Public Hearings
7:10 Hearing under the provisions of Massachusetts General Laws Chapter 40, Section 5 to consider the following amendments to the Mashpee Zoning By-laws submitted for the October 20 Town Meeting:
- An article amending Section 174-24C.3., submitted by the Planning Board, which would include archaeological sensitivity of a site in the items to be considered in the review and approval of Special Permits.
- An article amending Section 174-47.B.10., submitted by the Planning Board, which would amend the affordable housing requirements of the Cluster Subdivision Zoning Bylaw by restricting the issuance of occupancy permits for half of the residences in the development until the required affordable housing provisions have been met. In addition, it removes the provision that the affordable housing lots would become part of the open space after 3 years, but leaves the provision that the extra market-rate lots would do so. Both are intended as incentives and enforcement mechanisms to ensure the provision of the required affordable housing in a timely manner.
- An article amending various subsections of Sections 174-46 and 174-45.1., submitted by the Planning Board, which is intended to simplify and update the Town’s “transfer of development rights” bylaws, wherein residential development rights can be transferred to a project done under either the “Open Space Incentive Development” (OSID) or “Commercial Center” zoning bylaws from other lands permanently set aside as open space. (Removed from the Town meeting warrant by Selectmen)
