Board of Selectmen Minutes
Municipal Office Building – Selectmen’s Meeting Room
May 12, 2009                                                                    7:05 p.m.



Present:        Board of Selectmen:  Chairman E. Bernard Plante, Joseph F. Coggans, Jr., Kenneth I. Schold, Francis B. King, Brian Stowell.   

Robert Spain, Town Manager, Edd Cote, Richard Valentino, Tom Reilly, The Millbury-Sutton Chronicle, and concerned citizens

The meeting opened with the Pledge of Allegiance

Reorganization of Board of Selectmen:  
Selectman King made a motion to keep Board as is; E. Bernard Plante, Chairman, Joseph Coggans, Vice-Chairman, Kenneth Schold, Clerk, seconded by Selectman Stowell.
Motion carried unanimously.

Chairman Plante said that this is going to be a very tough year.  We as a Board are going to try to get the people laid off back to work as soon as possible.  State Aid is getting worse and we don’t’ want to raise taxes.
Welcome our new member Brian Stowell to the Board.

Motion made by Selectman Stowell, seconded by Selectman King to approve the meeting of fiscal 2010 for every 2nd and 4th Tuesday of the month.
Motion carried unanimously.

Selectman Coggans presented Chairman Plante with two donated flags from the Department of Correction.  On behalf of the Board we want to thank the DOC and thank Selectman Coggans for putting the article forward.  

Proclamation for Gilberte Army who is turning 100 on May 22, 2009 was read.  Selectman King will present it to her.

Change of Manager - Applebees
Attorney Barry Gerstein appeared for Applebees. They would like Kenneth Tousignant as manager.  
Motion made by Selectman Coggans to approve the change of manager, seconded by Selectman Schold.
Motion carried unanimously.

Change of Owner
Matt Volpe appeared for the new owners of Superior Oil, Petrolex II LLC d/b/a Superior Oil.  They are a Rhode Island company, have applied for all the permitting and will try to keep things running the same.
Motion by Selectman Schold to approve the tanks, seconded by Selectman Coggans.
Motion carried unanimously.

New Drainlayer:
Mainstone, Inc.-Brian Bergin-installing a new sewer line at 231 West Main Street.
Motion made by Selectman Schold to approve the license, seconded by Selectman Stowell.
Motion carried unanimously.

One Day Liquor Licenses
Marie’s Catering-Asa Waters- May 15, 2009.
Motion made by Selectman King, seconded by Selectman Schold, to approve a one day liquor license for Marie’s Catering on May 15, 2009.
Motion carried unanimously.

Marie’s Catering-Asa Waters- May 16, 2009.
Motion made by Selectman King, seconded by Selectman Schold, to approve a one day liquor license for Marie’s Catering on May 16, 2009.
Motion carried unanimously.

Bartending Service of New England-Asa Waters- June 3, 2009.
Motion made by Selectman King, seconded by Selectman Schold, to approve a one day liquor license for Bartending Service of New England on June 3, 2009.
Motion carried unanimously.

Board of Selectmen Reappointments:
Conservation Commission, David Palleiko; Council on Aging, Edna Lapan, Everett Grahan; Board of Registrars, Everett Grahan; WRTA, Judy O’Connor; Liquor License Agents, Chief Handfield, Sgt. Desorcy; Butler Farm Re-Use, Victor Irr; Forest Fire Warden, Matt Belsito; Board of Fire Engineers, Phil Day, Matthew Belsito, David Rudge, Jeff Dore;  Earth Removal Board, Al Peloquin.
Motion made by Selectman Schold to reappoint the above names, seconded by Selectman Coggans.
Motion carried unanimously.

Previous Meeting Minutes
Motion made by Selectman Schold, seconded by Selectman Coggans to approve the minutes of the Tuesday April 6, 2009 meeting.  
Motion carried unanimously.
Motion made by Selectman Schold, seconded by Selectman King to approve the executive minutes of the Tuesday April 6, 2009 meeting.  
Motion carried unanimously.
Motion made by Selectman Schold, seconded by Selectman King to approve the minutes of the Tuesday April 14, 2009 meeting.  
Motion carried unanimously.
Motion made by Selectman Schold, seconded by Selectman King to approve the executive minutes of the Tuesday April 14, 2009 meeting.  
Motion carried unanimously.
Motion made by Selectman Stowell, seconded by Selectman King to approve the minutes of the Tuesday May 5, 2009 meeting.  
Motion carried unanimously.

