MASHPEE ZONING BOARD OF APPEALS
MEETING MINUTES
JUNE 11, 2014
The Mashpee Zoning Board of Appeals held Public Hearings on Wednesday, June 11, 2014, at 6:00 p.m. in the Waquoit Room at the Mashpee Town Hall, 16 Great Neck Road North. Chairman, Jonathan Furbush, Vice Chairman, William A. Blaisdell, Clerk, Ron Bonvie, Board Members, James Reiffarth, and Richard Jodka, and Associate Member Scott Goldstein. Richard Morgan, Building Commissioner was also present.
Chairman, Jonathan Furbush opened the meeting at 6:00 p.m. and announced that the meeting was being televised live on local Mashpee television. He stated four regular Board Members and Associate Member, Scott Goldstein were acting throughout.

NEW HEARINGS
Louis J. and Louise M. DiMeo Trustees: Request a Variance under §174-33 of the Zoning By-laws for setback relief from water and wetlands to allow for a deck expansion as defined by MGL C 131, §40 on property located in an R-3 Zoning District at 5 Compass Circle, (Map 105 Parcel 260), Mashpee, MA.
Mr. Louis DiMeo representing himself stated he presented his application to the Conservation Commission for the pool deck expansion and after speaking with Mr. Morgan, he suggested Mr. DiMeo meet with the Zoning Board of Appeals. He and his wife Louise purchased the home with the pool two years ago. He stated there’s a two foot wall that aligns the pool facing the ocean. There’s a seat inside the pool that is only two feet below the water line, and when anyone gets out of that seat, it’s very dangerous to step out and walk along the ledge because it’s very narrow and he’s concerned for his family’s safety.
Mr. Furbush asked what the proposed dimensions were for the deck extension. The proposed plot plan depicted the patio addition, retaining wall and steps are 291 square feet. The wall is currently two feet wide and three feet high, and the pool is 31 feet long. Mr. DiMeo stated he is proposing to extend the deck four feet, so it will be a total of 6 feet.
Mr. Jodka read the comments submitted by Drew McManus, Conservation Commission into the record; “Mr. DiMeo’s project at 5 Compass Circle was approved at the hearing dated Thursday, May 22, 2014. No issues.”
Mr. Reiffarth read the comments submitted by Glen Harrington, Board of Health into the record; “No comments from the BOH are necessary regarding the deck at 5 Compass Circle.”
There were no abutters present and no questions from the other Board members.
Mr. Blaisdell made a motion to approve Louis and Louise DiMeo’s request for a Variance under §174-33 of the Zoning By-laws for setback relief from water and wetlands to allow for a deck expansion as defined by MGL C 131, §40 on property located in an R-3 Zoning District at 5 Compass Circle, (Map 105 Parcel 260), Mashpee, MA. Referencing a Certified Plot Plan for Patio Addition”, by Cape & Islands Engineering, Summerfield Park, 800 Falmouth Road, Suite 301C, Mashpee, MA, dated 6/4/2014 for 5 Compass Circle, Mashpee, MA.
Mr. Reiffarth, seconded the motion, yes, and Mr. Jodka, yes, Mr. Furbush, yes, and Mr. Goldstein, yes. All were in favor.
OTHER BUSINESS
Mr. Goldstein read the note to accept the May 28, 2014 Meeting Minutes, Mr. Jodka made a motion to approve, yes, Mr. Furbush, yes, Mr. Blaisdell yes, and Mr. Reiffarth, yes. All were in favor.
Mr. Reiffarth made a motion to adjourn. Mr. Blaisdell, seconded, yes, Mr. Furbush, yes, Mr. Jodka, yes, and Mr. Goldstein, yes. All were in favor.
