.  Town Manager told him we have not heard anything from contractor, we have not gotten the final numbers yet; the work is done, the initial bill is higher than we thought it should be.  The Sewer Commission is discussing this tonight in their meeting.
Long discussion regarding the WRTA bus shelter issue and where to put it.  Selectman Coggans would like to send it back to the WRTA.  Selectman King thinks the people waiting for the bus needs a shelter from the weather.
Selectman King made a motion to put shelter on Main Street, seconded by Selectman Stowell.
Motion carried unanimously.

Chairman Plante wanted to thank Michael Kamendylis for making the shelves at Town Clerk’s window and Treasurer/Collector window. If any other residents would like to contribute to the Town we would be most appreciative.

Chairman Plante would like a list of all vehicles on the road for the Town.

Motion made by Selectman King, seconded by Selectman Coggans to accept the donations.
