Charlie Maintanis called the meeting to order at 9:05 a.m.

Informal discussion
Propose – 11,000 square foot building for a fitness training studio
Mark Lee and Livia Monteforte (realtor) appeared. Realtor Livia Monteforte said this is an informal discussion. CrossFit is interested in purchasing the property. Currently at Mashpee Commons but looking to get into more permanent space. Want to determine if that would be possible at this site before moving forward with formal offer. According to Livia Monteforte, they would be following what had been proposed for the property sometime in the 80’s or early 90’s. Lot is currently on the market; has been on and off the market for some time. There is a small area the current owners cleared.
- CrossFit classes are pre-scheduled…people don’t just come and go.
- Classes start at 6 a.m. Only 1 class on Sunday. Busiest day there would be 7 classes. No plans to do 24-hour operation.
- 8-20 individuals per class.
- Showed proposed elevation of 2003 Plan vs. proposed elevation they are proposing.
- Showed brochure from design company being considered.
- Tom Fudala said parking requirement is 42 spaces and the newer plan shows 42 spaces. However, Tom pointed out that the size doesn’t look adequate on the earlier plan. Also, at rear parking area 10 foot buffer needed. Tom said there is going to be a steep wall at the back.
- Would have to meet Fire Department access requirements; also, there are rear, side, and front buffer requirements.
- State Highway Department would give curb cut.

- Glen Harrington advised the septic design needs 5 gallons per day per occupant and 20 people per class would go over the allowed maximum. Glen said to get a variance from that 600 gallons a day regulation, you would have to put in a denitrification system. Glen explained if CrossFit thinking is to expand, they may want to think about adding the alternative system to go over 600 gallons/day. With that, however, a lifetime maintenance contract goes with it so you have to take care of it.
- Mary LeBlanc suggested they think about how to make the building façade appealing…aesthetically focus on style, colors, etc.
- Livia Monteforte said they are going to Cape & Islands Engineering since they did the work on the early proposal.
- Joel Clifford noted that with the grade going up the property they should verify fire truck access. Also, they should run the template Fire Department would provide to determine Fire Department access around the building. Joel said due to elevation, make sure access truck can make that turn.
- Sprinkler system—Joel said that depends on size of the building.
Concluding:
- Mary LeBlanc suggested before they go too far in design, come back for review.
- For review they need Plan to scale, including proposed elevations; buffers; parking spaces.
- Tom said it gets more complicated if you have to get variances. He said 10 foot buffer required at all sides of the property and 100 foot buffer required at the front unless waived by the permitting authority if abutting property owners give written permission.
- For use the Planning Board is the Special Permit authority.
- Mary said eventually a Landscape Plan would be needed.
Both Mark Lee and Livia Monteforte thanked the Board for all the input. Livia Monteforte said they are willing to work the structure around the lot.

Kevin Lewis, General Manager at Willowbend Country Club appeared. He said they want to build a pavilion at the pool complex, replacing existing awning that’s there. Tom Fudala advised they are coming to Planning Board meeting tomorrow night for a Site Plan change to their Special Permit.
- Mary LeBlanc commented the Plan looks nice. Asked: will this now be permanent. Mr. Lewis responded “yes”.
- Tom noted the use is allowed; just site plan change.
- Mr. Lewis said rest rooms are public access; are handicap accessible.
Willowbend (continued)
- Tom said it looks like public bathroom eliminated. On the Plan they’re listed for employees. Mr. Lewis said the 2 smaller bathrooms are not just employee bathrooms; they are public rest rooms.
- Snack bar is staying same as it was…change not happening.
- Using one of the cabanas for new employee/public bathrooms going there.
- Jonathan Furbush said if the pergola structure is built, then setback from the street to be 30 feet and therefore a variance might be needed. Mr. Lewis said the thought is not to build the Pergola right away.
- Glen Harrington stated the Board of Health has to do a final Plan review for the work area and equipment so a floor plan with equipment schedule is needed.
- Glen said the hand sink in operating area where preparation going on would be better than location shown.
- Glen advised everything would be subject to Board of Health final review.
Motion: Tom Fudala motioned Plan Review recommend approval subject to, if necessary, the issuance of a variance for the set-back of the pergola and Board of Health final Plan review for the café work room and equipment. Scott Carline seconded this motion; and it was unanimously passed by Plan Review.
Motion: Jonathan Furbush motioned Design Review approve subject to a variance, if necessary, from the Zoning Board of Appeals for the pergola shown on the Plan dated 3/5/13 prepared by Baxter Nye Engineering, Hyannis; and Board of Health final Plan review of the café work room and equipment. Mary LeBlanc seconded this motion; and it was unanimously passed by Design Review.

Nicole Cormier and Jennifer Ladd appeared. Tom Feronti (Mashpee Commons) was also present.
- Nicole Cormier said they hope to have street closed.
- Up to 16 vendors; food probably served. Mashpee Commons food vendors will rotate. If empty spot, will allow vendors to participate.
- Vendors will be in 8X8 tents.
- Joel Clifford said street cannot be closed it is main fire access street. They will consider closing a portion of that road then.
- Tom Feronti said only 1 handicap access parking space would be relocated.
- Mr. Feronti said they would just use saw horses to block off the area.
- Joel Clifford advised that a scaled Plan is to be submitted to the Fire Department, along with who the vendors are and how they’re going to be set up.
- Charlie Maintanis added that egress/access issues have to be included in the Plan also.
- Tom Feronti said they would not be blocking any of Green Street.
- Public restrooms across from Bleu Restaurant.
- Glen Harrington advised that anyone who has prepared food has to get Board of Health temporary permit. Glen said the Board of Health will inspect every Saturday.
Mashpee Commons Farmers’ Market (continued)
- Charlie Maintanis will check regulations regarding tents.
- Propane on site?
- Food truck has to be inspected by Fire Department, as well as Board of Health.
- Charlie Maintanis…need provisions to do inspections once set up. If vendors bring their own canopies they have to be inspected each week.
- Scott Carline said Police Department would assist wherever they can. If necessary, detailed officer would be assigned.
- Charlie said deal with Site Plan first, then deal with ZBA if necessary.
Anytime Fitness, Deer Crossing
Sign 66.25 square feet
Representative – Eric Eskander__
Eric Eskander appeared.
Sign too big. Can’t be more than 5% of any façade. Mr. Eskander said he will redo façade calculations and then come back with signage. For the sign, he said he’s having indidividual letters going up against white background.
Approval of Minutes
Design Review: Jonathan Furbush approved the minutes of the Design Review and Plan Review combined meeting of January 15, 2013 as amended on behalf of Design Review Committee.
Mary LeBlanc motioned to approve the minutes of the Design Review and Plan Review combined meeting of February 19, 2013 as amended; Jonathan Furbush seconded the motion; and it was approved by Design Review, with Joseph Cummings abstaining.
Plan Review: Glen Harrington motioned to approve the minutes of the Design Review and Plan Review combined meeting of January 15, 2013 as amended; Tom Fudala seconded the motion; and it was approved by Plan Review, with Scott Carline abstaining.
Glen Harrington motioned to approve the minutes of the Design Review and Plan Review combined meeting of February 19, 2013 as amended; Scott Carline seconded the motion; and it was approved by Plan Review, with Joel Clifford abstaining.
