Board of Selectmen Minutes
Municipal Office Building- Selectmen's Meeting Room
July 8, 2008                                                                    7:00 P.M.



Present:  Board of Selectmen: E. Bernard Plante, Joseph J. Coggans, Jr., Kenneth Schold, Francis B. King, Michael O. Moore.

Robert J. Spain, Town Manager, Brian Turbitt, Tom Reilly, The Millbury-Sutton Chronicle and Donna Boyton, The Telegram & Gazette, and concerned citizens,

Chairman Plante opened the meeting with the Pledge of Allegiance

Laurie Connors- McCracken Road and Greenwood Street.
Chairman Plante recused himself from the room as he is a MA Highway employee.
The road improvement project they are proposing is widening the 146 bridge, vertical and horizontal alignment of McCracken Road, widen McCracken road, 28 feet of width, now it varies from 21-26 feet.  Install sidewalk on McCracken Road, improvements to intersection, install sidewalk on Greenwood Street from flood control bridge to intersection, repave bridge to intersection.  Preliminary estimate is $5.9 million.   She is hoping to have project funded through original 146 interchange project.  MA highway requires the town to show a commitment to the project by funding design and right of way acquisition.   She is willing to ask the town to fund the permitting and design.  Selectman Coggans said the Mall may take some costs of this.    The cost is roughly $600,000 for design.  Mr. Spain is reasonably confident that Mall would participate-may not fund it all but most.   Selectman Schold wanted to know if there would be land taking involved.  Yes, there may be.    If we succeed at this point then in September they will make a presentation to the committee.
Selectman Moore asked at what point public hearings will be held?  That would be up to MA Highway.  
Motion made by Selectman King, seconded by Selectman Schold to submit the project to the State Highway Department for review.
Motion carried 4-0-1. Chairman Plante abstained.

Minutes of the Meeting - June 24, 2008
Motion made by Selectman Schold to approve the minutes of the meeting as written, seconded by Selectman King.
Motion carried unanimously.

Minutes of Executive Session - June 24, 2008
Motion made by Selectman Moore, seconded by Selectman Coggans to approve the minutes of the Executive Session as written.
Motion carried unanimously.


TOWN MANAGER REPORT

Snow and Ice Transfer
Transfer $34,470.47 from Police Salary Fund to Snow and Ice Fund-only 33B transfer this year.
Motion made by Selectman Moore, seconded by Selectman King to approve the transfer.
Motion carried unanimously.

Update on Sewer Project
Martin Street is moving right along.  Going to start on the lower end of Park Hill.  They shut down the Grafton Road piece-moved to Scott Road because of holiday.  They will go back to Grafton Road.  Staying within budget-may end up with some money after project is completed.  

Anna Lewandowski asked a question regarding the blasting.  She wanted to remind the people that they only have 30 days to file the form if you have damage to your home.  Form goes to the fire department.  

Mr. Spain wanted to commend the Police Department and DPW regarding the storm last week with trees down and power lines down.  On Saturday July 12th between 7-3  the DPW will have a Chipping Day at the Highway Garage.  

Vinny Pignataro-appointment as Special Police Officer - Selectman Coggans recused himself from the room.  Mr. Spain relayed from the Chief that he is qualified but not a Millbury resident.  
Motion to postpone appointment until we can get more detail made by Selectman King, seconded by Selectman Schold.  
Motion carried 4-0-1.

Announced that only the Town Clerk and Treasurer's Office will be open until 7:00 p.m. on Tuesdays.  Selectman Coggans does not believe the other departments should be closed.  Chairman Plante does not understand why the other offices are not busy.

Tonnage for the first 6 months is 1,354, we were allowed 1500.  By contract it should only be residential trash- no businesses allowed.  Selectman Schold wanted to know if the recycling is working?  Yes, especially since we have made it easier for the people with the single stream system.  Selectman King asked how the metal is doing?  Mr. Spain said it is phenomenal; every couple of weeks getting $4,000-$5,000.00.


NEW BUSINESS

Selectman King wanted to know if they are looking into a hazardous waste day.  Yes but it is almost $12,000.00 and it was not budgeted, but looking into it.  Not under a threat of penalty-would rather be proactive about.  Mr. Spain would like to make it more routine in order to keep the cost down.  Selectman King suggested they look at doing it together with Sutton. Mr. Spain will look into it.

Chairman Plante wanted to know when the paving will start- Mr. Spain told him soon.

NSTAR?    We are fine there.  They will need permits in the future.  

Alpine paving will be on hold, Aquarion needs to do some work on the road.  

Selectman Moore wanted to know about the RFP for legal council?  Mr. Spain said that it is ready to go out.

Selectman Schold wanted to know if anything was found regarding dogs at cemetery.  There is no law per se - but something that he could talk to the dog officer about regarding dog "littering".  There is no signage there- it has been taken down.

Motion made by Selectman Coggans, seconded by Selectman Schold to move into Executive Session at 7:45 p.m. under Chapter 39, Section 23B, Paragraph 3.

Chairman Plante stated that the Board will leave Executive Session only to adjourn.

The Board returned to open session at 8:45 p.m.

Motion made by Selectman Schold, seconded by Selectman Moore to adjourn at 8:45 p.m.  Motion carried unanimously.
