Minutes of the Meeting of September 17, 2015

Chairman Burton Kaplan called the meeting to order at 7:03 PM.
APPOINTMENTS
7:15 PM – Barbara Keen – Variance Request to Local BOH Regulations – 98 Cape Drive.
Patty Flynn, a realtor with William Raveis, representing Barbara Keen of 98 Cape Drive, introduced herself to the Board.
Ms. Flynn remarked that Barbara Keen is requesting a variance from the Septic Inspection Regulation because the septic tank is five feet below grade. Ms. Flynn provided photographs of the septic tank taken during the septic inspection to the Board of Health.
Glen Harrington commented that the septic inspection revealed the leaching system at 98 Cape Drive had failed and will need to be upgraded. Also, the septic tank is five feet below grade, and the Board of Health regulation requires replacement if the tank is more than four feet below grade. Mr. Harrington feels that since the leaching system is to be replaced, it would be worthwhile upgrading the septic tank to prevent any hazards.
Lucy Burton made a motion that the Board of Health deny the variance request for 98 Cape Drive based upon the age of the septic tank and the necessity to have the 1500 gallon H-20 loading septic tank replace the old 1000 gallon H-10 septic tank and to maintain the three feet of cover. Burton Kaplan seconded the motion. The motion was unanimously approved.
NEW BUSINESS
- Sign Expense Warrants. The Board members signed the expense warrants.
- Review/Approve BOH Public Session Minutes: September 3, 2015.
Lucy Burton made a motion that the Board of Health approve the Public Session minutes of September 3, 2015, as amended. Burton Kaplan seconded the motion. The motion was unanimously approved.
OLD BUSINESS
- Compliance Review: 42 Wheeler Road.
Glen Harrington stated that he spoke to the previous owner of 42 Wheeler Road. The previous owner had money held in escrow to design and install the septic system. The septic system has been installed, but the Certificate of Compliance will not be issued until the Installer’s and Engineer’s As Built Cards are submitted to the Health Department. When the property was transferred, a Title V Inspection was not performed, and it has been more than two years since the date of transfer that the septic system had been installed.
Mr. Harrington is recommending daily fines of $250 until the Certificate of Compliance is issued.
Lucy Burton made a motion that the Board of Health impose daily fines of $250 against 42 Wheeler Road, Mr. Marcio Dejesus, until the Installer’s As Built Card and Engineer’s As Built Card are received and the Certificate of Compliance is issued beginning upon receipt of the fine letter. Burton Kaplan seconded the motion. The motion was unanimously approved.
- Housing Compliance: 394 Cotuit Road.
Glen Harrington remarked that discussion on 394 Cotuit Road is merely an update. Progression is slow at this point. Erika Woods of the Cape Cod Hoarding Task Force previously informed Mr. Harrington that she planned to get Ms. McFarland-Richter to attend the “Buried in Treasures” training in Falmouth.
- Housing Update: P-103 Deer Crossing, Shellback Way.
Glen Harrington commented that he is still in the process of obtaining bids and access for the clean-up at P-103 Deer Crossing. In order to receive formal bids, the scope of work requires a two-week advertisement period.

DISCUSSION
- Meeting Update – Mashpee Cares Committee Meeting: Lucy Burton.
Lucy Burton commented that she was unable to attend the Mashpee Cares Committee Meeting which was held today at 4:30 PM. Ms. Burton has requested meeting minutes in the past but has not received them.
- Meeting Update – Waste Management Committee Meeting: Kalliope Egloff.
Burton Kaplan remarked that when Kalliope Egloff returns she will update the Board of Health on the Waste Management Committee Meeting.
Glen Harrington commented that October 17, 2015, is the final day to enter budget information for submittal. The budget message is level service; however, the Town Manager is requesting information from each department as to the actual necessities required to operate the office.
NEXT MEETING
The next meeting of the Board of Health is scheduled for Thursday, October 1, 2015, at 7:00 PM. As there was no further business, Lucy Burton made a motion to adjourn the Public Session Meeting of the Board of Health at 7:36 PM. Burton Kaplan seconded the motion. The motion was unanimously approved.
