Board of Selectmen Minutes
Municipal Office Building – Selectmen’s Meeting Room
July 28, 2009                                                                   7:05 p.m.


Present:        Board of Selectmen:  Chairman E. Bernard Plante, Joseph F. Coggans, Jr., Kenneth I. Schold, Francis B. King.   
Absent:  Brian W. Stowell

Robert Spain, Town Manager, Edd Cote,  Rita Sullivan, Richard Bowen, Kopleman & Paige, Dee Moschos and Sharon Siegal, Mirick, O’Connell, Josh Farnsworth, The Millbury-Sutton Chronicle, Donna Boynton, Telegram & Gazette and concerned citizens

Chairman Plante opened with the Pledge of Allegiance

A Proclamation for Smokey Bear’s 65th Birthday was read.  Rita Sullivan will be presenting it to Smokey on August 6th at the Annual Library Picnic.

Dee Moschos spoke on his and Sharon Siegal’s behalf to thank the town for appointing them as Labor Town Counsel for another year.


7:12 p.m. Hide-A-Way Public Hearing

Ashley Plasse spoke on her own behalf regarding her wishes to purchase the business and change manager/transfer stock. Her TIPS certification was a misunderstanding; this will solely benefit her; there have been no problems or incidents at the bar in the past two years that she has been running it.  She would like to be thought of as a business owner, not the daughter of the current owner.
Our attorney Rich Bowen from Kopelman & Paige questioned Ms. Plasse.  She used Attorney Kring to look over paperwork.  She has been working at the Hide-A-Way since 2002.  Ms. Plasse was questioned extensively regarding the paperwork and as to why three versions were submitted.
At the request of Ms. Plasse a Motion to recess the hearing until 7:00 pm Tuesday August 25, 2009 was made by Selectman Coggans, seconded by Selectman Schold.  
Motion carried unanimously.

The Public Hearing was recessed at 7:42 p.m.

One Day Liquor License-Loaves & Fishes
August 1, 2009 at Asa Waters.
Motion to approve the one day license made by Selectman King, seconded by Selectman Schold.
Motion carried unanimously.


Review of Town Manager
Strong review overall. Weakness still is communication. Average was 3.63.  Selectman King would like to see Mr. Spain review himself next year.

Previous Meeting Minutes
Motion made by Selectman Schold, seconded by Selectman King to approve the minutes of the Tuesday June 30, 2009 meeting as corrected to read “Motion made by Selectman Coggans” regarding Matthew Wunschel.  
Motion carried unanimously.

Motion made by Selectman Schold, seconded by Selectman King to approve the minutes of the July 14, 2009 meeting.
Motion carried unanimously.

Motion made by Selectman Coggans, seconded by Selectman King to approve the executive minutes of the July 14, 2009 meeting.
Motion carried unanimously.

Town Manager Report
A donation of $5,000.00 was made to the Washington Park Fund from the Lions Club.
Motion made by Selectman Schold to accept the donation, seconded by Selectman King.
Motion carried unanimously.
This now brings the fund up to $12,390.00

Dwinell Road is not a feasible outlet.  The McCracken Rd. project is still waiting for the pipe to come in.  Not going to start until the week of August 3rd.  Also intending to start repaving of Park Hill Ave and offshoots.

Mr. Spain would like the Board to waive the permitting fees for Habitat for Humanity.
Motion by Selectman Schold to waive all permit fees, seconded by Selectman King.
Motion carried unanimously.

We did not get the COPS grant money.  There is another grant that they are working with Senator Moore’s office.  They did get the Justice Assistance Grant for about $28,000.  

August 6 is the annual library Picnic.

There will be no meeting August 11.  Town Manager Spain will be on vacation from August 10-14.  Chief Handfield will be acting Town Manger.

Mr. Schold was inquiring about the Brierly Pond Dam.

Mail
Thank you card from Irene Army.

Bill Borowski sent a letter and spoke regarding a block party on Shirley Ave.  He would like to close the left side of Shirley Ave from 2:00 p.m. to 6:00 p.m. on August 29.

Motion by Selectman Coggans contingent upon the Police and Fire Chiefs ok, seconded by Selectman King.
Motion carried unanimously.

Application from Sandy Cristo to join the Charter Review Committee.
Motion made by Selectman Schold to appoint Mrs. Cristo to the Charter Review Committee,   seconded by Selectman King.
Motion carried unanimously.

Executive Session
Motion made by Selectman Coggans, seconded by Selectman King to move into Executive Session at 8:45 p.m. under Chapter 39, Section 23B, Paragraphs 3.

Chairman Plante stated that the Board will leave Executive Session solely to adjourn; no other business will be conducted.

The Board returned to open session as 9:50 p.m.

Adjournment
Motion made by Selectman Coggans, seconded by Selectman King to adjourn at 9:50 p.m.  Motion carried unanimously.
