Charlie Maintanis called the meeting to order at 9:04 a.m.

Applicant seeks to utilize approximately 6,000 square feet of space to
Operate an antiques storage, showroom and sales business

Representative – Kevin Kirrane______________________________
Kevin Kirrane stated he provided the Committee with copies of a current floor space of the building. He noted that of the 10,000 square feet space only about 6,000 square feet of the building will be utilized. The other spaces currently occupied or being occupied are identified. Following are points made by Mr. Kirrane.
- Unit 2 (actually Unit 1a) being proposed for antiques retail and storage use.
- Mashpee TV occupies 4,000 square feet; flip-flops operates from 3 p.m. and in the evening; Cape Cod Rehab occupies other end of the building—good portion taken up with pool, track, etc.
- This use was approved for the left-hand side of the building, but was not approved for the right-hand side of the building at that time.
- Planning Board interested in parking issues and they are going to address those issues. They believe they comply with the By-Law.
- Mary LeBlanc asked whether they had a Site Plan. Tom Fudala showed Mary the originally approved Plan.
- Kevin Kirrane said they are not proposing any plans; are merely applying for the retail use.
- Mr. Kirrane doesn’t see this use as a major traffic/parking generator.
- Charlie Maintanis commented that there is a general, overall parking situation at that area.

- Mr. Kirrane said for the uses stated 149 spaces needed if the building is completely occupied, but only 140 are provided. He explained Cape Cod Rehab say that most they generally occupy are 30 spaces; Flip-Flop calls for 33 spaces and they say they only occupy about 15 spaces at any given time so there are a lot more spaces required than actually used.
- Tom Fudala said they can probably deal with parking but they have to demonstrate and provide information to support what parking spaces are really needed for their use.
- Kevin Kirrane said the number of parking spaces required under By-Law exceeds what is actually going to be needed and they will provide support for their position. He said the By-Law calls for 22 spaces but this type of use doesn’t require that number of spaces.
- Catherine Laurent suggested a condition requiring parking be permitted on site and once spaces are fully occupied and not sufficient then applicant has to return with a Plan to the Planning Board for additional parking spaces.
- Catherine noted there are missing street signs on Route 28/Industrial Drive and at Industrial Drive/Commercial Street intersections and the signage should be a condition. Catherine said Town just purchased one sign for Commercial Street. Catherine will do a sketch for Kevin Kirrane to show signage needed.
- Glen Harrington asked whether there was a breakdown for the square footage for showroom and storage. Mr. Kirrane said they do not yet have that information.
- Mr. Kirrane believes only about 6,000 of the 10,000 square feet going to be used for this business unit. Until they have another tenant, will leave unit as 10,000 square feet.
- Demising wall between Mashpee TV and this unit.
Motion: Glen Harrington motioned to approve the use for Vintage Lifestyle at Unit 1a to operate antiques storage, showroom and sales business with the condition all of the parking be on-site and the street signs at the intersection of Industrial Drive and Route 28 and at intersection at Commercial Street and Industrial Drive be in place prior to occupancy.
Catherine Laurent seconded the motion. The motion was unanimously approved by Plan Review.
Glen Harrington exited the meeting.

Informal Review
Representative – Conrad Geyser
Conrad Geyser said this is their third attempt.
- Size down 40%; and down to 1 pole barn.
- Plan now stamped.
- Do have total coverage of the lot.
- Parking issue has been straightened out and paved cul-de-sac for fire access.
- Moving existing swale to the center of the cul-de-sac. Not shown on plan but that is their intent.
- Existing deck to be enclosed office space.
- Charlie Maintanis asked whether existing dirt road to be abandoned. Conrad Geyser said not practical to get it abandoned so “no” is the answer.
- Tom Fudala stated it would be better to keep it a dirt road to use as emergency access.

- Conrad Geyser said he would like to maintain the dirt road to get that access. Charlie Maintanis commented that if structure more than 150 feet from road then you do have to maintain to allow Fire Department access to the structure.
- Tom Fudala noted the driveway/parking area has to be paved for Fire Department access.
- They are going to ZBA to get a set-back variance from Savannah’s Path.
- Tom Fudala said Mr. Bornstein will be notified when applicant goes to ZBA.
- Mr. Geyser said barn is under 20 feet total; no height change on existing structure.
- Parking will not be an issue—just office use.
- Tom Fudala advised Mr. Geyser to make sure parking spaces are the right size.
Mr. Geyser asked if they don’t want to cover everything with asphalt what are the prospects. Tom Fudala explained paving is to support Fire Department access vehicles and also we don’t want your oil leaking straight into the ground water.
Mr. Geyser will have to come back with drainage/catch basin Plan. Also, Tom Fudala suggested he contact the Fire Department regarding access to the barn.

Informal Review – Relocation of some buildings and realignment of the road system

Matt Eddy, Jack McElhinney (attorney) and Tim Sullivan (owner) appeared. Matt Eddy said this project went through the Planning Board in 2009 but now with new owner they have looked at shifting the road layout and some of the buildings. Matt said they are here looking for feedback before getting into the actual planning.
They are going to ZBA to get a variance.
Matt said they are just looking for thoughts, feedback and some direction and also some direction from Fire Department that we’re on same page so we can come back with Plan for approval.
Matt had copy of approved Plan and pointed out the changes they are considering.
- Same 40-unit count.
- Style of homes/structure—basically identical…just some minor architectural changes.
- 6-unit structure replaced with 2-4 units.
- 1 additional structure on site.
- Main item for discussion is realignment of Simons Road. Matt said they’ve had discussions with Tom Fudala on this and there is a Warrant for Town Meeting for relocation of the Simons Road easement.
- Open space/green space area made site better.
- Working with Natural Heritage—everything so far being approved by them.
- Expanded natural heritage.
- Utilities are generally same as approved or somewhat better.
Willowbend (continued)
- Parking…their opinion is they are not eliminating required parking spaces, just eliminating additional parking that previously was used for special occasions such as the pro-am event, July 4th fireworks, etc.
- New Units provide for 2 parking spaces per unit.
- Sheldon Hamblin of the Fire Department wanted vegetation in front of 3-story buildings. He felt to plant trees they would get too big and would add to difficulty to Fire Department access. Mary LeBlanc said it will be interesting to see the Landscape Plan with no trees. They said they will re-address this and look to have landscape plan with no trees just in front of the 3-unit buildings, rather than the whole site.
- When Catherine asked whether 30 foot easement is typical, Tom Fudala said it is.
- New road is not a town-owned road.
- Public has rights to Simons Road, but Willowbend will maintain.
- Matt Eddy said right to public won’t change, just being relocated. Tom Fudala said that within this lot it would become a driveway.
- Tom Fudala said for Public Ways throughout Willowbend signs were suppose to be put up saying “Public Way”. Attorney Jack McElhinney said they do survey and replace Public Way signage. He will look into this.
Mary LeBlanc commented how do we protect Town and let public know. Tom Fudala said this is a better situation if public wants to drive it. Also Tom said the Board of Selectmen has to have public meeting to approve the easement; Planning Board will have public meeting to approve the subdivision; and Special Permit needed to approve this condo project.
Matt Eddy said they will follow-up with the Fire Department.
