Planning Board Minutes 10/22/07

The regularly scheduled meeting of the Millbury Planning Board was held on Monday, October 22, 2007, at 7:15 p.m., in the Municipal Office Building, 127 Elm Street, Millbury, Ma.  Chair Anna Lewandowski presided.  

Present:  Rusty Valery, Brian Stowell, Anna Lewandowski, Richard Gosselin, Scott Mueller

7:15 p.m.       Comolli – 133 Elm Street Public Hearing, cont.

Mr. Stowell read his statement attesting that he has viewed all evidence received during the September 24, 2007 meeting, which he was absent from.  

Chair Lewandowski opened the meeting to the public for comment.  

Mrs. Salois submitted photos of her home and of ledge outcroppings, and expressed concerns with damage from blasting or hammering, water damage, traffic safety on “old” Elm Street, sight distance and the location of the new driveway.

Attorney Spillane was present to represent Mrs. Salois.  He requested the Board to continue the public hearing to allow him time to review the revised plan,  and he identified the following additional concerns:

·       Installation of gas and utility lines will also require blasting
·       The project is adjacent to several historic buildings
·       Diversion of water onto abutting property
·       Slope of land and resulting problems

The Planning Board also advised the applicant of its concerns, which included:

·       Modification of the slope to include retention area to contain drainage to the south
·       Two identified historic homes will be inspected prior to construction and any defects due to construction shall be remedied by the developer
·       Prove preventative measures such as use of rip rap for water runoff from slope
·       Improve sight distance at driveway intersection
·       Improve turning area

Motion by Brian Stowell, seconded by Richard Gosselin to continue the public hearing to November 5, 2007, no vote was taken.

Motion by Rusty Valery, seconded by Scott Mueller to continue the public hearing to November 26, 2007 at 8:00 p.m., motion carried unanimously.




8:15 p.m.       Mangano Estates Public Hearing, cont.  

William Hannigan, Hannigan Engineering submitted a letter dated October 22, 2007, summarizing the various plan revisions.

Ms. Lewandowski suggested a hydro-geologist be contracted to review the property for drainage, especially with the large of area of trees to be removed.  Mr. Hannigan will provide a map which will show the location of Cronin Brook and the distance and significant elevations from the brook, and will be required to file with the Conservation Commission.

Mr. Gosselin cautioned the applicant to pay attention to the 2:1 slopes, particularly with the removal of the retaining walls.

There was no public comment.

Motion by Brian Stowell, seconded by Richard Gosslein, to continue the public hearing to November 26, 2007 at 8:30 p.m., motion carried unanimously.

9:00 p.m.       Sycamore Street Residential Development Public Hearing

Clerk Valery read the public hearing notice.  

Motion by Rusty Valery, seconded by Richard Gosselin to continue the public hearing to allow the Planning Board to review the Lee ANR plan for property on Elmwood Street, prior to conducting the hearing.  Motion carried unanimously.

9:05 p.m.  Lee ANR Plan, Elmwood Street

Mrs. Lee is dividing a section of her property to sell to her abutter, Robert Powers.  Mr. Powers indicated that he will keep this property wooded, acting as a buffer, and this will not be considered a building lot.

Mr. Gosselin requested monuments be shown on the plan.  The applicant will have this completed and will return on October 29, 2007 for approval.

9:15 p.m.       Sycamore Street Residential Development Public Hearing  

Chris King, Heritage Design was present, representing the applicant, Patriot Homes.  He reviewed the proposed plan and requested waivers and indicated that the applicant will be filing a notice of intent with the Conservation Commission.  

Chair Lewandowski opened the meeting to the public.

William Delorey, 22 Sullivan Place asked for the location of construction with relationship to his property.  

Doug Morris, 48 Sycamore Street stated his concerns with traffic, advised that it appears  though his driveway will be directly across from one of the entrances to the project, truck traffic from construction, off street parking, water flow across Sycamore Street, and the poor condition of the roadway.

Discussion as to the status of the parcel across the street ensued.  Mr. King stated that it is unclear at this time as to the ownership.  If that parcel is conveyed as part of this agreement, the applicant will offer it to the abutter for $1.00.  It will not be developed.  

Donna Beaume, 51 Sycamore Street also stated concerns with title issues to this piece of property.  

Applicant is also proposing a walking path to a picnic area.

Several Board members had the following concerns:

·       Slope issues, particularly the 8% slope for the buildings in the back
·       Bounds to be set for the perimeter of the property
·       Include monuments and the 83 datum coordinate system
·       Place retention area underground and grass over
·       Eliminate units 9 & 10, should Route 146 frontage be created
·       Contact CMRPC for ideas on future use of Route 146
·       With reference to the 5:1 ledge cut, have test pits been completed –complete in rear prior to next meeting
·       Sidewalk compliance with ADA requirements
·       Widen and upgrade Sycamore Street
·       Lack of parking and open space areas
·       Identify amounts of cut and fill amounts
·       Reduce number of units
·       Eliminate some units and provide additional parking for units 1 – 10
·       Use page 14 façade version, with cedar shake use
·       Possible continuance of sidewalks down Sycamore Street

Town Planner Connors recommended a traffic impact assessment and the Board agreed, particularly with respect to trips generated and to address safety issues.  She also recommended the allocation of units for low to moderate income families.

Motion to continue the public hearing to November 26, 2007 at 9:15 p.m., motion carried unanimously.

Minutes

Motion to approve the minutes of September 10, 2007, with one correction, by Brian Stowell, seconded by Richard Gosselin, motion carried unanimously.

Motion to approve the minutes of September 24, 2007 by Brian Stowell, seconded by Richard Gosselin, motion carried unanimously.

Other Business

1.      Mrs. Lewandowski advised the Board that Town Planner Connors is approaching her three year anniversary date, requested that an appraisal be performed by the Board and provided a template for the review process.

2.      Virginia Smith, 84 S. Main Street:  Motion by Brian Stowell, seconded by Richard Gosselin to approve the endorsement of  the Multifamily/Site Plan dated July 30, 2007, motion carried unanimously.
