Board of Selectmen Minutes
Municipal Office Building – Selectmen’s Meeting Room
July 14, 2009                                                                   7:05 p.m.


Present:        Board of Selectmen:  Chairman E. Bernard Plante, Joseph F. Coggans, Jr., Kenneth I. Schold, Francis B. King, Brian W. Stowell.   

Robert Spain, Town Manager, Edd Cote, Millbury Police officers, Diane Lewos, Tom Reilly, The Millbury-Sutton Chronicle, and concerned citizens

Chairman Plante opened with the Pledge of Allegiance

Pinning ceremony for the Promotion of Brian Lewos to Sergeant.  

Plaque was presented to Walter Hagstrom for his over 30 years of service to the Town on the Board of Assessors as well as many other boards/committees.

Plaque was presented for Richard Plante which was accepted by his daughter Michelle, for his 30+ years of service to the Town as Cemetery Commissioner and Fire Fighter.

New Drainlayer-Peter Fox: He would like to do tie-ins for new section near Sutton lines.
Motion made by Selectman Schold to approve the new drainlayer, seconded by Selectman Stowell.
Motion carried unanimously.

Motion made by Selectman Coggans, seconded by Selectman Schold to appoint the Financial Management Task Force, Gary Nelson, Jude Cristo, E. Bernard Plante, Brian Turbitt, Bob Spain, Susan Hitchcock, Tom Clawson, and Joe Barbato.  It was noted that they should appoint a couple of citizens at large.  
Motion carried unanimously.

One Day Liquor License-Creedon & Company
July 19, 2009 at Asa Waters.
Motion to approve the one day license made by Selectman King, seconded by Selectman Schold.
Motion carried unanimously.

New Drainlayer-Thomas Mallet and Sons- He is doing a house on Burbank Street and would like to tie in.  Motion made by Selectman Schold to approve the new drainlayer, seconded by Selectman King.
Motion carried unanimously.

Letters of intent from Lisa Shaw and Leonard Marrino to join the Millbury Affordable Housing Trust.  
Motion made by Selectman Schold to appoint Lisa Shaw and Leonard Marrino to the Millbury Affordable Housing Trust.
Motion carried unanimously.

One Day Liquor License-Marie’s Catering
July 17, 2009 at Asa Waters.
Motion to approve the one day license made by Selectman Coggans, seconded by Selectman Schold.
Motion carried unanimously.

Previous Meeting Minutes
Motion made by Selectman Stowell, seconded by Selectman King to approve the minutes of the Tuesday June 8, 2009 meeting.  
Motion carried unanimously.

Motion made by Selectman Stowell, seconded by Selectman King to Approve the minutes of the June 9, 2009 meeting.
Motion carried unanimously.

Motion made by Selectman Schold, seconded by Selectman Stowell to Approve the minutes of the June 23, 2009 meeting.
Motion carried unanimously.

Town Manager Report:
Mr. Spain asked John McGarry to update the Board on projects throughout the town.  *See attached.

Motion made by Selectman Coggans to close McCracken road seconded by Selectman King.  Motion carried 4-0-1.  Chairman Plante abstained.
Motion made by Selectman Stowell to close Dolan Road seconded by Selectman Schold.  Motion carried 4-0-1.  Chairman Plante abstained.
Mr. Spain asked the Board to sign the one year ambulance contract with Alert Ambulance-they are working with their issues and it is only one year.  
Motion to sign contract made by Selectman Coggans for discussion seconded by Selectman King.  Selectman Schold likes the ideas of 10 day reports, wants to know what the benefit of registering the vehicles in the town where they are garaged.  Selectman Coggans let him know that it is solely for excise tax.  
Motion carried 4-0-1.  Selectman Stowell abstained.

We would like to wish Irene Army well who is leaving as a library page for 20 years.  She has been a godsend for Liz at the library and will be much missed.  Selectman Coggans will present her with a proclamation on Thursday.

Joyce in our office completed a state procurement course on Design and Building Construction Contracts and got a 98 on the test.  She does a lot of the routine contracts and bids-she helps the manager tremendously.  The DPW Director is certified, Joyce is certified and Mr. Spain will finish the program.  

Mr. Spain will be on vacation Friday and Monday and August 8th through the 15th.  This weekend he will appoint Brian Turbitt as Acting Town Manager as the Chief will be away as well.

Selectman King and Mr. Spain will be away for the August 11th meeting.
Motion made by Selectman Coggans to cancel meeting on August 11th, seconded by Selectman Stowell.
Motion carried unanimously.

The evaluation for the Town Manager will be done soon.  Selectman Stowell will do it on time served.

New Business:
Selectman Coggans made a motion to remove Mr. Spain from the Charter Review Committee, seconded by Selectman King.
Motion carried unanimously.
The vacancy will be appointed at the next meeting.

Chairman Plante was approached by a few citizens that asked to do volunteer work such as mowing lawn, clean-up, etc.  He encourages anyone with time on their hands to help out their community.  

Selectman King inquired about the Verizon contract- They have complied with the contract to date.  They have under the contract up to four years to provide service to the whole town-they are 70-80%.

The Providence Street Bridge is going back out to bid.  The money and supplies is there so things should move alone faster once they award the new contract.  

Selectman King made a motion to appoint the Chairman as the sole spokesman to the press and manager regarding Selectman issues, seconded by Selectman Stowell for discussion.  Personal matters can be discussed by each selectman.
Motion carried unanimously.

Mail:
Letter from the Board of Fire Engineers regarding Adam Roy completed and passed the District 7 Recruit Training Program.  We commend him for this achievement.

Letter from the Conservation Commission recommending David Bodreau to fill the vacancy left by Anthony Cameron.  
Motion made by Selectman Stowell to appoint David Boudreau to the Conservation Commission, seconded by Selectman Schold.  
Motion carried unanimously.

Executive Session
Motion made by Selectman Coggans, seconded by Selectman King to move into Executive Session at 9:20 p.m. under Chapter 39, Section 23B, Paragraphs 3, 4 and 6.

Chairman Plante stated that the Board will leave Executive Session solely to adjourn; no other business will be conducted.

The Board returned to open session as 11:00 p.m.

Motion made by Selectman Coggans, seconded by Selectman King to adjourn at 11:05 p.m.  Motion carried unanimously.
