Minutes of the Meeting of Wednesday, June 9, 2010

Chairman Burton Kaplan called the meeting to order at 7:03 PM.
NEW BUSINESS
1. Sign Warrants. The Board members signed the warrants.
2. Approve Public Session Minutes: May 26, 2010
Board members made amendments to the minutes of the BOH Public Session held on May 26, 2010.
Lucy Burton made a motion that the Board approve as amended the minutes of the BOH Public Session held on May 26, 2010. Kalliope Egloff seconded the motion. The motion was unanimously approved.
3. Revised Smoking Regulation
Glen Harrington distributed to the Board members a copy of the revised Mashpee Smoking Regulation for their review, along with copies of the smoking regulations for Bourne, South Hadley, and Holyoke. South Hadley, Holyoke and Taunton used the same format for their regulations. Glen stated that Bourne, Taunton, South Hadley and Holyoke have written a separate, stand alone regulation covering non-tobacco nicotine products, apart from their existing tobacco regulations. Glen stated that he has incorporated much of the templates used by these towns into the draft smoking regulation for Mashpee. The four Massachusetts town non-tobacco product smoking regulations took effect on the following dates:
Holyoke - September, 2009
South Hadley - October 29, 2009
Bourne - February, 2010
Taunton - April, 2010
Burton Kaplan asked that the Board members review the smoking regulation packet of information provided by Glen Harrington in preparation for discussion and comments at the next BOH meeting on 6/23/10.
4. Sewer Commission Request
Burton Kaplan reported that at the last Sewer Commission meeting, Chairman Tom Fudala requested that Mr. Kaplan ask the Board of Health to provide a listing of every denitrification septic system installed in the Town of Mashpee by map and parcel ID. Tom Fudala inferred that there were approximately 300 such systems in Mashpee. Glen Harrington stated that data on all Mashpee denite systems are stored in a data base called Carmody, which the county maintains. All operators who sign up and do the operation and maintenance of denite systems and have contracts with homeowners pay a $50 fee to maintain the data base. Mr. Harrington informed Mr. Kaplan that providing the requested information to the Sewer Commission is possible due to the database maintained by the County.
Discussion took place regarding the future of denitrification septic systems and the possibility of town wide sewage treatment in the future.
OLD BUSINESS
1. Cavossa Proposal to Take Over Operation of Regional Transfer Station
Burton Kaplan commented on an article in the Mashpee Enterprise regarding the proposal from Carl Cavossa to take over the management of the Upper Cape Regional Transfer Station. Glen stated that he had seen the article but had received no response regarding the article from either Joyce Mason or Catherine Laurent.
2. Landfill Monitoring Contract
Burton Kaplan asked whether Joyce Mason had asked the Board of Health to put the Landfill Monitoring Contract out to bid. Glen Harrington stated that the answer was no.
3. Big John’s Dogs
Lucy Burton distributed photographs of the Big John’s Dogs cart located in the Mashpee Commons parking area, taken at 5:45 PM on Tuesday, June 8th. The cart was uncovered again, with water left in the steam tables, but no food on the cart. Lucy Burton stated that at the last BOH meeting the owner, John Jasset, had earned the trust of the Board by promising to be diligent about monitoring the cart, but she has now lost confidence that John Jasset is capable of following through with his promises.
Glen Harrington stated that although no violations have occurred, it is obvious that the cart is not being monitored, and that Mr. Jasset’s time is spread very thin. Lucy Burton stated that in light of the situation found on 6/08/10, it does not bode well for the coming season, and Mr. Jasset will need to be watched more closely. Burton Kaplan asked that Glen Harrington contact Mr.Jasset to inquire about the condition of the cart found on 6/08/10.
4. 48 Fells Pond Road – Follow-Up
Glen Harrington reported that the last word he had received was that the first rock got sent back, the second rock had been delivered, but had not yet been installed. Glen stated that the hope was that it would be installed this week, but neither he nor Lucy Burton had had a chance to drive by to inspect the property as of today.
5. Food Allergy Awareness – FYI.
Kalliope Egloff stated that she had been forwarded information on Food Allergy Awareness from the Food Safety and Nutrition Educator in her office, and wanted to keep everyone in the loop as to what was going on.
6. Site Assessment for Photo Voltaic Panel Installation
Glen Harrington stated that a solar assessment is to be conducted by Cape Light Compact at the Mashpee Transfer Station to determine how many panels would be feasible for the area, and how much electricity could be generated from the panels. Glen Harrington described the panels as being on posts which go into the ground and are bolted to aluminum or stainless steel trays and are filled with dirt and weighted down. Burton Kaplan stated his concern that the panels would not withstand a hurricane. Glen Harrington stated that he was not sure the panels themselves would withstand a hurricane, but he felt that the entire units in the trays would be weighted down sufficiently to withstand a hurricane.
7. MMR Annual Visit
Glen Harrington stated that the MMR will make their annual visit to the Board of Health in July, 2010.
8. Deposition Dates in Boston – Lakeside Estates
Burton Kaplan reported that the Board of Health had been given two appointments for depositions in Boston on 7/01/10: Burton Kaplan at 9 AM and Glen Harrington at 1 PM.
Burton Kaplan stated that he will be unable to attend the 9 AM appointment, and has asked Town Counsel to reschedule his appointment.
9. Pow Wow Vendor Applications
Glen Harrington reported that the office is processing applications from 10 vendors for the annual Mashpee Wampanoag Pow Wow on July 4th weekend. All vendors are the repeat vendors from previous years except for one.
As there was no further business, Lucy Burton made a motion to adjourn the Public Session of the Board of Health at 7:45 PM. Kalliope Egloff seconded the motion. The motion was unanimously approved.
