The minutes were amended on page 8 under the Special Events application to read: Tammy Gray opposed to Laura Franks as the attendee.
Motion made by Selectman Cahalane to approve the minutes of Monday, September 10, 2012 as amended.

October Town Meeting: As a reminder, the Board of Selectmen announced the upcoming date of October 15th as Town Meeting and urged members of the public to attend, and vote on matters contained in the warrant.
No Plow List: The No Plow List for the upcoming winter season has been published. The Selectmen advised residents to review the list, and to make an effort to rectify issues if necessary to be removed from the list before the onset of inclement weather.

Request for One-Day Liquor License – Rod & Gun Club:
Correspondence was received from Michael Hope on behalf of the Mashpee Wampanoag Rod & Gun Club requesting the use of their liquor license on the date of October 13, 2012. Rod & Gun Club member Courtenay Mills was present for discussion purposes.
Motion made by Selectman Cahalane to approve the request of the Mashpee Wampanoag Rod & Gun Club to use their 2012 Liquor License on October 13, 2012 as requested.

Request to Fill Vacancy – P/T Circulation Assistant – Library:
Kathleen Mahoney, Librarian was in attendance to respectfully request the Selectmen approve the Position Vacancy Request; 19 hours per week Circulation Assistant to the Mashpee Public Library. It was disclosed that funding is available in the budget from an unfilled position.
Motion made by Selectman Cahalane to grant permission to the Library to advertise for the part-time position of Circulation Assistant as referenced.

Certification & Confirmation of Appointment – Treasurer/Collector:
Joyce Mason, Town Manager introduced Craig Mayen, the candidate recommended for the position of Treasurer/Tax Collector to the Board of Selectmen. Mr. Mayen is a Mashpee resident and has held the position of Treasurer for the Town of Sandwich for the past six years. Mr. Mayen is also a Certified Public Accountant, a Certified MA Municipal Treasurer, and will soon receive certification as a MA Municipal Collector.
Motion made by Selectman O’Hara to certify and confirm the appointment of Craig Mayen as Treasurer/Collector of the Town of Mashpee.

Recommendation for Appointment – Constable:
An application was before the Board for the position of Constable. As per the policy of the Board of Selectmen, a maximum of one Constable is appointed per thousand year-round population as determined by the Town of Mashpee census. Presently, there are nine appointed Constables in the Town of Mashpee.
Motion made by Selectman Cahalane to place the matter on the Selectmen’s agenda for discussion purposes.
Motion seconded by Selectman Sherman.
Discussion followed with respect to this regard. The Town Manager indicated that all of the current Constables have served the Town well, and at this time, there is no need for the Town to appoint an additional Constable until a resignation is received.
The Board of Selectmen was in unanimous agreement to accept the recommendation of the Town Manager, and not consider any new appointments for the position of Constable at this time.

NEW BUSINESS:
Recommendation for Appointment – Sewer Commission:
The Board of Selectmen received a letter of interest from Glenn Santos to serve on the vacant position to the Sewer Commission representing Precinct 3. Additional communication was received from the Town Planner dated September 21, 2012 recommending the appointment as soon as possible. The next scheduled meeting of the Sewer Commission is October 18th.
Motion made by Selectman Cahalane to highly recommend the appointment Glenn Santosto the Sewer Commission as referenced.

Acceptance of Resignation – Affordable Housing Committee:
Correspondence was received from Frederick Detschel dated September 16, 2012 resigning from his position on the Affordable Housing Committee.
Motion made by Selectman Cahalane to accept with regret, the resignation of Frederick Detschel from the Affordable Housing Committee.

As with all resignations, it is the practice of the Board of Selectmen/Office of the Town Manager to send a letter of appreciation to the individual giving notice for time served. In other circumstances, a letter and a certificate of appreciation is presented to individuals who have dedicated many years of service to the Town of Mashpee.

Acceptance of Registration – Board of Registrars:
The Selectmen were in receipt of correspondence from Karen Walden dated September 10, 2012 resigning from the Board of Registrars. Ms. Walden has served on the Board of Registrars and at Town Meetings for the past twenty plus years.
Additional communication was received from the Town Clerk requesting the Board advertise the vacancy on the Board of Registrars. The voter replacing Ms. Walden would be a Democrat.
Motion made by Selectman O’Hara to accept the resignation of Karen Walden from the Board of Registrars with regret, and advertise to fill the current vacancy as referenced.

Acceptance of Registration – EDIC:
Joyce Mason, Town Manager has indicated the Town received notification that Kenneth Marsters is no longer able to serve on the Economic Development Industrial Corporation (EDIC) Board. The Selectmen were requested to accept his resignation and advertise to fill the present vacancy.
Motion made by Selectman Sherman to accept the resignation of Kenneth Marsters from the EDIC Board with regret.

NEW BUSINESS:
Execution of November 2012 Election Warrant:
Correspondence was received from the Town Clerk dated September 25, 2012 requesting the Selectmen execute six copies of the State Presidential Election Warrant to be held on Tuesday, November 6, 2012.
Motion made by Selectman Cahalane to approve and execute the 2012 State Presidential Election Warrant as presented.

