Mashpee Plan Review Committee
Held Tuesday, April 16, 2013

Design Review Members Present:  Jonathan Furbush, and Joseph Cummings


Plan Review Members Present:  
        Charlie Maintanis, Local Inspector
Tom Fudala, Town Planner
                Ronnie Warden, Assistant Health Agent
Joel Clifford, Fire Inspector
Scott Carline, Police Department


Charlie Maintanis called the meeting to order at 9:05 a.m.

Willowbend
Simons Road and Willowbend Drive
Owner - Southworth Mashpee Properties, LLC
Proposes to construct 40 new townhome and condo units within Willowbend
Country Club (a modification of existing permit).  Plan Review approved in 2009.
The layout has been revised with the same number of units and will include the
necessary site and infrastructure improvements and be served by Willowbend
Wastewater Treatment Facility.  Simons Road is proposed to be realigned as part
of the project.

Jack McElhinney from Willowbend addressed the Committee and stated they met informally about a month ago to discuss modification of the 2009 approval received from the Planning Board for a 40-unit neighborhood which is now being renamed Village at Willowbend.  Mr. McElhinney referred to the Site Plan and noted:

  • Total of 12 buildings to be located alongside realigned Simons Road.
  • Simons Road is a public way—portions of the road are paved.
  • Simons Road location they are now proposing would be behind the units, rather than in front of the units.  This works better for units and for abutters outside of Willowbend.
  • Rather than 4 3-story buildings, now proposing 3 3-story buildings and 9 2-story buildings (2 will be 4-unit; 7 will be 2-unit).
  • Mr. McElhinney said he and Matt Eddy spoke with the Fire Department regarding access and a note has been added to the Plan that all landscape vegetation in front of all habitable residential structures to be kept at 20 feet.
  • Warrant Article on for May Town Meeting.  Mr. McElhinney said they are waiting for Planning Board meeting and they will re-submit amended Article and may have to amend the Article from the floor at the meeting.
  • First public hearing with Planning Board to be tomorrow evening.
  • Mr. McElhinney said they will probably have to go back to ZBA.  Tom Fudala suggested they go to ZBA first before Planning Board signs off.  Mr. McElhinney said they will do that.
Willowbend (continued)

  • Natural Habitat asked that the stockade fence around the perimeter be pulled back further to protect box turtle habitat, which has been done.
  • New Simons Road is an easement (not a road) so no set-back required.
  • Joel Clifford advised that a final set of Plans are needed to be reviewed by the Fire Department before going for approval.
  • Mr. McElhinney said parking requirements are all met.
  • Start construction in the Fall at the earliest.
Motion:  Tom Fudala motioned that Plan Review recommends approval subject to Fire Department is satisfied with the radiusite of their tower truck and subject to there being a variance in effect for the 3-story buildings.  Scott Carline seconded the motion; and it was unanimously passed by Plan Review.

Motion:  Jonathan Furbush motioned Design Review approve the Design Review portion subject to ZBA variance approval and approval by the Fire Department and Planning Board for the proposal shown on the Plan dated 4/4/13 prepared by Baxter Nye Engineering, Hyannis.  Joseph Cummings seconded this motion; and it was passed by Design Review.

Approval of Minutes

Design Review:  Jonathan Furbush motioned to approve the minutes of the Design Review and Plan Review combined meeting of March 19, 2013; Joseph Cummings seconded the motion; and the motion was approved by Design Review.

Plan Review:  Scott Carline motioned to accept the minutes of the Design Review and Plan Review combined meeting of March 19, 2013 as presented; Tom Fudala seconded the motion; and it was approved by Plan Review, with Ronnie Warden abstaining.

Next Meeting…Charlie Maintanis advised that on the agenda for May 7th Design Review and Plan Review combined meeting is a North Market Street applicant looking to put a veterinary clinic/supply store at that site and the use would be retail and veterinary.


Adjournment…This joint meeting of Design Review and Plan Review adjourned at 9:35 a.m.
