BOARD OF HEALTH – PUBLIC SESSION
Minutes of the Meeting of September 18, 2014

Co-Chairman Burton Kaplan called the meeting to order at 7:04 PM.
NEW BUSINESS
1. Sign Expense Warrants. The Board members signed the expense warrants.
2. Review/Approve BOH Public Session Minutes: September 4, 2014.
Approval of the Board of Health September 4, 2014, Public Session minutes was continued until the next Board of Health meeting with a full Board in attendance.
3. Request for Title V Funds: GPS Data Logger.
Glen Harrington commented that the Mashpee IT Department would like to upgrade their existing GPS data logger since the data logger is outdated. The current data logger has trouble keeping lock and communication with the satellites so it takes longer to accomplish anything.
Burton Kaplan and Kalliope Egloff are in favor of replacing the current data logger but feel that the other Town Departments should share in the cost of purchasing a new data logger. Ms. Egloff expressed her opinion that if funding is obtained from the Title V Program, then the GPS data logger should be primarily used by the Board of Health.
4. Request for Kennel License: 12 Cransbourne Circle (Mary T. Perry – Delilah’s Door).
Alan Schulman, resident at 12 Cransbourne Circle, introduced himself to the Board.
Mr. Schulman commented that Mary Perry of 12 Cransbourne Circle has purchased two miniature Chihuahuas, a male and a female. Last April the female gave birth to three puppies: two males and one female. Mr. Schulman has a twelve year old Border Collie bringing the total to 5 dogs at the property of 12 Cransbourne Circle. Many coyotes have been seen at night and during the day and have attacked the animals in the area, including the male parent Chihuahua. The Chihuahuas are brought into the house at night and will also be kept indoors when the temperature drops below 60 degrees. Ms. Perry is applying for a kennel license because she plans to keep the three puppies and two dogs.
Mr. Schulman stated that the pen has 50 square feet of area and is enclosed with metal fencing adjacent to the deck. The deck cannot be accessed from the backyard. The dogs have shelter beneath the deck if it rains and are not left outdoors unattended.
Glen Harrington commented that according to Massachusetts State Law having more than 3 dogs requires a Kennel License. However, the Local By-law states that 5 to 9 dogs are considered a personal kennel. Breeding is also considered to be in the definition of a kennel.
Veronica Botelho, neighbor to 12 Cransbourne Circle, introduced herself to the Board.
Ms. Botelho commented that Mr. Schulman has had two Border Collies. The dogs have continuously jumped over her five-foot wooden fence and constantly barked in her yard. One dog has since died, and the other dog is still loose and not leashed. Ms. Botelho is requesting that the dog stay out of her yard and garden.
Mr. Harrington remarked that at the Mashpee Site Plan Review meeting it was voted that one of the conditions on the Kennel Application and the License issued by the Town Clerk should be that the Border Collie be restrained on the property at 12 Cransbourne Circle.
Kalliope Egloff made a motion that the Board of Health approve the Kennel Application for 12 Cransbourne Circle, with the condition that there is a maximum threshold of 9 dogs that could be kept on the property per the Local By-law. If any neighbor complains, the owner is reminded to comply with the State Kennel Law. Burton Kaplan seconded the motion. The motion was unanimously approved.
OLD BUSINESS
1. Refuse Regulation – Draft Amendments.
Burton Kaplan suggested that a couple of minor corrections be made to the draft Refuse Regulation.
The draft Refuse Regulation will be discussed at the next scheduled meeting on October 2, 2014, with a full Board in attendance.

DISCUSSION
1. Oktoberfest.
Glen Harrington informed the Board of the vendors participating in the Mashpee Oktoberfest: Church Pies of Cape Cod is selling frozen chicken pot pies, Kids Klub is offering popcorn, Kiwanis Club is serving chowder, My Favorite Italian Foods is presenting Italian imported cheese samples, and Treasure by the Sea is displaying jams and jellies.
NEXT MEETING
The next meeting of the Board of Health is scheduled for Thursday, October 2, 2014, at 7:00 PM. As there was no further business, Burton Kaplan made a motion to adjourn the Public Session Meeting of the Board of Health at 7:35 PM. Kalliope Egloff seconded the motion. The motion was unanimously approved.