Community Connections – Request for Letter of Support:
It was disclosed that Community Connections, Inc. intends to open a new expanded facility in the Town of Mashpee to provide services for people with disabilities in the Upper Cape area. An application was presented to the Selectmen for community support of the project. The letter of support does not commit the Mashpee community to provide financial support for the proposed project.
Motion made by Selectman Cahalane to send a letter of support the USDA Rural Development Center in West Wareham, MA in support of Community Connections, Inc. and their application to USDA Rural Development.

COMMUNICATIONS & CORRESPONDENCE:
Rachael’s Challenge: The Rachael’s Challenge program will be held on October, 3rd at the Mashpee Middle School. The initiative was a collaboration of efforts to bring to the Town of Mashpee in an effort to stop bullying, bring a positive change to young people and to help create a safer learning environment.
Community Health Center of Cape Cod: The 22,000 square foot expansion to the Community Health Center of Cape Cod is now complete. The new state-of-the-art facility is an asset to the Town of Mashpee. It is expected to be open to patients by the end of October. A November 3rd open house is also planned. The Board of Selectmen expressed appreciation to the Health Center in their future endeavors.
Oktoberfest: The annual Oktoberfest is scheduled to be held in Mashpee Commons on Saturday, October 6, 2012. The rain date is Sunday, October 7th.
School Superintendent Search Committee:
Motion made by Selectman Cahalane to place the above topic on the Selectmen’s agenda.

School Superintendent Search Committee:(continued)
The Board of Selectmen reviewed communication from the Finance Committee dated September 28, 2012 relative to the approaching vacancy of the Superintendent of Schools, and the resulting replacement search. The letter as referenced was read aloud into the record. (Attached to Town Clerk’s copy of official minutes)
The Finance Committee voted unanimously to recommend requesting the Board of Selectmen forward to the School Committee its formal request that the Town Manager or designee be a part of the search committee for a new Superintendent of Schools.
In the past, there has been a member of the search committee outside of the School Committee which included the Town Manager and a designee from the Board of Selectmen and Finance Committee.
Motion made by Selectman Cahalane to co-sign the letter of communication as received from the Finance Committee.

APPOINTMENTS & HEARINGS:
Waterways Commission Chairman – Discussion of Proposed Request for Proposals for Mashpee River:
Ken Bates, Chair of the Waterways Commission was in attendance to discuss the draft Request for Proposals for Engineering Services for obtaining Mashpee River dredging permits. The expected cost of the project is $80,000. The estimate would include engineering, permitting and filing fees.
Included in the Selectmen’s informational packet was correspondence from the Conservation Agent dated September 26, 2012 with respect to this regard.
Discussion followed with respect to the proposed disposal site located on Town property in the Mashpee River Woodlands area. Approval of the site including site preparation and restoration is required by the Waterways Commission, Conservation Commission, Board of Selectmen and Barnstable County Dredge department.
It was disclosed the parcel was purchased using state land bank funds (Self Help Grant). Permission to use land bank funded conservation parcels require authorization from the Mass General Court, approval of the Secretary of Environmental Affairs, and any authorization as required by the provisions of MGL Chapter 41, §15A.
The Conservation Agent wrote in his memorandum that “the commission would want to have assurances that the dredge spoils be free of contaminants, and that the salinity content of the spoils would not adversely affect existing soil regimes and groundwater quality of the deposition site nor would be deposition of dredge spoils prevent the establishment of native vegetation as mitigation for the disturbance o the proposed site.”
As discussion continued, several mandates of the Self Help Grant were defined. It was noted the grant was acquired in 1985. The Board of Selectmen directed the Waterways Commission Chair to further review this matter with the Conservation Commission to obtain a vote of support. It was agreed that Town Counsel would be included in full discussions. The matter was tabled at this time.
Planning Board – Greenways Proposal:
Planning Board members David Kooharian and George Peterson discussed The Mashpee Greenway, a project proposed to connect existing and future trails and facilities to a central park envisioned in Mashpee Commons in the vicinity of the Mashpee Public Library.
The proposal to develop a central park integrates the shopping and residential areas of Mashpee Commons with a connection of parks, walkways, fitness trails and bike paths. The area of discussion also incorporates the Mashpee High School and its surrounding areas which includes the Mashpee Village, the Deer Crossing complex, SouthCape Village, the Windchime Point condominiums and the natural area of Trout Pond.
A parcel of existing green space located behind the Library is currently earmarked for the central park. Elements in the public park would include a playground, gazebo/band stand and possible splash park to be used for winter skating activities. The park, a safe place to gather would also provide an area for concerts, artisan fairs and farmers markets.
The Planning Board has had ongoing discussions with the developers of Mashpee Commons to deliberate the concept of the Mashpee Greenway. It was noted that in general, Mashpee Commons is receptive to the idea, and they are currently reviewing liability matters related to the project proposal.
Discussion followed regarding the potential for town ownership of the park, possible funding sources and general liabilities associated to this endeavor. The Selectmen were supportive of the Greenways proposal as identified, and requested the Town Planner develop a three-phase approach beginning with reachable goals such as trail-ways from the high school to the Mashpee Commons area.
LIAISON REPORTS:
Town Meeting: To be held on October 15, 2012 at 7:00 p.m. The Town is expected to utilize School equipment to broadcast the meeting. It was also noted that Board Members read the warrant for the Audible Ledger, a radio information network for the blind and print impaired.
Library: The Selectmen authorized on this date, the hiring of a part-time Circulation Assistant to the Library.
