Planning Board Minutes 02/26/07
The regularly scheduled meeting of the Millbury Planning Board was held on Monday, February 26, 2007, at 7:15 p.m. at the Municipal Office Building, 127 Elm Street, Millbury, MA.  Chairman Borowski presided.

Present:  Rusty Valery, Anna Lewandowski, Richard Gosselin, Brian Stowell, William Borowski

7:15 p.m.       Minutes

Motion to approve the minutes of November 13, 2006 by Rusty Valery, seconded by Richard Gosselin, motion carried on a 4-0-1 vote.  Brian Stowell abstained, he was not present at that meeting.

Motion to approve the minutes of November 27, 2006 by Anna Lewandowski, seconded by Rusty Valery, motion carried on a 4-0-1 vote.  Brian Stowell abstained, he was not present at that meeting.

7:30 p.m.       Mangano Estates, Public Hearing, cont.

Marc Belanger, Hannigan Engineering advised the Board that the traffic report has not been completed yet.  

Chairman Borowski asked if three items that arose from the last public hearing were addressed yet:  modify 8% slope, reference datum used and remove disclaimer and Braney Road improvement plan.

Mr. Gosselin reviewed the road slopes, and identified Roads D&E and Roads C&D  that will require flat landings, with no greater than a 2:1 slope.  He also advised that the detention pond be reviewed for steepness.  Slopes exceed 8% for a distance in excess of 900 feet.  Mr. Belanger submitted a sketch with alternate alignments to lessen grades, and asked for guidance from the Board.  Mr. Gosselin recommended following the contour lines and to re-design the plan without massive cuts.  

Mrs. Lewandowski inquired as to access from Colton Road.  Mr. Belanger advised that a 50 foot wide access has been provided.  She believes that lots 5, 6 and 16 are too close in proximity to the brook and could potentially be under water.  

Mr. Valery expressed his concern with the existing condition of Braney Road.  

Mr. Stowell recommended that the applicant bring other team members to the public hearing so that questions could be directed to them.

Proposed water connections and design were also discussed.

There were no public comments.

Motion to grant an extension of time for filing a decision to April 25, 2007, by Richard Gosselin, seconded by Rusty Valery, motion carried unanimously.

Motion to continue the public hearing to Monday, April 9, 2007 at 8:00 p.m. by Richard Gosselin, seconded by Rusty Valery, motion carried unanimously.

The Board will require that revised plans be submitted no later than 10 days prior to the public hearing date of April 9th.  A cut and fill plan will also be required.

8:05 p.m.  Machonis/Woodland Street Multifamily Special Permit Public Hearing

Ronda Toulodros, Land Planning, Inc. reviewed plan revisions, which included the addition of arbor vitae trees as a buffer.  Ms. Connors advised that the trees should be six feet tall and four feet apart.  

Mrs. Lewandowski would like roof and perimeter drains to a drywall, added to the plan, to contain runoff and divert water.

Chairman Borowski opened the meeting to the public.

Eric White, 60 S. Main Street wanted to confirm that the size and location of the arbor vitae trees would be changed to 6’ tall, 4’ apart, and was advised that this would be on the revised plan.  

Motion to close the public hearing by Rusty Valery, seconded by Anna Lewandowski, motion carried unanimously.

Waivers:

Motion by Rusty Valery, seconded by Richard Gosselin, to grant a waiver from Section 12.44 (b), submission of landscape plan, motion carried unanimously.

Motion by Rusty Valery, seconded by Richard Gosselin, to grant a waiver from Section 12.44 ( c ) isometric line drawing, motion carried unanimously.

Motion by Rusty Valery, seconded by Richard Gosselin, to grant a waiver from Section 12.44 (f) submission of a development impact statement, motion carried unanimously.

Motion to grant a multifamily special permit, and to approve the plan entitled “Site Plan for Special Permit, Located at 2 Woodland Street, Millbury, Massachusetts, Owned by and prepared for Ken Machonis” dated December 15, 2006 and revised on February 13, 2007, with amended conditions a – p, motion carried unanimously.

