                Motion made by Selectman Cook to approve the Regular Session
                minutes of Monday, September 11, 2006 as presented.
                Motion seconded by Selectman Myers.
                VOTE:  Unanimous.  4-0.
                Selectman Green absent for vote.

                Friday, September 15, 2006 Executive Session:

                NEW BUSINESS:

                Proclamation – National Domestic Violence Awareness Month:

Motion made by Selectman Cahalane to place the above topic on the Selectmen’s agenda.
Motion seconded by Selectman Cook.
VOTE:  Unanimous.  5-0.

Louise Patrick, Human Services Director was in attendance to request the Board proclaim October as National Domestic Violence Awareness Month in support of efforts to end and prevent domestic violence in the Town of Mashpee and across the Cape and the Islands.

Motion made by Selectman Cahalane to proclaim October as National Domestic Violence Awareness Month in the Town of Mashpee.
Motion seconded by Selectman Cook.
VOTE:  Unanimous.  5-0.

Request of the Town Clerk – Set Fee for Passport Photos:

Deborah Dami, Town Clerk was presented to request the Selectmen set a fee of $10 for passport photos.  It was noted the Town Clerk’s Office was appointed by the U.S. Department of State as a Passport Acceptance Agent.  The fee as recommended is comparable with other town clerks and businesses for taking passport photographs.

Motion made by Selectman Cahalane to approve the fee of $10 for Passport Pictures as referenced.
Motion seconded by Selectman Green.
VOTE:  Unanimous.  5-0.

Police Chief/DPW Director – Route 130 Safety Issue Update:

Rodney Collins, Chief of Police and Gregory Taylor, Director of Public Works reviewed the Route 130 traffic study update with members of the Board of Selectmen.  Enforcement and traffic volume have contributed to improved speed conformance.  The speed survey conducted in August 2006 was compared to a study conducted in December of 2005 at the posted 35 mph and 40 mph speed locations.  Details were addressed in the memorandum of September 5, 2006 from the DPW Director to the Board of Selectmen.  This December, an additional speed survey study will be conducted.

It was agreed that police presence along Route 130 has made a difference to improve speed conformance.  The Chief is presently working with Town Counsel to petition the State to allow the Selectmen to set a consistent speed limit of 35 mph in this area of concern.  

The Selectmen requested that additional reflectors be placed in the curved areas of the road to delineate turns for night-time drivers.  The cost is approximately $40 each installed.  Additional signage heading east was also considered to announce the dangerous intersection near the Dunkin Donuts facility.   Discussion followed with respect to the establishment’s drive-thru and effect on the roadway during peak business activity.   It was agreed the matter would be reviewed with the Planning Department.

Hearing – Café de la Terre – License Violation:

Selectman Cook stepped down for the above referenced Hearing.

The Hearing notice was read aloud concerning the license violations at Café de la Terre.  On September 7, 2006, the Town Manager met with the Manager of the establishment to review matters regarding the enclosure of outside dining area as per the direction of the Board of Selectmen.  It was determined that no changes were made to delineate the outside dining patio.  A seven-day extension was granted.  On September 15, 2006 an inspection was conducted.  The outside dining area was deemed not in compliance with the Selectmen’s directive to delineate and enclose the outside seating area to identify the restrictions of the license premise.

Michael Donaldson and Jessica Donaldson, Manager(s) of the Café de la Terre met before the Board to explain the lack of compliance and miscommunication regarding the barrier placement.  It was disclosed that Michael Donaldson is not managing the business at this time.  Jessica Donaldson indicated that she has ordered the divided barrier parts online and they are expected to arrive by the end of the week.  Chains and stakes are presently in place to temporarily delineate the outside seating area.

The Donaldson’s apologized for the miscommunication.  To conform to legal requirements, Mr. Donaldson was requested to remit correspondence to the Selectmen regarding the establishment’s change of manager status.  A vote of the Board is necessary, but it does not require a public hearing.

Motion made by Selectman Green to request the Town Manager or Selectman designee to verify and inspect the presence of a temporary outside seating barrier at the Café de la Terre that would conform to the Selectmen’s request and allow the business to operate the outside dining area.
Motion seconded by Selectman Cahalane.
VOTE:  Unanimous.  4-0.
Selectman Cook absent.

                Rotary Club of Mashpee – Request for One Day Permit for Oktoberfest:

                Selectman Cook stepped down for the above referenced agenda topic.

Timothy Crimmins, Rotary Club president was in attendance to request the Selectmen approve the annual one-day beer & wine license for Oktoberfest to be held on October 7, 2006 from 11:00 a.m. to 6:00 p.m., at 63 Steeple Street (across from the Mashpee Library) with a rain date of October 8, 2006.

Motion made by Selectman Cahalane to grant approval to the Mashpee Rotary Club, a one-day beer & wine license to be held on October 7, 2006, operating hours from 11:00 am. to 6:00 p.m. with a rain date of October 8, 2006 as referenced.
Motion seconded by Selectman Myers.
VOTE:  Unanimous.  4-0.
Selectman Cook absent.

COMMUNICATIONS AND CORRESPONDENCE:

Personnel Administrator – Twenty-Five Years of Service:

Marilyn Farren, Personnel Administrator was recognized for twenty-five years of service to the Town of Mashpee.

NEW BUSINESS:

Recommendation for Appointment – Cape Cod Regional Transit Authority Representative:

Motion made by Selectman Cahalane to designate Renè Read as Mashpee’s representative and voting member of the Cape Cod Regional Transit Authority.
Motion seconded by Selectman Green.
VOTE:  Unanimous.  5-0.

                MMR ISSUES:

                Open House – October 14, 2006:

The Selectmen were invited to attend an open house on Saturday, October 14, 2006 to review the environment of the Massachusetts Military Reservation and to learn about the missions of the Army National Guard Camp Edwards Training Site, Coast Guard Air Station Cape Cod, and Air National Guard Combat Communication Training Camp Complex.

Notice of Project Change:

The dates of the public forum regarding the proposed project change will be announced at the next Selectmen’s Meeting.  Project change initiatives include the development of a new capture system and the use of lead ammunition.

BLUE RIBBON COMPREHENSIVE COMMITTEE:

Common issues regarding the School and the Town were discussed by the BRCC at their last meeting.  Representatives from the School system discussed the potential for applicable high school students and student senior projects to assist with water issues by comparing data, gathering information and working with Town departments and volunteers in a unison effort.  A science curriculum is envisioned to assess waterways and other environmental issues.  Discussion also followed regarding the role of the future education coordinator.

The BRCC is expected to present a formal update to the Selectmen in October.

The Board will enter into Executive Session for the purpose of discussing negotiations.  The Board will not reconvene in Open Session.
