Board of Selectmen Minutes 10/27/2009

Present:        Board of Selectmen:  Chairman E. Bernard Plante, Joseph F. Coggans, Jr., Kenneth I. Schold, Francis B. King, Brian W. Stowell.

Chairman Plante opened with the Pledge of Allegiance

Public Hearing 7:05 p.m.
Tax Classification Hearing:  Public Notice read by Selectman Schold.
Board of Assessors Chairman Dennis Peil, informed the Board of Selectmen that the Board of Assessors recommend a single tax rate for fiscal 2010.  
Motion made by Selectman Coggans, seconded by Selectman Schold to close the public hearing at 7:15 pm.  Motion carried unanimously.
Motion made by Selectman Coggans, seconded by Selectman King to approve single tax rate.
Motion carried unanimously.

Motion made by Selectman King to sign the Special State Primary Warrant, seconded by Selectman Stowell.
Motion carried unanimously.

One Day Liquor License-Marie’s Catering
November 6, 2009 at Asa Waters.
Motion to approve the one day license made by Selectman King, seconded by Selectman Schold.
Motion carried unanimously.

One Day Liquor License-Cardoos Catering
October 30, 2009 at Asa Waters.
Motion to approve the one day license made by Selectman Stowell, seconded by Selectman King.
Motion carried unanimously.

Motion made by Selectman Schold to approve the Change of Officers/Directors for Applebees, seconded by Selectman Coggans.
Motion carried unanimously.
Discussion regarding the amount of liquor licenses we have left in town.

Previous Meeting Minutes
Motion made by Selectman Schold, seconded by Selectman Coggans to approve the minutes of the Tuesday October 13, 2009 meeting.  
Motion carried unanimously.
Motion made by Selectman Schold, seconded by Selectman Coggans to approve the executive session minutes of the Tuesday October 13, 2009 meeting.  
Motion carried unanimously.

Town Manager Report
When the Energy Advisory Committee was created the Board voted seven members and they already appointed eight so Mr. Spain would ask the Board to amend the members to nine people.
Motion to amend the committee to nine members for the Energy Advisory Committee made by Selectman Stowell, seconded by Selectman Coggans.
Motion carried unanimously.

Mr. Spain is asking the Board to waive the raffle permit fee for Bicentennial Committee because it is a Town run committee.
Motion made by Selectman Coggans, seconded by Selectman Schold to waive the raffle permit fee for the Bicentennial Committee.
Motion carried unanimously.

We received the check from Verizon in the amount of $25,000 that Joyce worked so hard to get.  We are expecting 9c cuts from the Governor.  Hopefully it will not be disastrous.

The tax rate will be $13.46 and free cash should be certified soon.  It will be significantly less than last year.  

Mr. McGarry asked to put the winter parking ban in place; violators will be towed.
Motion made by Selectman Stowell, seconded by Selectman Coggans to ban parking on streets after 2” of snow from December 1, 2009 - April 1, 2010.  
Motion carried unanimously.

Transfer of License from Troios Inc. to Perkins Entertainment LLC-Public Hearing 7:30 Attorney Peter Keenan, Pam Perkins, David Troy, Karen and John Gagliardi.

Attorney Keenan spoke regarding Perkins Entertainment LLC to transfer the existing liquor license from Troios Inc. to Perkins Entertainment.  He recognizes that there have been issues in the past at this establishment and noted that Pam Perkins is the sole owner of the establishment.  If license is approved then the real estate will be bought.  The business will be operated by Pamela and goal is to employ people from Town.  The establishment will be cleaned up, painted, new sign-applied to the lottery commission for sale of lottery.  Pam has extensive experience in this business.  Bartended at the St. Charles, Foggy’s and Vinny T’s.  She is TIPS certified as will all employees.  They want to make the town proud of this establishment.
Selectman Coggans wanted to know if there was any pledge of stock.  There is no pledge of stock; He would like to know if she plans to have any type of entertainment?  She would like to take it as it comes-but maybe a one man band or karaoke?  She would like to keep her options open.

Selectman King wanted to know who the staff was going to be and if any holdovers from the Hide-A-Way?  The workers would be Pam and Dave Perkins.  They would like to hire a M-F daytime person, 1 weekend person, 3 night people.  They have not discussed any holdovers.  

Mr. Spain wanted to know if she understood the raffle permit laws.   She would refer this to her attorney.

Motion to transfer the license made by Selectman Coggans, seconded by Selectman Stowell.
Motion carried unanimously.

Motion to close public hearing at 7:40 p.m. made by Selectman King, seconded by Selectman Schold.
Motion carried unanimously.

Town Manager Report (continued)
Dwinell Road-Laurie Connors has called in the bonds.  They are hoping to get the developer to finish the road, finish it themselves or give us the money to get it done.

We need to appoint a conflict of interest liaison regarding the new laws for the ethic commission.
Motion made by Selectman Schold to appoint the manager, seconded by Selectman Stowell.
Motion carried unanimously.

We have a shortage of fields in the town so we are trying to get things going with a local company that would like to fund the cost of a ball field at the sewer plant.  It would be fenced in.  The DPW director is engineering a plan.  

Citizen Speak
Will Tremblay spoke regarding how much Ray Dubois has done for this town.    7:00 pm. November 12 at the Federated Church for a meeting to try to get something together to raise some money for the Ray Dubois Scholarship Fund.  

Old Business
Selectman King brought up the issue of the skateboarders at the Federated Church-many accidents happening-is there anything more we can do?
The Town Manager will talk to the chief.  A park like that costs about $25,000.  We have talked to many people, if they raise the money we will find a place to put the park.  
Selectman Stowell brought up the tennis courts at Windle Field but that is a school committee issue.
Selectman Coggans mentioned that as long as the church allows the kids to use their property then they will.

Mail
Letter regarding donations to Bicentennial Committee in the amount of $4,881.00 from the wine tasting and donation cans.

Motion made by Selectman Coggans, seconded by Selectman King to adjourn at 8:00 p.m.  Motion carried unanimously.