Chairman Borowski declared a two minute recess.

8:25 p.m.       Carleton Road ANR Plan – Koza

Town Planner Connors advised that this ANR plan meets all zoning requirements.  

Motion by Brian Stowell, seconded by Anna Lewandowski, to approve the ANR plan dated January 31, 2007, prepared by Andrews Survey & Engineering, property owned by Walter Koza, motion carried unanimously.

8:30 p.m.       Riverlin Street ANR Plan – LDI, LLC

Ms. Connors advised that this plan meets zoning requirements.  Mr. Gosselin was concerned with the lack of monumentation points and asked the Planner to require this on future submittals.

Motion by Rusty Valery, seconded by Brian Stowell, to approve the ANR plan dated September 22, 2006 as revised on October 30, 2006 and January 12, 2007, prepared by Thompson Liston Associates, Lots 1A and 1B owned by LDI, LLC, motion carried on a 4-1-0 vote.  Richard Gosselin was opposed.

8:45 p.m.       Watson Estates, Public Hearing, cont.

Robert Murphy reviewed the proposed plan and indicated that all of the requirements of the Subdivision Rules & Regulations have been met for a public roadway.  This is to be considered a public subdivision, no longer a private compound.  A homeowner’s association will be created for maintenance of the infiltration basin.  

Mr. Gosselin raised concerns with the location of the oil easement and the town line location, which should be depicted on the plan.  The Board will consider, as a condition of approval, that before definitive plan endorsement the applicant shall revise the definitive plan to depict the installation of metes and bounds at intersection of town line and lot lines and roadway right-of-way.

No comments from the public were received.

Clerk Valery read letter dated February 22, 2007 from Police Chief Handfield which indicated that he had no issue with the proposed subdivision.

Motion by Rusty Valery, seconded by Richard Gosselin, to close the public hearing.  Motion carried on a 4-0-1 vote.  Mr. Stowell abstained as he was not present at the previous public hearings.

Waivers:

1.      Section 6.5.2:  Waive Street Trees:  Motion by Rusty Valery, seconded by Anna Lewandowski to grant a partial waiver from this requirement.  Significant trees (trees of 12” caliper, 4’ above finished ground level) within 20’ of the right-of-way shall be identified in the field prior to clearing.  The Town Planner and developer shall walk the site together and mark those trees that can be preserved.  These existing trees shall serve as street trees in lieu of planting new street trees.   Motion carried on a 4-0-1 vote.  Mr. Stowell abstained.
2.      Section 6.7.6  Waive the roadway pavement width from 22’ to 20’.  Motion to grant the waiver by Rusty Valery, seconded by Richard Gosselin, motion carried on a 4-0-1 vote.  Mr. Stowell abstained.
3.      Section 6.17.1 Waive the requirement to place the stormwater management facility on a separate lot.  Motion to grant the waiver by Rusty Valery, seconded by Richard Gosselin, motion carried on a 4-0-1 vote.  Mr. Stowell abstained.
4.      Section 6.9 to allow 4”x 4”x3” concrete bounds instead of granite.  Motion to deny the waiver by Rusty Valery, seconded by Richard Gosselin, motion carried on a 4-0-1 vote.  Mr. Stowell abstained.
5.      Section 6.10 Waive curbing.  Motion to deny the waiver by Rusty Valery, seconded by Anna Lewandowski, motion carried on a 4 –0-1 vote.  Mr. Stowell abstained.  

Motion by Rusty Valery, seconded by Anna Lewandowski, to approve the application to allow the construction of four single family dwellings pursuant to plan entitled “Definitive Subdivision of Watson Estates, McCracken Road, Millbury, Massachusetts”, dated December 8, 2006 revised through February 13, 2007, prepared by Jarvis Land Survey, Inc., and Land Planning, Inc., subject to conditions a – dd as itemized on the decision, motion carried on a 4-0-1 vote.  Mr. Stowell abstained.
