APPOINTMENTS AND HEARINGS:
Public Comment:
Frank Lord, Mashpee One Room Schoolhouse Preservation Council expressed appreciation to the Board of Selectmen, the Town of Mashpee and Department of Public Works for their support with respect to the accomplishment of the relocation and restoration of the One Room Schoolhouse. Mr. Lord proudly indicated the ribbon cutting ceremony held on Memorial Day was a tremendous success.
APPOINTMENTS AND HEARINGS:
Public Comment:
Peter White urged the residents of the Town of Mashpee to attend the Selectmen’s meetings. Mr. White indicated the Selectmen are expected to review the annual reappointments on tonight’s agenda. Mr. White expressed interest in serving on the Town’s Affordable Housing Committee.

With reference to the agenda topic regarding the potential merger of the Water District and Sewer Commission, Mr. White recommended to maintain a separation of the entities. In his opinion, it would be far worse than mixing apples and oranges.
With regards to the Green Communities Act, Mr. White urged the Town to form a committee as renewable energy is a great resource for the Town.
Mr. White also made comment regarding the Town’s Energy Committee and asked to attend a future meeting to offer his valuable experience.
Public Hearing – Mashpee Commons Annual Entertainment License:
The Board of Selectmen opened the Public Hearing on the application of Mashpee Commons Limited Partnership to provide entertainment to the public from June 2, 2009 through December 31, 2009. Entertainment is to be held at Mashpee Commons, Mashpee.
The Hearing notice was read aloud into the record. Lissa Daly representing Mashpee Commons LP was in attendance to discuss the annual entertainment license request with members of the Board of Selectmen and interested public.
A list of upcoming summer events from July 8th through August 31st was included in the Selectmen’s informational package. Additional dates not previously listed include; the Seaside Le Mans on September 12th, the Fall Sidewalk Sale on October 2nd through the 4th, the annual Oktoberfest on October 10th, the Holiday Kick-Off on November 27th and the Mashpee Christmas Parade scheduled to be held on December 12, 2009. The additional dates as disclosed were read aloud into the public record.
Public Hearing – Mashpee Commons Annual Entertainment License:
Being no additional comment, the Board of Selectmen motioned to close the Public Hearing.
Motion made by Selectman Cahalane to close the Public Hearing.

Motion made by Selectman Cahalane to approve the application of Mashpee Commons Limited Partnership to provide entertainment to the public from June 2, 2009 through December 31, 2009 in Mashpee Commons, Mashpee as referenced.

Mashpee Housing Authority – Request to Amend Deed – 570 Old Barnstable Road:
Leila Botsford Executive Director of the Mashpee Housing Authority was in attendance to request the Board of Selectmen approve a change to the deed at property located at 570 Old Barnstable Road, Mashpee to incorporate additional housing units to the current affordable housing complex.
The land was deeded to the Mashpee Housing Authority in 1985 to allow for the construction of six units of affordable housing. In January of 2006, the Selectmen voted to sponsor a Town Meeting article to allow for the addition of 9 more bedrooms to expand the property. The site is presently permitted for 9 additional bedrooms under the present Title V septic system. The Breezy Acres affordable housing project at the referenced site location received Community Preservation Act funding to allow for the construction of additional affordable housing units. To make the best use of the $450,000 in awarded CPA funds, and secured State grant appropriations, the Housing Authority has requested the deed be amended to allow for the development of 22 more bedrooms. The new configuration
would to tie into the existing 18 bedrooms on site. The proposal would be more financially feasible and would allow for a total of 40 bedroom units of affordable housing.
An innovative alternative septic system would be developed on site to replace the existing Title V system to accommodate the additional bedroom units at the Breezy Acres development site.
An I/A septic system pre-treats effluent and other pollutants before it enters into the soil absorption system. The design frequently uses a large area to serve as a leaching system where playing fields are often located. The innovative alternative system provides advanced treatment to reduce the wastewater’s nitrogen content.
Ms. Botsford explained the bids received through the Request for Proposal would further define the anticipated septic system and its configuration in accordance with Town requirements.
It was noted the Board of Health agent has approved the request for 22 additional bedrooms, a total not to exceed 40 at the Breezy Acres location, a site consisting of 6.2 acres.
The Selectmen requested to review the correspondence from the Board of Health agent regarding approval of the 22 additional bedroom units. In addition, the Selectmen requested a copy of the RFP requiring the innovative alternative septic system. It was agreed that future plans contained in the bid specifications would also be reviewed.
Motion made by Selectman Cahalane to approve the request of the Mashpee Housing Authority, and amend the deed associated to 570 Old Barnstable Road to allow for a total of 22 additional bedroom units, a total not to exceed 40 bedrooms.

COMMUNICATIONS AND CORRESPONDENCE:
Barnstable County Human Rights Commission – “Celebrating of Our Immigrant Communities; The Many Faces of Cape Cod”:
Correspondence was received from the Barnstable County Human Rights Commission dated May 19, 2009 relative to plans for the second annual “Celebrating Our Immigrant Communities; The Many Faces of Cape Cod” in a variety of ways from July 8 through July 14, 2009.
In the spirit of the event, the Selectmen were requested to endorse an attached proclamation.
It is the consensus of the Board of Selectmen to refer the matter to the Town’s Human Services Director Gail Wilson and to the Affirmative Action Committee for additional input.
Annual Reappointments – Boards & Committees:
The Board of Selectmen conducted an initial review of the annual list of reappointments. It was agreed the Town Committees and Boards Guide Booklet would be re-distributed to the respective Boards and Committees.

