MASHPEE ZONING BOARD OF APPEALS
JANUARY 14, 2015
MEETING MINUTES
The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, January 14, 2015, at 6:00 p.m. in the Waquoit Room at the Mashpee Town Hall, 16 Great Neck Road North. Board Members Jonathan D. Furbush, William A. Blaisdell, James Reiffarth, Associate Member Scott Goldstein were present. Board members Ronald Bonvie and Richard Jodka, and Associate Member Dom DeBarros were absent.
Mr. Furbush announced the meeting was being televised live on local Mashpee television.
55 Santuit Lane: Greg Bush, homeowner, formally requested a continuance until February 11, 2015 hearings. Mr. Blaisdell made a motion to accept Greg Bush’s request for a Written Finding to raze and replace his single-family dwelling. Mr. Furbush, seconded, yes, Mr. Reiffarth, yes, and Mr. Goldstein, yes and Mr. Blaisdell, yes. All were in favor. (This was continued from December 10, 2014 to finalize plans with the Board of Health).
2 Popponesset Island Road: Tim Santos, P.E., of Holmes and McGrath, Inc. representing the petitioner’s request for a Special Permit to construct two (2) additions, filed a formal request to continue until the hearings dated January 28, 2015. Mr. Blaisdell made a motion to accept the continuance, yes, Mr. Furbush, seconded yes, Mr. Reiffarth, yes, and Mr. Goldstein, yes. All were in favor.
23 Mizzenmast: Steve Cook, of Cotuit Bay Design, representing the petitioner’s request for a Written Finding to allow for construction of a screened porch, filed a formal request to continue until the hearings dated January 28, 2015. Mr. Blaisdell made a motion to accept the continuance, yes, Mr. Furbush seconded yes, Mr. Reiffarth, yes, Mr. Goldstein, yes. All were in favor.
50 Spoondrift Way: Attorney, Kevin Kirrane, representing the petitioner, to address the Building Department’s concern about the plans of the proposed wooden decking around the pool, filed a formal request to continue until the hearings dated January 28, 2015. The Board will vote to determine if a minor or major modification. Mr. Blaisdell made a motion to accept the continuance, yes, Mr. Furbush seconded, yes, Mr. Reiffarth, yes, and Mr. Goldstein, yes. All were in favor.
Mashpee Commons LP: To update the Board of the required 40B foundations completed in November, 2014.
Mr. John Connell and Mr. Tom Feronti, representing Mashpee Commons, provided the Board with a photo of the two foundations (#40 and #42), completed within the guidelines of the Comprehensive Permit. Mr. Connell stated the next step is to present this same information to Mass Housing by February 9, 2015, and is a four month “turn-around” from them to approve the engineering, monitoring, and financing. Mr. Connell is hoping that by spring this will be finalized and the modular companies will be ready.
Mr. Furbush asked if work can continue on the roads and infrastructure. Tom Feronti stated they will continue advancing the completion of Market Street. He stated he is working with the plans submitted to the utility companies, i.e. NSTAR, and phone and cable. He mentioned there is one outstanding plan with National Grid due to the natural gas moratorium for the lower Cape and is unclear if this will be available. He supplied all of the civil engineering and building designs with natural gas, and is working on contingency plans in case they learn they will not have natural gas and need to find another energy source to power the buildings. The road and curbing will be advancing but have to wait until the final letter of approval from Mass Housing to construct the buildings. There is natural gas pressure issues from the
Town of Dennis and East, no more new natural gas services until 2019. They are in a position that they can modify their designs and looking into other sources, but waiting for direction from consultants.
Mr. Reiffarth stated that there is some drainage issues in front of the credit union building. There’s sand and gravel running into the drive way from Jobs Fishing and Rte. 28, and there’s a large ditch on the side of the road that’s leaving sand, dirt and gravel. Mr. Feronti will look into this issue.
Article XVI §174-__: Discuss implementing the Zoning Bylaw provisions of G.L. c. 44, §63A relative to retention of consultants.
Mr. Blaisdell stated that Town Counsel drafted this bylaw and will need to be submitted to the Selectmen by February 9, 2015. The Board wants to know the next step and confirm with Town Counsel. This can be discussed at their meeting with Town Counsel on January 21, 2015.
Mr. Furbush made a motion to approve December 10, 2014 meeting minutes, yes, Mr. Blaisdell seconded, yes, Mr. Reiffarth, yes, and Mr. Goldstein, yes. All were in favor.