Town Manager Report:
Mr. Spain thought everything went well at the town meeting.  We need a special town meeting for June 23, at 7:00 in the high school auditorium to make some adjustments to the budget.  
We are in the process of open registration to Blue Cross from Fallon and Tufts.  Trying to make sure no one falls through the cracks.  Today was the first day for the benefits fair, there are four days total.  We will use some of that money to restore some reduction in force.    
Motion made by Selectman Coggans to open the warrant and set a special town meeting for June 23, 2009, seconded by Selectman Schold.
Motion carried unanimously.

Update on tonnage at the transfer station is 250 tons for April.  Our yearly total so far is 2,313.19.  We are still on track to finish under tonnage.

Town Manager Reappointments:
Emergency Management Auxiliary Police, Ronald Tranter, Gary Gagne; Sewerage Commission, Gary Nelson; Animal Control Officer, Dan Chauvin; Municipal Fire/Building Code Violations Hearing Officer, Deborah Plante; Asa Waters Task Force, Dennis Hill, Judith Murphy; Certified Weigher, Vernon Jackson; Constable, Stewart Barden, Karl Swenson;  Ponds & Lakes Commission, Ken Schold, Bruce Hjort.
Motion made by Selectman Stowell to concur with the reappointments listed above, seconded by Selectman Schold.
Motion carried unanimously.

Appointing Harold Proodian to Bicentennial Committee.
Motion made by Selectman Stowell, seconded by Selectman Schold to concur with the appointment.
Motion carried unanimously.

Appointing Kevin Krassopoulos as a full-time Public Access Director for the Town. Looking to expand coverage of meetings and events.  His entire salary and benefits are coming from public access grants- not tax dollars.
Motion to concur with the appointment of Kevin Krassopoulos made by Selectman Schold seconded by Selectman Stowell.
Motion carried unanimously.

The brush chipping is taking much longer than initially planned.  Bids were way too high so we decided to do it internally.  DPW is limited-but we are trying to get it all done.  Total cost of project should be $50,000; we will be reimbursed from FEMA about $26,000.  We will get to the street sweeping; the cemetery is coming along and keeping up with ball fields as well.

Selectman Schold wants to thank Boy Scout Troop 109 for helping to put flags on the graves with the veterans’ council.

Selectman King does not want to let the FEMA money get away from us; please stay on top of it.

The Selectmen are looking for people to serve on the Millbury Affordable Trust Fund.

Town Planner is asking Chairman to sign a letter for a back up grant.
Motion made by Selectman Stowell to sign the letter, seconded by Selectman Schold.
Motion carried unanimously.

Selectman Coggans would like the Charter Review Committee to move along.  We are waiting for two more members from the Moderator.

Financial Management Task Force will get going after town meeting and budget time.  We will still need planning for the future-especially in these bad times.

Roadway Advisory Committee is trying to put together the roads that need to be done this year with the Chapter 90 money.  We should be getting around $320,000.  

The Providence Street bridge crew is trying to negotiate with the contractor.

We are still waiting to hear from Congressman Neal’s office regarding the grant for the fire truck.

The Butler Farm gardening plots should be ready this weekend.  Steve Sharon will be tilling it with his plow.

Selectman King would like to thank Warren Gardner for grinding the stump on the common.  He also wanted to know if National Grid was going to move those wires.

It will take around $8,000 to replace that tree.  We appreciate all the work that Mr. Gardner does around town.  Selectman Stowell wanted to mention a fund raiser is being put together to replace the tree with another copper beach.  

Chairman Plante wants to thank the school committee, dept heads, town manager and his staff for being well prepared for town meeting.

Mail:
Letter from Fire dept regarding a donation of $1500 for fire equipment from the Morin family.
Motion to accept the donation made by Selectman Schold, seconded by Selectman Coggans.  Motion carried unanimously.

Letter from Police Chief regarding National Police Week.

Letter from Senator Michael Moore regarding the budget.

Adjournment
Motion made by Selectman Coggans, seconded by Selectman King to adjourn at 8:25 p.m.  Motion carried unanimously.
