Chairman Burton Kaplan called the meeting to order at 7:00 PM.
NEW BUSINESS
1. “Workshop” Session: Recycling By-Law for Town Meeting Approval
Penalties, Section 5.
Burton Kaplan stated that one of the key issues the Board had previously discussed was whether fines should be levied for noncompliance against haulers and individuals. Burton Kaplan asked for clarification as to what action or non-action taken by the haulers would justify a fine. Glen Harrington stated that the haulers’ obligations include:
· Offering recycling as a service to their customers
· Providing educational materials
· Assigning a company coordinator
· Taking their recyclables to an approved site
· Not picking up recyclable material as municipal solid waste
· Providing weight slips for recycling on a quarterly basis to DPW.
Glen Harrington stated that fines will be levied according to Mass. General 111 31B, up
to $1000 per violation.
Effectiveness
Glen Harrington stated that he had selected an effectiveness date of September 1, 2010 for multifamily complexes, and January 1, 2011 for all other residential properties, with haulers affected immediately after the by-law is approved by the Attorney General.
Purpose – Page 1. The Board agreed to replace the term “Waste” with the term “Refuse” throughout the document. Glen Harrington stated that the BOH issues Refuse Haulers permits, not MSW permits.
The Board agreed to define recyclable materials as materials for which recycling is required, and are listed as Waste Ban Materials, per 310 CMR 1907.
The term “Company” was changed to “Recyclers and Refuse Haulers”.
Lucy Burton suggested adding an addendum to the by-law, listing the recyclable items, to inform people as to what items are included in the Waste Ban. Under the Recyclable Materials section, it was agreed to add an Appendix A, labeling it as the current Waste Ban list, subject to change.
RE: Residential Dwellings and residential fee schedules. The Board agreed that there would be no residential fee schedule attached to haulers’ applications. Glen Harrington stated that he would change the refuse hauler’s permit application to include a check-off box indicating that the hauler acknowledges that he will charge a flat fee for pickup of both trash and recyclables.
Multifamily dwellings must provide to the BOH a written description of their recycling program, and must include the location of the recycling container(s), the schedule of service, the hauler or recycler’s name and the name of the recycling coordinator contact.
A Recycling Information Form to be submitted by the multifamily dwelling recycling coordinator will be included as an attachment to the by-law.
Waste haulers must inform their prospective customers that they recycle, what they recycle, and how to do it, based upon the rules and regulations of the Board of the DEP.
Enforcement. Glen Harrington stated that the intent is that the Selectmen are going to handle the enforcement of the regulation at the transfer station, and the BOH, agents of the BOH, police officers, Director of Public Works and the Conservation Officer are to be empowered to enforce the provisions of the Enforcement section.
Penalties.
This section still needs to be finalized.
Glen Harrington stated that he would work on the agreed-upon changes to the draft tomorrow, and will check with the Town Manager to determine the deadline for submitting the document for inclusion in the warrant for the next Town Meeting.
Kalliope Egloff made a motion that the meeting be adjourned. Lucy Burton seconded the motion. The motion was unanimously approved. As there was no further business, the meeting was adjourned at 8:50 PM. The next Board of Health meeting is scheduled for Wednesday, March 10, 2010, in Meeting Room 3.
