Planning Board Minutes 06/28/2010
The regular meeting of the Millbury Planning Board was held on Monday, June 28, 2010, at 7:15 p.m., in the Municipal Office Building, 127 Elm Street, Millbury, MA.  Chairman Richard Gosselin presided.

Present:  Richard Gosselin, Jeffrey Markarian, Anna Lewandowski, Paul Piktelis, Associate Member Edd Cote

Absent:  Gary Schold

7:15 p.m.       Eastview Acres Performance Guarantee

Bob Vigneau was present to address the Board.

The Board continued discussion regarding acceptance of the Performance Guarantee for Eastview Acres.  All exhibits to be attached to the agreement are now complete and have been approved by Town Counsel.

Motion by Jeffrey Markarian, seconded by Paul Piktelis, to accept Performance Bond secured by escrow account in the amount of $785,000.00 to guarantee the construction of the ways and municipal services serving the subdivision of land shown on a plan entitled “Eastview Acres” Definitive Subdivision of Land in Millbury, Massachusetts, dated September 13, 2004, as amended September 2, 2008, prepared by Thompson-Liston Associates, Inc. , 51 Main Street, Boylston, MA and recorded at Worcester Deeds Plan Book 870, Plan 116, motion carried unanimously.

Motion by Jeffrey Markarian, seconded by Paul Piktelis, to release lots 15 – 19 and lots 1 – 5 from the covenant recorded in Worcester Deeds Book 43344, Page 238 relative to plan entitled “Eastview Acres”, dated September 13, 2004, as amended September 2, 2008, and recorded at Worcester Deeds Plan Book 870, Plan 116.  The Town Planner shall retain said Partial Covenant Release in her possession until the TPR Homes, LLC provided evidence, for Town approval, that the Escrow Account described in the Bond Agreement is in existence, that the type and quantity of funds are sufficient and that the escrow agent has sole control over the escrow funds, motion carried unanimously.

Mr. Vigneau will make the escrow account accessible by Town Planner signature.  She would have to send a letter to Fletcher, Tilton and Whipple law firm to ask them to release money.

Town Planner will forward a letter to the Building Inspector advising him of conditions to release lots for building and occupancy permits.




Summer Schedule

Motion by Jeffrey Markarian, seconded by Paul Piktelis, to cancel the July 12, 2010 meeting and hold a meeting on July 19, 2010 instead.  Motion carried unanimously.

Motion by Jeffrey Markarian, seconded by Paul Piktelis, to cancel the August 9, 2010 and August 23, 2010 meetings and reschedule to August 16, 2010, motion carried unanimously.

Minutes

Motion by Jeffrey Markarian, seconded by Paul Piktelis, to accept the minutes of June 14, 2010, motion carried unanimously.

Adjournment

Motion to adjourn by Jeffrey Markarian, seconded by Paul Piktelis, motion carried unanimously.
