Planning Board Minutes 10/18/2010
The regularly scheduled meeting of the Millbury Planning Board was held on Monday, October 18, 2010, at 7:00 p.m., in the Municipal Office Building, 127 Elm Street, Millbury, MA. Chairman Richard Gosselin presided.

Present:  Richard Gosselin, Gary Schold, Jeffrey Markarian, Paul Piktelis, Anna Lewandowski, Associate Member Edd Cote

Mail

Gary Schold read letter from Dennis Ganash, 2 Diana Hill Drive,  dated October 5, 2010, regarding his ongoing drainage issue at  Cronin Brook Heights.  He also read e-mail from DPW Director John McGarry which indicated that he had  inspected the drainage installed at 2 Diana Hill Drive, this is clean stormwater and is authorized to go into the drainage system.  

Mr. Schold read letter dated September 28, 2010, from Robert Gallo, Fox Gate, Inc., regarding Autumn Gate Estates, and his proposal to collect the bond from Safe Guard.  He outlined his offer to pursue the bond and incur the associated costs.  He asked to appear before the Planning Board.  The Board agreed that this conflicts with existing litigation and will forward Mr. Gallo’s letter to the Board of Selectmen.

Minutes

Motion to approve the minutes of September 27, 2010 by Gary Schold, seconded by Paul Piktelis, motion carried unanimously.

Naming of Access Way to Wheelabrator

Mr. Miller would like to name the roadway into Wheelabrator which was established through the ANR process.  It is a private way.  The Board identified issues with fire, police and abutters who would have to be notified.  No action was taken.

7:30 p.m.       54/56 Canal Street Public Hearing, Cont.  
                To be postponed to 7:30 p.m. on November 8, 2010  

Gary Schold read letter from applicant requesting a continuation of the public hearing to November 8, 2010.  Motion by Jeffrey Markarian, seconded by Gary Schold, to continue the public hearing to November 8, 2010 at 7:30 p.m.  The meeting is to be held at the Millbury Senior Center.  Motion carried unanimously.



Discussion:  Revisions to Subdivision Rules & Regulations

The Board will begin consideration of revisions to the Town’s Rules & Regulations Governing the Subdivision of Land.

Street lighting was identified, Ms. Connors would like to require the use of LED streetlights.  Mrs. Lewandowski recommended eliminating the streetlight requirement in some subdivisions.  The Board would consider this after input from safety officers, police and DPW.  

Mrs. Lewandowski would also like the Planning Board to have the ability to require a new purchaser of an approved subdivision to appear before the Planning Board again.  Ms. Connors stated that the Board cannot consider ownership when acting on a subdivision.

Executive Session

Motion to enter into Executive Session for the purpose of discussing pending litigation, and to return to open meeting for the purpose of adjournment,  by Anna Lewandowski, seconded by Paul Piktelis, upon unanimous roll call vote motion carried.  

Adjournment

Motion to adjourn by Anna Lewandowski, seconded by Paul Piktelis, motion carried unanimously. Meeting adjourned at 8:45 p.m.
