Planning Board Minutes 07/21/2008

The regularly scheduled meeting of the Millbury Planning Board was held on Monday, July 21, 2008, at 7:00 p.m., in the Municipal Office Building, 127 Elm Street, Millbury, MA.  Chairman Richard Gosselin presided.

Present:  Brian Stowell, Richard Gosselin, Anna Lewandowski, Jeffery Markarian, Associate Member Peter Caruso, Jr.

Absent:  Rusty Valery

7:15 p.m.       Overlook Estates Update

Riley Lamson was present to address the Board.  He advised that the Amigo corporate name has been changed to Overlook Estates Development, LLC.  Work on the subdivision will begin in late summer, financing is almost complete.  It will take approximately 4 months to the completion of base course paving.  A pre-construction meeting will be necessary, and a representative from the Earth Removal Board will be invited to attend.

7:25 p.m.       1542 Grafton Road – ANR Plan – Cadorette

Robert Murphy was present.  Applicant is proposing to pave the first 600 feet and the lot will then be on a paved road.  Wetlands have been delineated and the lot meets the upland requirements.

Motion by Brian Stowell, seconded Anna Lewandowski to approve the ANR plan dated April 10, 2008, prepared by Blackstone Valley Survey & Engineering, Inc., for Joseph A. Cadorette, 1542 Grafton Road, Millbury, MA, motion carried unanimously,.

7:30 p.m.       Grafton Street – Vassar Multi-Family Special Permit Public Hearing

Brian Stowell read the public hearing notice.

Norman Hill, Land Planning was present to address the Board.  The location of the duplex has been changed, the original road design has remained the same.  Issues identified by the Town Planner were addressed.

Brian Stowell read memo submitted by Land Planning requesting a waiver of the technical review fee, and technical review of the project.  Ms. Connors advised that there is a balance in the technical review account from the subdivision submittal that could be used.    

Chairman Gosselin opened the meeting to the public.  Michael McGovern asked about the design of the rain garden.  

There was no other public input.

Motion by Brian Stowell, seconded by Jeff Markarian to continue the public hearing to August 18, 2008 at 7:15 p.m., motion carried unanimously.

Other Business:

The Planning Board advised the public that West Nile Virus was found in Millbury.  Free spraying for mosquitoes is available by calling 508-393-3055.  

Minutes:

Motion by Brian Stowell, seconded by Jeff Markarian to approve the minutes of June 16, 2008, with revisions, motion carried unanimously.

Motion by Anna Lewandowski, seconded by Brian Stowell to approve the executive session minutes of June 16, 2008, motion carried unanimously.

Chairman Gosselin declared a three minute recess.

8:00 p.m.       95-97 Worcester-Providence Turnpike:  Metro PCS Co-Location Public Hearing

Brian Stowell read the public hearing notice.

An additional antennae at 135 feet is being requested.  It will be attached to the existing pole and will be housed inside the existing compartment which will not been seen by abutters.  Francis Parisi, engineering representative for Metro PCS was present. All conditions of the original approval will be adhered to.  He further explained the present Metro PCS network system.

Mr. Gosselin stated his concern that this location on the pole be used effectively by PCS if approved, as other carriers would likely be interested in this space and he does not want an abandoned antennae there.  

Discussion regarding surety ensued.  

Motion by Brian Stowell to approve the the Site Plan entitled:

Motion to close the public hearing by Brian Stowell, seconded by Jeff Markaraian, motion carried unanimously.

Other Business:  Schedule Executive Session Meeting for review of RFP applications.

The Board agreed to meet on Thursday, July 24, 2008 at 6:00 p.m.

8:30 p.m.       Autumn Gate Estates Abutters  

Ms. Connors advised the Board that she invited David Calarese (LRC representative) to this meeting and he had agreed to come, however was not present.

Ron Bourdeau, 32 Autumn Gate (formerly 118 Grafton Street) addressed the Board.  He provided a timeline of events that has occurred since 1999 and reviewed it with the Board.  

Kim O’Malley, 116 Grafton Street asked about the status of the bond, winter snowplowing, school bus access and identified safety issues.  She also stated her issues with the retaining walls that were built in front of her property, all the top soil was removed, the land was leveled and dropped about 4 feet so that the developer did not have to apply for a permit.  There are drainage problems, and stone and mud runoff now.  Ms. Connors will visit the site.  

John O’Brien, 112, Grafton Street, asked the Board for help with winter maintenance.  

The Board addressed the questions and agreed that the Town Planner would meet with the DPW Director to arrive at  a solution.  A letter will be sent to David Calarese which will include a time table to get the roadways plowed or the town will do so and bill him for this.  

Mr. Bourdeaux also advised the Board that he has a 100 year old foundation and the blasting has created problems with this and with his well.  He brought a dirty well filter to be viewed by the Board.  He also asked if LRC had  received any kind of tax reduction.  He was advised to check with the Assessor’s Office.  Street signs are not present.  

Ms. Connors advised that water and sewer cannot be addressed by the Board as he has frontage on someone else’s property, LRC owns the road and pipes.  Mr. Bourdeaux may use well water and septic system, or seek permission to hook into the water and sewer lines.  Buses are not under Planning Board jurisdiction.  She also advised that LRC is filing for bankruptcy protection.

The Board discussed the status of the bond it holds and the effect of bankruptcy.  

The Board agreed to address plowing and remaining issues at its first meeting in October.

9:30 p.m.       Dick Valentino, Discussion of Wind Turbine Bylaw

Mr. Valentino appeared in his capacity as the Chair of the Board of Appeals.  The town has a bylaw for wind energy, however, it should be updated.  The Board of Appeals just permitted a tower for Davis Road.

The Board agreed and a draft of the proposed bylaw will be discussed in November.

Other Business:

51, 53, 55 Sycamore Street:  Chris King, Heritage Design Group was present for Patriot Homes.  He advised that the applicant appeared before the Conservation Commission and was not granted a permit.  He reviewed a proposal to reduce the density of the development and to discuss a modification to the special permit.

The applicant will renovate the home at 55 Sycamore Street, use the driveway to provide four parking spaces, and renovate the garage as another single family dwelling.  The driveway would be 16 – 20 feet in width.  The existing driveway is approximately 3 feet from an intermittent stream.  The existing garage slab would be used and built upon.  4% leveling at 100’ would require a waiver and the driveway would have to service two dwellings.  

Ms. Lewandowski expressed concerns with shared driveways and would like to see separate driveways for the two dwellings.

Open Space Plan:  Ms. Connors distributed the draft plan.  The Board has three weeks to comment in writing.  Mrs. Lewandowski wants the public access areas to Dorothy Pond identified in the plan.

Braney Road Sidewalk/Cronin Brook:  Developer has appeared before the Conservation Commission last week and is addressing Planning Board issues.  Relating to the Cronin Brook Subdivision, bounds are in, streetlights are up and the developer is making progress on the punch list.
