Co-Chair Kalliope Egloff called the meeting to order at 7:00 PM.
APPOINTMENTS
7:15 PM – David Welch, Representative – Board of Health Variance Request – 246 Great Pines Drive.
David Welch, representing Linda Perrotta of 246 Great Pines Drive, introduced himself to the Board.
Glen Harrington stated that there has been a request for a variance to the 30-year rule of the Septic System Inspection Regulation. Mr. Harrington has not been to the property of 246 Great Pines Drive, but photographs have been provided. The tank may never have been serviced because there are no access manholes cut into the deck. Mr. Harrington commented that there has been no septic inspection, and approval of the variance will be contingent upon a full inspection and the condition of the septic tank.
Mr. Welch was informed by Linda Perrotta, the owner of the property that the deck is completely over the septic tank.
Lucy Burton made a motion that the Board of Health require a full inspection of the septic system at 246 Great Pines Drive with the Health Agent witnessing the septic tank and measuring the access to the tank. The Board of Health will make a later decision based on the information that is discovered at that septic inspection. Kalliope Egloff seconded the motion. The motion was unanimously approved.
7:20 PM – Jack Landers-Cauley, P.E. – Title V Variance – 36 Nick Trail.
Stephen Palumbo of Jack Landers-Cauley’s office, representing Michael Reardon of 36 Nick Trail, introduced himself to the Board.
Mr. Palumbo commented that there is an existing 2-bedroom cottage on the corner of Nick Trail and Uncle Henry’s Road. Mr. Reardon would like to upgrade the failed septic system because of groundwater issues, and Mr. Palumbo is requesting a 4-foot separation to the groundwater. Mr. Palumbo is proposing to elevate the system with a 1500 gallon septic tank and a pump chamber and place a leaching field on the side of the property.
Glen Harrington made comments to the final plan:
- General Note #5 on Page 2 should have covers brought to within 6 inches of grade not 12 inches.
- The stone depth in the leach field must be 6 inches minimum not 4 inches.
- The observation ports on Page 2 in the Profile states that they are to be placed according to the Town of Mashpee standards and requirements. Mashpee does not have a requirement for the observation ports. It is a Title V requirement.
- The Cross Section detail on Page 3 depicts 2 inches of pea stone, a pea stone cap, but filter fabric is shown on Page 2 on the Profile. Either one can be used.
- The manifold and the pressure distribution system should be 6 inches below the laterals.
- The bottom of the Test Hole should be 70 inches not 30 inches on Page 2.
- The Percolation Rate should be less than 2 minutes, not 5.
Lucy Burton made a motion that the Board of Health approve the variance for 36 Nick Trail with the ten technical issues as outlined by the Health Agent. Kalliope Egloff seconded the motion. The motion was unanimously approved.
NEW BUSINESS
1. Sign Expense Warrants. The Board members signed the expense warrants.
2. Review/Approve BOH Public Session Minutes: April 24, 2013.
Approval of the corrected Board of Health April 24, 2013, minutes was continued until the next Board of Health meeting with a full Board in attendance.
3. Board Approval – Definitive Subdivision Plan: Bayswater Seaside II, LLC.
Glen Harrington commented that the definitive plan proposes a re-alignment of Shore Drive West between New Seabury Country Club and Tidewatch Village Condominiums. The re-alignment will allow a new road, Coastline Drive, to provide more frontage for lots along the shoreline. All of the lots will be on town water and the New Seabury Wastewater Treatment Plant. All of the drainage will be subsurface. This meets all of the Board of Health requirements.
Lucy Burton made a motion that the Board of Health approve the Definitive Subdivision Plan for Bayswater Seaside II LLC. Kalliope Egloff seconded the motion. The motion was unanimously approved.
OLD BUSINESS
1. David Chase – Enforceable Agreement Violation – 84 Captains Row.
Glen Harrington stated that on April 10, 2013, the Board of Health issued a $500.00 fine and a deadline of May 1, 2013, to install a septic system. The system was installed and compliance issued by May 1, 2013. The fine letter was received recently by David Chase, but he does have more time to pay the fine.
The Enforceable Agreement Violation for 84 Captains Row will remain on the agenda for the next meeting as a follow-up to the fine.
2. Steven Lewis – O & M Violation – 53 Uncle Henry’s Road and 30 Nick Trail.
Glen Harrington remarked that he has not had the opportunity to send the decision letters made by the Board of Health from the previous meeting to Steven Lewis.
3. Jennifer Thomas – O & M Violation – 141 Timberlane Drive.
Mr. Harrington commented that the Board of Health issued Jennifer Thomas a $300.00 fine for failing to provide an Operation and Maintenance contract. The Operation and Maintenance contract was provided on May 2, 2013, within 14 days of the notice. The First Class mail would have been delivered to Ms. Thomas, but the Certified Mailer has not been returned to the Health Department. Glen Harrington has requested to continue 141 Timberlane Drive to the next meeting.
ADDITIONAL TOPICS
Amendment to the Septic System Inspection Regulation.
Glen Harrington discussed amending the Septic System Inspection Regulation and would like the Board to consider revising the current regulation. Because it is a Septic Regulation the amendment must be published for two consecutive weeks for a public hearing. The Board agreed to set the public hearing date for June 26, 2013.
DISCUSSION
1. Medical Marijuana.
The Board discussed the Department of Public Health’s standard when adding medical marijuana to a food product and the possibility of allergic reactions. The Board would like to make a change to tighten up the State requirements.
2. Draft Tanning Regulation.
Lucy Burton remarked that a particular pediatrician commended the work performed by the Board of Health on the tanning regulation and recommended to not allow anyone under the age of 18 to tan, unless in the case of a rare condition.
Glen Harrington commented that the Food and Drug Administration now want the tanning beds marked stating that the tanning beds should not be used by persons under the age of 18.
The Board discussed informing various organizations that the Public Hearing for the draft Tanning Regulation will take place on May 22, 2013. May is Skin Cancer Awareness month.
NEXT MEETING
The next meeting of the Board of Health is scheduled for Wednesday, May 22, 2013, at 7:00 PM. As there was no further business, Lucy Burton made a motion to adjourn the Public Session of the Board of Health at 8:03 PM. Kalliope Egloff seconded the motion. The motion was unanimously approved.
