BOARD OF HEALTH – PUBLIC SESSION

Minutes of the Meeting of July 24, 2013

Chair Kalliope Egloff called the meeting to order at 7:00 PM.

APPOINTMENTS
7:15 PM – Michael Borselli – Title V Variance – 31 Tide Run.
Michael Borselli of Falmouth Engineering, representing David Lee of 31 Tide Run, introduced himself to the Board.

Mr. Borselli commented that Mr. Lee would like to add a garage to his single family home, but setback variances are required to the existing septic tank and soil absorption system.

  • 310 CMR 15.211 – Septic tank to slab foundation 10’. Distance provided is 7’. A 3-foot variance is requested.
  • 310 CMR 15.211 – Soil Absorption System to slab foundation 10’. Distance provided is 4’. A 6-foot variance is requested.
Glen Harrington stated that the change in footprint of the property requires a septic inspection to check the septic tank and the levels in the tank. Mr. Harrington is requesting a revised plan to indicate the reserve area and the water line. Also, a septic permit is required to relocate the distribution box.

Burton Kaplan made a motion that the Board of Health approve the two variance requests submitted on behalf of 31 Tide Run subject to a septic inspection due to a change of footprint, subject to showing the  reserve area on the plan, subject to showing the water line on the plan, obtaining a septic permit to relocate the distribution box, a compliant soil absorption system shall be provided because of the fact of a 2-foot distance and an 8-foot variance, subject to shoring the southwest corner of the garage, and no bedrooms will be allowed in the garage. Kalliope Egloff seconded the motion. The motion was unanimously approved.

7:20 PM – J. M. O’Reilly – Title V Variance – 24 Cranberry Lane.
Glen Harrington commented that this will be a new dwelling on a vacant lot. It must meet full requirements of the code, and some variances are necessary. There is an abutting well to the west of 24 Cranberry Lane and a well across the street. A variance to the property line is necessary for the Reserve Area. A variance of 10 feet provided to the cellar wall for the Soil Absorption System, and 15 feet provided for the Reserve Area to the cellar wall in lieu of the 20-foot requirement.

The entire Santuit Pond Subdivision was constructed with the well setback at the State distance of 100 feet. The Mashpee Board of Health’s setback later changed to 150 feet. The well across the street from 24 Cranberry Lane was installed when the setback was 100 feet. Mr. Harrington feels that the well across the street will not be impacted because groundwater flows south, away from the well.
Gary and Kimberly Ridenour, owners of 24 Cranberry Lane, and Vicki McDevitt, owner of 30 Cranberry Lane introduced themselves to the Board.

The owners of 24 Cranberry Lane stated that they will connect Ms. McDevitt of 30 Cranberry Lane to Town Water when the septic installation takes place.

Burton Kaplan made a motion that the Board of Health approve the variance requests submitted on behalf of 24 Cranberry Lane subject to a 10-foot variance for the Soil Absorption System, a 5-foot variance for the Reserve, a 3-foot variance for the Reserve Area, and subject to the Water District certifying that 30 Cranberry Lane has been connected to Town Water. Kalliope Egloff seconded the motion. The motion was unanimously approved.

7:25 PM – Cape and Islands Engineering – Title V Variance – 127 Whippoorwill Circle.
John Slavinsky of Cape and Islands Engineering, and Ernie Virgilio owner of 127 Whippoorwill Circle introduced themselves to the Board.

Glen Harrington commented that this is a septic repair of an existing four-bedroom dwelling that had been inspected for property transfer purposes and failed. Mr. Slavinsky is requesting a one-foot drop to groundwater for the Soil Absorption System. Mr. Harrington recommends pressure distribution to mitigate the variance.

Mr. Slavinksky is requesting 3 variances: 1.) One-foot drop to groundwater to provide a 4-foot separation to estimated high groundwater; 2.) A variance of 6 feet is requested from the pump chamber to the crawl space, 10 feet required; and 3.) A variance of 8 feet is requested from the Soil Absorption System to the crawl space, 20 feet required.

Burton Kaplan made a motion that the Board of Health approve the variance requests submitted on behalf of 127 Whippoorwill Circle subject to one-foot drop to groundwater to provide the 4-foot separation to the estimated high groundwater table; subject to a 6-foot variance from the pump chamber to the crawl space; and subject to an 8-foot variance from the Soil Absorption System to the crawl space. Kalliope Egloff seconded the motion. The motion was unanimously approved.

NEW BUSINESS
1.   Sign Warrants. None.

2.   Review/Approve BOH Public Session and Executive Session Minutes: July 10, 2013.
Approval of the corrected Board of Health July 10, 2013, minutes was continued until the next Board of Health meeting with a full Board in attendance.

3.   Septic Tank Variance: 22 Little Neck Lane.
Glen Harrington commented that the owner, Mark Gurnee, submitted a letter requesting a variance for 22 Little Neck Lane. A septic inspection was performed on March 27, 2013, for property transfer purposes. The septic tank is a 1,000 gallon H-10 tank installed in 1968. Mr. Gurnee is requesting a variance to leave the tank in service but strengthen the top of the tank with an engineered slab. Access and landscaping above the tank would make removal very difficult and costly.

Mr. Harrington stated that the Board has previously requested the septic inspector to certify that the tank is structurally sound. The solids levels in the tank were not taken by the septic inspector so a full tank inspection will need to be performed. If the septic tank does not meet the new criteria for structural integrity, then a concrete slab could be installed to extend the tank’s useful life.

Burton Kaplan made a motion that the Board of Health require a re-inspection of the septic tank and certification as to the integrity of the septic tank at 22 Little Neck Lane. Kalliope Egloff seconded the motion. The motion was unanimously approved.
4.   Board Approval – Definitive Subdivision Plan – 56 & 57 Blue Castle Drive and 56 Degrass  
      Road.
Glen Harrington commented that the definitive subdivision plan for 56 & 57 Blue Castle Drive and 56 Degrass Road depicts a proposed 16-lot subdivision. Through nitrogen aggregation, the Board of Health, and the State 3 bedrooms may be allowed on each lot. The drainage has a subsurface component to meet Board of Health requirements.

Burton Kaplan made a motion that the Board of Health approve the Definitive Subdivision Plan as presented for 56 & 57 Blue Castle Drive and 56 Degrass Road subject to nitrogen aggregation for each of the lots. Kalliope Egloff seconded the motion. The motion was unanimously approved.

OLD BUSINESS
1.   Amendment to Septic Inspection Regulation.
The Board members signed the Amendment to the Septic Inspection Regulation.

DISCUSSION
1.   Irrigation Well Permit: 15 Cranberry Avenue.
Glen Harrington stated that at one point this property was in a documented area of contamination. The area has been cleaned, but the Board of Health has a moratorium for private wells and irrigation wells in documented or anticipated areas of contamination. This is no longer documented, but it is definitely a former area. Mr. Harrington will issue a permit for the replacement irrigation well, but Volatile Organic Compound testing will be required to be performed for the well testing at the owner’s expense.

NEXT MEETING
The next meeting of the Board of Health is scheduled for Wednesday, August 28, 2013, at 7:00 PM. As there was no further business, Burton Kaplan made a motion to adjourn the Public Session of the Board of Health at 8:00 PM.   Kalliope Egloff seconded the motion.  The motion was unanimously approved.
