BOARD OF HEALTH – PUBLIC SESSION
Minutes of the Meeting of October 15, 2015

Co-Chair Kalliope Egloff called the meeting to order at 7:00 PM.
APPOINTMENTS
7:15 PM – John and Kim Canty – Operation and Maintenance Violation – 15 Nehoiden Road.
Glen Harrington stated that the septic system at 15 Nehoiden Road had been monitored for 10 years. John and Kim Canty received a letter from Waste Water Treatment Services informing them that all of the Board of Health requirements had been met and further monitoring would not be required. No monitoring had taken place for two years. Mr. and Mrs. Canty received a letter from Barnstable County Department of Health and Environment informing them of the violation. Mr. and Mrs. Canty were able to provide a signed contract with the monitoring company, even though monitoring had not occurred during the two-year timeframe.
Lucy Burton made a motion that the Board of Health not take further action on the violation at 15 Nehoiden Road. Kalliope Egloff seconded the motion. The motion was unanimously approved.
7:20 PM – Public Hearing – Synthetic Drug Regulation.
Kalliope Egloff and Lucy Burton discussed the Synthetic Drug Regulation and made suggestions. Otherwise, the regulation appeared to be reasonable and should be adopted.
Lucy Burton made a motion that the Board of Health approve the regulation for prohibition of sales of synthetic marijuana. Kalliope Egloff seconded the motion. The motion was unanimously approved.
NEW BUSINESS
- Sign Expense Warrants. The Board members signed the expense warrant.
- Review/Approve BOH Public Session Minutes: October 1, 2015.
Lucy Burton made a motion that the Board of Health approve the Public Session minutes of October 1, 2015, as amended. Kalliope Egloff seconded the motion. The motion was unanimously approved.
- Board of Health Recommendation – Capital Improvement Program.
Glen Harrington commented that the Health Department will not be requesting any purchases over $25,000 for the Fiscal Year 2017 Capital Improvement Program.
Kalliope Egloff made a motion that the Board of Health introduce the Town of Mashpee Board of Health Fiscal Year 2017 budget to the agenda. Lucy Burton seconded the motion. The motion was unanimously approved.
Glen Harrington stated that he submitted a narrative to the Town Manager and the Board of Health members. There were several changes and additions to the Fiscal Year 2017 budget. The Town Manager issued this statement to the department heads, “to submit a reasonable and realistic budget request based upon mission critical and operational needs in order to provide essential services that the Town has come to expect and deserve”.
Mr. Harrington proposed level funding for the budget. Since the Town Manager is in favor of employee training, Mr. Harrington incorporated the training classes into the budget so that the certifications for the health agents are maintained. The new Board of Health overtime budget pays the assistant health agent one and one-half hours for time worked over 40 hours. The scanning position is advertised at $12.00 an hour for a 19-hour week. The three year plan and outlook is the landfill, since it is the Board of Health’s largest responsibility.
Kalliope Egloff made a motion that the Board of Health approve the Town of Mashpee Board of Health Fiscal Year 2017 Budget. Lucy Burton seconded the motion. The motion was unanimously approved.
- Board of Health Recommendation to Waste Management Committee.
Kalliope Egloff remarked that the Waste Management Committee approved three goals at the March 2, 2015, meeting:
- Reduce trash and increase recycling, as well as composting, at the Transfer Station, consequently reducing disposal costs.
- Provide equity for users of the Transfer Station.
- More effectively educate residents the financial and environmental benefits of increased recycling.
Ms. Egloff is requesting a consensus from the Board of Health for the Waste Management Committee.
Glen Harrington commented that the Board of Health’s responsibility is overseeing the Trash Hauler’s. In Mr. Harrington’s opinion, true control of the trash haulers would be curbside pickup. One trash hauler for the entire town would handle the recycling requirements. Trash disposal fees are expensive; therefore, recycling is very important. The transfer station should operate as an enterprise fund so that it pays for itself, and it should be phased in to prevent excessive fees.
The Board of Health and Mr. Harrington are in favor of Pay-As-You-Throw and increased education in recycling. Mr. Harrington suggested using clear bags and having someone at the transfer station to enforce the waste bans.
Ms. Egloff’s recommendation to the Waste Management Committee will be increased education in recycling, an enterprise fund operation, and increased enforcement for Pay-As-You-Throw.
OLD BUSINESS
Glen Harrington commented that the draft rodent regulation originated for the Building Department’s Demolition Permit. The emergency clause and the health agent’s inspection were added to the regulation.
Lucy Burton made a motion that the Board of Health approve the Rodent Control Regulation. Kalliope Egloff seconded the motion. The motion was unanimously approved.
- Housing Compliance: 394 Cotuit Road.
Glen Harrington remarked that he received updates for 394 Cotuit Road from Erika Woods of the Cape Cod Hoarding Task Force and forwarded them to the Board of Health members.
- Housing Update: P-103 Deer Crossing, Shellback Way.
Glen Harrington stated that information for the cleanup at P-103 Deer Crossing has been submitted to the State of Massachusetts for advertising for the public bid. Mr. Harrington will forward the same information to all of the other firms that expressed an interest in performing the work. The companies will be given two weeks to submit a bid. Once a bid is accepted, Mr. Harrington will seek funding from the Finance Committee.
- Update on Failed Septic System: 87 Lighthouse Lane.
Glen Harrington commented that the septic system at 87 Lighthouse Lane had to be pumped because sewage was backing up into the house. DeBarros Septic pumped the system and will be reimbursed by the Town of Mashpee. Engineering has commenced, and BSS Design to will contact the Health Department to schedule a percolation test.
ADDITIONAL TOPICS
Lucy Burton made a motion that the Board of Health add 42 Wheeler Road to the agenda. Kalliope Egloff seconded the motion. The motion was unanimously approved.
- Compliance Review: 42 Wheeler Road.
Mr. Harrington remarked that the original fine of $250 for 42 Wheeler Road was paid. At the last meeting the Board of Health voted to issue daily fines until the Certificate of Compliance was issued. The engineer returned his as built card with a plan; however, the installer did not realize the cards needed to be submitted to the health department. Therefore, the installer was at fault and not the homeowner. Mr. Harrington recommended that the Board rescind the additional fines and take no further action based upon the payment of the original $250.
Lucy Burton made a motion that the Board of Health rescind the accruing daily fines for 42 Wheeler Road and recommend no further action. Kalliope Egloff seconded the motion. The motion was unanimously approved.
DISCUSSION
- Meeting Update – Mashpee Cares Committee Meeting: Lucy Burton.
Lucy Burton commented that the next meeting for the Mashpee Cares Committee Meeting is scheduled for October 20, 2015.
- Meeting Update – Waste Management Committee Meeting: Kalliope Egloff.
Kalliope Egloff remarked that she has no information concerning the Waste Management Committee.
- Electronic Cigarette Waste: Kalliope Egloff.
Kalliope Egloff explained that Electronic Cigarettes, whether discarded or active, contain cadmium coil, LED lamps, and lithium ion batteries. Nicotine is used, which is a P-Listed hazardous waste that is highly toxic and poisonous. P-Listed wastes are commercial chemicals. There are many hazardous wastes involved with electronic cigarettes and vaping.
NEXT MEETING
The next meeting of the Board of Health is scheduled for Thursday, November 5, 2015, at 7:00 PM. As there was no further business, Lucy Burton made a motion to adjourn the Public Session Meeting of the Board of Health at 8:09 PM. Kalliope Egloff seconded the motion. The motion was unanimously approved.