Motion made by Selectman Cook to approve the above referenced Annual Reappointments.

With respect to the remaining reappointments, the Selectmen agreed to open all appointments. Advertisement shall be posted seeking letters of interest for appointment. The matter will be placed on the Selectmen’s agenda of June 22, 2009 for additional consideration.
Special Olympics – Cape Cod School Day Games:
The Selectmen acknowledged and congratulated the participants in the Special Olympics held last Friday. It was a great event with the schools and there was a lot of public support and backing from local businesses. The students were recognized for their organizational skills and congratulations were given to all who of those involved for everyone is deemed a winner!
OLD BUSINESS:
Water District/Sewer Commission:
The Board of Selectmen continued discussions on the potential merger of the Water District and Sewer Commission. Correspondence received from Attorney William Henchy dated November 12, 2006 relative to the powers necessary for the Mashpee Water District to operate municipal sewers was also re-visited.
Upon discussion, it was agreed the Selectmen would hold preliminary discussions with the Sewer Commissioners on June 22, 2009. The Water District would be invited to attend the Selectmen’s July 6th meeting to discuss the possible undertaking of the sewer operations. During the interim of these meetings, a subcommittee would review the financial implications. The first meeting of the financial subcommittee is Tuesday at 1:00 p.m.
Tax Taking Report:
It was reported the subcommittee charged with identifying parcels of Town owned land to place at possible auction to increase the tax coffers have mapped the properties in quadrants for ease of review. It was suggested the Selectmen schedule a special workshop session to further review the tax taking report.
At this time, it was agreed the list of parcels and related mapping would be distributed to the Board of Selectmen at their next meeting.
NEW BUSINESS:
Recommendation for Bid Extensions – Annual Bids – DPW:
Catherine Laurent, Director of Public Works was in attendance to recommend the Selectmen award the list of annual contracts as identified in communication dated May 26, 2009. The bids are noted to be the second year of a two-year bid for FY2010. The bids would therefore be re-bid for FY2011. The bid recommendations are enclosed in the official minutes for public record.
Motion made by Selectman Cook to approve the recommended extension of annual contracts for FY10 as submitted.

Recommendation for Bid Acceptance – Annual Bids – DPW:
Correspondence was received from the DPW Director dated May 26, 2009 recommending the Selectmen award the contracts for the annual bids. The recommendation is for a one-year contract for FY10 with an option to renew for FY11.
With respect to paving, and work associated to paving, the low bidder was disqualified. As a result, the second low bidder was selected.
Motion made by Selectman Cook to accept the annual bids for FY10 with an option to renew for FY11 as submitted.

Acceptance of Resignation – School Committee Member:
The Board of Selectmen was in receipt of a resignation from Ralph Marcelli dated May 19, 2009 from the School Committee. Additional correspondence was received from the Town Clerk regarding the vacancy and the request to advertise for a future joint appointment by both the Board of Selectmen and School Committee. It was noted that communication was also received from the Superintendent of Schools in response to the School Committee vacancy.
Motion made by Selectman Cahalane to accept with regret, the resignation of Ralph Marcelli from the School Committee.

Acceptance of Resignations (2) Historical Commission:
The Board of Selectmen were in receipt of a resignation from Gail Slattery dated May 11, 2009 from the Historical Commission.
The Selectmen were also in receipt of a resignation from Paula Peters dated July 20, 2007 resigning from the Historical Commission. Upon approval, and in accordance with the Town’s bylaw, Ms. Peters as the commission’s representative to the CPC would be removed from the Community Preservation Committee. It was noted that Ms. Peters has attended meetings of the CPC, and has acted in good faith as a contributing member.
Motion made by Selectman Cook to accept the resignation of Gail Slattery and Paula Peters from the Historical Commission.
Motion seconded by Selectman Richardson.
VOTE: Unanimous. 5-0.
Request of Mashpee Community Concert Committee – Waive Permit Fee:
Correspondence was received from James Vaccaro, Mashpee Community Concert Committee dated May 21, 2009 requested the Selectmen waive all Town fees associated to the annual Mashpee Night at the Pops. It was noted the Board at their last meeting approved the one day beer and wine licensed event. The request to waive the fees was inadvertently omitted from the license application. The waiver of fees excludes the cost for Police and Fire Department details.
Motion made by Selectman Cahalane to waive all Town fees associated to the annual Mashpee Night at the Pops on July 25, 2009 with a rain date of July 26, 2009 as requested.
Motion seconded by Selectman Cook.
VOTE: Unanimous. 5-0.
ENVIRONMENTAL OVERSIGHT COMMITTEE:
The next scheduled meeting of the EOC is Thursday, June 11th at 6:30 p.m. The ENSR Corporation is scheduled to discuss the intent of the Santuit Pond diagnostic study. Interested residents are invited to attend. The meeting will be held in conference room #1.

The Board will enter into Executive Session at this time for the purpose of discussing a personnel matter. The Board will not reconvene in Open Session.
