Minutes of the Meeting of Wednesday, April 27, 2011

Chairman Kalliope Egloff called the meeting to order at 7:00 PM.

NEW BUSINESS
1.  Warrants.  Board members signed the warrants.

2.  Review Public Session Minutes:  4/13/11
Amendments were made to the BOH Public Session minutes of 4/13/11.  Approval of the minutes was continued to the next meeting with full Board attendance.

3.  Request for Outdoor Seating:  Taylor’s Restaurant
Glen Harrington commented that the restaurant is not changing its menu, just requesting approval for an additional four tables with four chairs each, to be provided at the southern end of the existing restaurant.  The rear screen door at the kitchen is proposed to be utilized for service of food from the kitchen.  No material of construction is noted for the walkway from the kitchen or the food service seating area.  A solid consistent washable patio surface should be provided in the seating area and a solid surface should be provided at the walkway to mitigate dust production.  The septic system is constructed to handle the increase in seating.

Burton Kaplan made a motion that the Board approve the outdoor seating request submitted by Taylor’s Restaurant, subject to the following conditions:
        (1)  Constructing patio with a finished solid consistent washable/cleanable surface
         (2) A walkway of solid material
         (3) Covers for the tables, either umbrellas or awning
         (4) Septic inspection
        (5)  If the screen door is not maintained, then an air door will be required
        (6)  If seating is less than 10 ft. to the driveway, a barrier may be necessary to prohibit                   dust migration into the seating area
Kalliope Egloff seconded the motion.  The motion was unanimously approved.

4.  Request for 2011 Trash Hauler’s License:  Waste Solutions, Inc.  (cont’d)
Glen Harrington stated that Town Counsel had offered guidance based on the information presented from Allied and the tipping report from Bourne Landfill.   Kalliope Egloff stated that options available to the Board at this time regarding Waste Solutions violations included a fine, dismissal of the case, or continuance of the hearing until a full Board is present.

Burton Kaplan made a motion that the Waste Solutions, Inc. hearing be continued to the next Board of Health meeting with full Board attendance.  Kalliope Egloff seconded the motion.  The motion was unanimously approved.

5.  Request for 2011 Trash Hauler’s License:  C.L. Noonan Container Services (cont’d)
6.  Failure to Comply with Refuse Regulations:  Waste Solutions (cont’d)
7.  Failure to Comply with Refuse Regulations: C.L. Noonan Container Services (cont’d)
8.  Failure to Comply with Refuse Regulations: Cavossa Disposal Corp. (cont’d)
Burton Kaplan made a motion that the above four hearings be continued to the next Board of Health meeting with full Board attendance.  Kalliope Egloff seconded the motion.  The motion was unanimously approved.

9.  Request for Temporary Food Permits:  Mashpee’s Family Food Festival – May 14, 2011
The following Temporary Food Permit applications for the Mashpee Family Food Festival were reviewed by the Board and found to be incomplete:  Pizza Guys, Trevi Café, Maple Leaf Farms, Porky’s BBQ & Grill, Pies ala Mode, Regatta, Tea Shoppe, Bleu, Anejo Mexican Bistro, Wimpy’s, Carbo’s Bar & Grill (including Salad Pizatti, Steakhouse Sports Bar, Soprano’s, and Falmouth Raw Bar), Siena, and Royal Nursing Center.  

Burton Kaplan stated his feeling that before these applications reach the Board of Health for approval, they should be reviewed or returned for completion.  Glen Harrington stated that these events happen every year, and he had recommended in the past that the Event Coordinator come before the BOH to discuss who will be participating, what foods they would serve, and in general, educate the Event Coordinator as to how the Board of Health wants the event to be run.

Burton Kaplan made a motion that the Board of Health approve the above-listed Temporary Food Permit applications, subject to inspection at the time the event is held.   Kalliope Egloff seconded the motion.  The motion was unanimously approved.   

OLD BUSINESS
1.  Tobacco Regulation.  Glen Harrington stated that because the Town Hall computers were down for the past week, he has not had an opportunity to address amendments to the regulation.  Discussion of the regulation was continued to the next BOH meeting.

2.  Paperwork Reduction Electronic Regulation
Discussion of the regulation was continued to the next BOH meeting.

ADDITIONAL TOPICS
Burton Kaplan made a motion to add to the agenda a discussion of a memorandum submitted to the Board of Selectmen by the DPW Director on the subject of the Solar Photovoltaic Project on the Mashpee Landfill.  Kalliope Egloff seconded the motion.  The motion was unanimously approved.

Discussion followed.  Kalliope Egloff recommended that the Board of Health work along with the DPW as the project progresses.

DISCUSSION
The following BOH Executive Session minutes have been amended but not approved:
6/23/10; 7/14/10; 7/28/10; 8/11/10.  

The following BOH Executive Session minutes have not been amended:  3/24/10; 4/14/10; 5/05/10; 5/26/10; 9/15/10; 9/29/10; 2/02/11; 3/09/11.  

Kalliope Egloff requested that the topic of Recycling be added to the agenda for the 5/11/11 BOH meeting.

NEXT MEETING
The next meeting of the Board of Health is scheduled for Wednesday, May 11, 2011.

As there was no further business, the meeting was adjourned at 7:45 PM.
