                Meeting Called to Order by Chairman Taylor at 6:30 p.m.

                MINUTES:

                Monday, May 8, 2006 Regular Session:

                Motion made by Selectman Cook to approve the Regular Session
                minutes of Monday, May 8, 2006 as presented.
                Motion seconded by Selectman Cahalane.
                VOTE:  Unanimous.  4-0.

                APPOINTMENTS AND HEARINGS:

                Public Comment: None at this time.

                Rodney Collins – Chief of Police – Route 130 Safety Study:

Rodney Collins, Chief of Police was present to discuss options to enhance public safety along Route 130, Mashpee.  In 2005, five fatal accidents occurred.  It was disclosed, in 2006, one fatal accident has occurred to date.  The survey conducted by the department identified speed as the number one cause of the fatal accidents that have occurred in this area.

Chief Collins indicated he met with engineers from VHB and with the Director of Public Works to review this matter.  The results of the safety meeting recommend maintaining consistent speed limits and reduced speeds along Route 130.  To reduce the present speed limits, an engineering study is required by the MA Highway Department (MHD) and Motor Vehicle Registrar in accordance with M.G.L. Chapter 90 regulations.  The study was noted to be costly and must be approved by the Selectmen prior to implementation.  It was suggested Town Counsel be consulted regarding this concern and the possibility of requesting the MHD to consider altering its normal course of processing speed limits that would allow the Town to not incur additional costs for the engineering requirement.

Correspondence from VHB dated March 9, 2006 has confirmed the speed zones signs along Route 130 have been properly posted and erected.
It was noted that Route 130 is considered a safe road when driving in accordance to posted speed limits.

Chief Collins indicated that his department will conduct further enforcement, and that speed tracking would be reviewed in July to detail the impact of increased law enforcement.  It was agreed the Chief and DPW Director would report the speed count findings to the Selectmen for additional review and consideration.

Discussion followed with respect to the previous discussion the Selectmen conducted with Chief Collins, the DPW Director and VHB engineers regarding a safety study on Route 130 vs. a speed study.  It was noted that this matter was not fully discussed with the respective parties.

Signage – Orchard Road/Quinaquisset Avenue:

Motion made by Selectman Cook to place the above topic on the Selectmen’s agenda.
Motion seconded by Selectman Cahalane.
VOTE:  Unanimous.  4-0.

The issue of the newly erected signage on Orchard Road at the intersection of Quinaquisset Avenue was discussed with Greg Taylor, Director of Public Works.  The height and location of the present sign was reviewed.

Motion made by Selectman Cook to erect a more appropriate and smaller sign at the corner of Quinaquisset Avenue and Orchard Road.
Motion seconded by Selectman Cahalane.
VOTE:  Unanimous.  4-0.


Public Hearing (cont’d) – Application for Entertainment License – Café de la Terre:

The Board of Selectmen opened the Public Hearing on the application of Café de la Terre, 25 Market Street, Mashpee Commons, Michael Donaldson, Manager for an Entertainment License for live music and amplification system to include Sunday Entertainment.

The Hearing notice was read aloud in accordance to posting requirements.  At their last meeting, the Selectmen approved an outside patio entertainment license, but continued the remainder of the Hearing to obtain necessary inspections regarding the interior portion of the entertainment license request.

Correspondence was received from the Deputy Fire Chief and Building Inspector on this date with respect to this regard.  Both parties found one emergency light not working.  The certificate of inspection would be approved when the light is repaired.

There were no representatives from Café de la Terre to discuss the license application with the Board of Selectmen.

Motion made by Selectman Cook to continue the Public Hearing; Café de la Terre, Application for Entertainment License to Monday, June 5, 2006 at 6:40 p.m.
Motion seconded by Selectman Cahalane.
VOTE:  Unanimous.  4-0.
NEW BUSINESS:

Certification and Confirmation of Appointment Process – Assistant Town Manager:

Rene Read of Duxbury, MA was the candidate approved by the Town Manager and Personnel Department for hire as Assistant Town Manager at Step 1 of the intended pay scale.

Mr. Read is presently the Assistant Town Administrator for the Town of Harwich.  All posting requirements in accordance with the Hiring Certification have been met for the Selectmen’s approval.

Motion made by Selectman Cahalane to certify and confirm the appointment of Rene Read as Assistant Town Manager.
Motion seconded by Selectman Cook.
VOTE:  Unanimous.  4-0.

Certification and Confirmation of Appointment Process – Assistant Town Planner:

The Hiring Certification for Thomas Mayo, the final candidate for the Step 1 position of Assistant Town Planner was presented to the Selectmen for certification and confirmation.  All procedures regarding posting requirements have been met in accordance to the hiring process.

Motion made by Selectman Cahalane to confirm and certify the appointment of Thomas Mayo as Assistant Town Planner.
Motion seconded by Selectman Green.
VOTE:  Unanimous.  4-0.

EDIC Discussion:

A list of individuals interested in serving on the Board of Directors for the Mashpee Economic Development Industrial Corporation (EDIC) was presented to the Selectmen in a memorandum from the Town Manager dated May 10, 2006.

Letters of interest from the eight individuals were included in the informational packet.  It was recommended a subcommittee be formed to interview the candidates and report their findings to the full Board of Selectmen.

Motion made by Selectman Cahalane to form a subcommittee consisting of Selectmen Theresa Cook and the Town Manager Joyce Mason to interview EDIC candidates and report their findings to the Board of Selectmen on June 5, 2006.
Motion seconded by Selectman Green.
VOTE:  Unanimous.  3-0.
Selectman Cook abstained.

Acceptance of Resignation – Data Collector:

A resignation was received from Ardelle Kelley dated May 9, 2006 resigning from the position of Data Collector effective May 23, 2006.

Motion made by Selectman Cahalane to accept the resignation from Ardelle Kelley from the position of Data Collector as stated with regret.
Motion seconded by Selectman Cook.
VOTE:  Unanimous.  4-0.

It was agreed the Assessing Department would be requested to meet with the Selectmen to discuss the importance of the position as it relates to knowledge of the Town of Mashpee and how the department would maintain status during the absence of a data collector.  It was noted the data collector position has been duly advertised.

Acceptance of Resignation – Leisure Service Advisory Council Member:

Correspondence was received from the Director of Leisure Services dated May 8, 2006 regarding the resignation of Reid Riberty from the Leisure Service Advisory Council.

Motion made by Selectman Cook to accept with extreme regret, the resignation of Reid Riberty from the Leisure Service Advisory Council.
Motion seconded by Selectman Green.
VOTE:  Unanimous.  4-0.
