The regularly scheduled meeting of the Millbury Planning Board was held on Monday, October 19, 2009 at 7:15 p.m., in the Municipal Office Building, 127 Elm Street, Millbury, MA.  Chairman Richard Gosselin presided. 
 
Present:  Jeffrey Markarian, Richard Gosselin, Anna Lewandowski, Gary Schold, Paul Piktelis, Associate Member Edd Cote 
 
7:15 p.m.       ANR – 38 Carleton Road 
 
Rick Hathaway, Andrews Survey was present.  Applicant is dividing the lot into two lots, both have adequate frontage.   
 
Motion by Jeffrey Markarian, seconded by Gary Schold, to approve the ANR entitled “Division of Land on 38 Carleton Road, in Millbury, Massachusetts”, dated September 30, 2009, prepared by Andrews Survey and Engineering, Inc., 104 Mendon Street, Uxbridge, MA, motion carried unanimously. 
 
7:25 p.m.       Discussion:  Revisions to Subdivision Rules & Regulations 
 
The contingency factor will be raised to 25%, and the Planning Board will reserve the right to ask for more than the 25% on more complicated projects.  Section 29 (e) will also be changed to reflect the change in percentage.   The Board will review this proposal and will discuss it at its next meeting. 
 
7:30 p.m.       Etre, 26 Leslie Lane, Multifamily Special Permit Public Hearing, cont. 
 
Coordinates and monuments have been added to the plan.   
 
Motion by Anna Lewandowski, seconded by Jeffrey Markarian, to close the public hearing, motion carried unanimously. 
 
Motion by Jeffrey Markarian, seconded by Paul Piktelis, to approve the waiver of Section 12.44 (A) – Requirements to provide natural features, topography and contour lines at one foot intervals, location, type and intensity of lighting, motion carried unanimously. 
 
Motion by Jeffrey Markarian, seconded by Paul Piktelis, to approve the waiver of Section 12.44 (B) – Requirement to submit a Landscape Plan, motion carried unanimously. 
 
Motion by Jeffrey Markarian, seconded by Paul Piktelis, to approve the waiver of Section 12.44 (C) -  Requirement to submit an isometric line drawing, motion carried unanimously. 
 
Motion by Jeffrey Markarian, seconded by Paul Piktelis, to approve the waiver of Section 12.44 (D) - Requirement to submit a locus plan, motion carried unanimously. 
 
Motion by Jeffrey Markarian, seconded by Paul Piktelis, to approve the waiver of Section 12.44 (E) -  Requirement to submit building elevation plans, motion carried unanimously. 
 
Motion by Jeffrey Markarian, seconded by Paul Piktelis, to approve the waiver of Section 12.44 (F) – Requirement to submit a Development Impact Statement, motion carried unanimously. 
 
Motion by Jeffrey Markarian, seconded by Paul Piktelis, to grant the multifamily and site plan review special permit under Sections 14.11(a) and 14.11(l) of the Millbury Zoning Bylaws, subject to conditions A-F, for property located at 26 Leslie Lane, plan entitled “Certified Plot Plan, 26 Leslie Lane, Millbury, Massachusetts”, dated 10/6/09, prepared by HS&T Group, Inc., 75 Hammond Street, Worcester, MA, motion carried unanimously. 
 
7:45 p.m.       Best Buy:  Minor Modification of Shoppes At Blackstone Valley Special Permit 
 
Jaima Darsinos, MJM Architects, discussed proposed modifications to the former Circuit City store, which include ADA-access ramp, parking, truck well/loading dock, lighting and signage.   
 
Mr. Gosselin asked if the fire lane would be impeded in any way, and Mr. Darsinos responded by saying that no expansion was planned for the exterior in that location. 
 
Best Buy anticipates opening in April or May of 2010.  
 
Motion to approve the modifications as depicted on the architectural site plan and exterior elevations plan entitled “Minor Modification Application, Shoppes At Blackstone Valley, Millbury, Massachusetts”, dated October 6, 2009, prepared by MJM Architects, 105 Broadway Avenue, Nashville, Tennessee, and consisting of two sheets, motion carried unanimously. 
 
Chair Gosselin declared a 5 minute recess. 
 
Minutes 
 
Motion by Jeffrey Markarian, seconded by Paul Piktelis, to approve the minutes of September 28, 2009, motion carried unanimously. 
 
Other Business 
 
Cronin Brook Heights:  Town Planner Connors advised that she had scheduled a site visit, walk-through with Tighe & Bond.  She also advised that the contractor approved to complete the work, Woodridge Construction, will be unable to proceed with the work, he did not realize the full extent of the remaining work until the site visit took place.  Mr. McKie is trying to find an alternate contractor to complete the work, but is not having any success.  The asphalt plants generally close by November 15th.  
 
Gustafson Plumbers completed the drain survey and provided the Board with a CD for viewing.  Mrs. Lewandowski requested a written report.   
 
Executive Session: Motion by Anna Lewandowski, seconded by Jeffrey Markarian, to enter into Executive Session for the purpose of discussing pending litigation, and to return to open meeting for the purpose of adjournment, upon roll call vote, motion carried unanimously.
