BOARD OF HEALTH – PUBLIC SESSION

Minutes of the Meeting of April 24, 2013

Chairman Burton Kaplan called the meeting to order at 7:00 PM.

APPOINTMENTS
7:15 PM – Richard Lewis – Title V Violation – 30 Nick Trail.
Steven Lewis, son of Richard Lewis of 30 Nick Trail, introduced himself to the Board.

Glen Harrington commented that 53 Uncle Henry’s Road and 55 Uncle Henry’s Road (now 30 Nick Trail) were permitted at the same time in 1999. Because of abutting wells and the variances required for the wells, denitrification systems were required to be installed at both of these properties. The septic systems were installed, but the denitrification systems were not installed. The two properties and the abutting properties have now been connected to town water, so the variances to the wells are not necessary. Mr. Harrington stated that a single $500 fine was issued for the property at 53 Uncle Henry’s Road and the approval of the variance was rescinded. 30 Nick Trail is similar except that there were 2 abutting wells for the approval of that septic system.

Burton Kaplan remarked that there are 2 issues that require attention. One is to rescind the requirement for the Innovative Alternative system, and the other is to delete the fine.

Lucy Burton made a motion that the Board of Health rescind the denitrification requirement for 30 Nick Trail. Kalliope Egloff seconded the motion. The motion was unanimously approved.

Kalliope Egloff made a motion that the Board of Health rescind $250 of the $500 fine imposed on February 27, 2013, for 53 Uncle Henry’s Road. Lucy Burton seconded the motion. The motion was unanimously approved.

Kalliope Egloff made a motion that the Board of Health levy a fine of $250 for 55 Uncle Henry’s Road (now 30 Nick Trail). Lucy Burton seconded the motion. The motion was unanimously approved.

NEW BUSINESS
1.   Sign Expense Warrants.  The Board members signed the warrant.

2.   Review/Approve BOH Public Session Minutes: April 10, 2013.
Kalliope Egloff made a motion that the Board of Health approve the Public Session minutes of April 10, 2013, as amended. Lucy Burton seconded the motion. The motion was unanimously approved.



3.   Request for 2013 Food Establishment License: White Lion Baking Company.
Elizabeth Miles commented that this will be a wholesale kitchen. The property location has all of the equipment needed for the kitchen and is located in an area where there is potential for a retail business.

Lucy Burton made a motion to approve the 2013 Food Establishment Permit for wholesale only for White Lion Baking Company with the condition of a pre-operation inspection and obtaining a wholesale license from the Department of Public Health. Kalliope Egloff seconded the motion. The motion was unanimously approved.

4.   Board Approval – Definitive Subdivision Plan: Southworth Mashpee Properties, LLC.
Glen Harrington stated that the Board of Health needs to submit any comments of the Definitive Subdivision Plan for Southworth Mashpee Properties to the Planning Board for their final approval. The site plans and details of the plan are for the Board of Health’s review, especially the drainage and the setbacks. The Subdivision will be connected to town water and the Willowbend Wastewater Treatment Plant.

Lucy Burton made a motion to approve the Definitive Subdivision Plan for Southworth Mashpee Properties, LLC. Kalliope Egloff seconded the motion. The motion was unanimously approved.

5.   Request for Proposed Peapod Pick-up Program: Stop and Shop (Kristina Stefanski, Rep).
Kristina Stefanski, Director of Quality Assurance for Stop and Shop, introduced herself to the Board.

Ms. Stefanski commented that the Peapod Pick-up Program is an extension of their delivery service. There will now be remote locations at some of the stores so customers can pick up their orders.

The food and groceries come from Peapod wareroom in Mansfield. It is a smaller store format within a store. From a food safety perspective and efficiency perspective the orders are picked, set in totes, placed on the delivery truck, and delivered to the store. The food is kept in a storage hub which is alongside the building.

The time and temperature studies are performed annually through a third party, an outside company that is paid for the service. An annual study and quarterly audits will be done internally on the delivery process. In addition, upon delivery to a customer, an associate will take a quick temperature of the product to ensure that the cold chain is maintained.

Kalliope Egloff made a motion that the Board of Health approve the alteration/modification of the existing permit for the Peapod Pick-up Program at the Mashpee Stop and Shop with the condition that the Health Agent has been satisfied with the time and temperature logs, speaking with other operating towns, and the site plan provided. Lucy Burton seconded the motion. The motion was unanimously approved.

6.   Local Variance Request – (Well to Septic): 9 Alewife Road.
Glen Harrington commented that this will be an emergency septic upgrade. The variance will not be necessary because the 150 feet from the well will be maintained.

7.   Request for 2013 Mobile Food License: Poppi’s Dogs.
Fred Jones of Poppi’s Dogs introduced himself to the Board.

Mr. Jones commented that he purchased a food cart that is currently under construction. Fred Jones was given permission by the site manager of Summerfield Park to park his cart in the lower driveway. Mr. Jones stated that the food is purchased every day, and everything bought comes prepared.

Kalliope Egloff made a motion that the Board of Health approve the 2013 Mobile Food Permit for Poppi’s Dogs, Fred Jones, subject to the pre-operation inspection by the Health Agent, mechanical refrigeration required for all potentially hazardous foods, all potentially hazardous foods to be disposed of daily, and no food preparation. Lucy Burton seconded the motion. The motion was unanimously approved.
OLD BUSINESS
1.   Ralph Ventresco – Title V Violation – 56 Canonchet Avenue.
Glen Harrington commented that Ralph Ventresco mailed the check, but it was sent to the Mashpee Water District’s address. The check has been forwarded to the Board of Health.

2.   Steven Lewis – I/A Violation – 53 Uncle Henry’s Road.
Steven Lewis commented that a check will be submitted to the Board of Health for the violation at 53 Uncle Henry’s Road.

3.   The Residences at South Cape Beach Condominium – Stuart Bornstein.
Stuart Bornstein stated that Bennett Environmental was hired to monitor the system and perform the necessary inspections. A contract, correspondence, and a schedule have been provided from the Department of Environmental Protection for testing and inspections.

Glen Harrington commented that the Department of Environmental Protection guidelines are more stringent than those of the Board of Health.

Burton Kaplan remarked that the contract for the Operation and Maintenance of the system was approved on April 17, 2013. Even though the contract was not executed, the work had started due to research performed by Bennett Environmental. The results of an inspection conducted on March 28, 2013, have been submitted to the Board of Health. Mr. Bornstein has requested a rescission of the fines previously imposed.

Kalliope Egloff made a motion that the Board of Health rescind the fine of $500 imposed against Stuart Bornstein, Baypoint LLC, 1 Quinn’s Way. Lucy Burton seconded the motion. The motion was unanimously approved.

ADDITIONAL TOPICS
None.

DISCUSSION
1.   Medical Marijuana.
Glen Harrington stated that he has not had the opportunity to make additional comments.

2.   Draft Tanning Regulation.
Glen Harrington commented that he drafted the tanning regulation, and he used the Brewster regulation as a format. The only difference is Mr. Harrington added the statement that no employees of tanning establishments shall be less than 18 years of age, as well as the section labeled Penalties.

The Board set a public hearing for the May 22, 2013, meeting to discuss the drafted tanning regulations for minors.

NEXT MEETING
The next meeting of the Board of Health is scheduled for Wednesday, May 8, 2013, at 7:00 PM. As there was no further business, Lucy Burton made a motion to adjourn the Public Session of the Board of Health at 8:06 PM. Kalliope Egloff seconded the motion. The motion was unanimously approved.
