Vice Chairman Burton Kaplan called the meeting to order at 7:05 PM.

NEW BUSINESS
1. Sign Warrants. Board members signed the warrants.
2. Approve Public Session Minutes of 9/10/08
The following corrections were made to the Public Session Minutes:
- Page 1, under APPOINTMENTS, 1. Jack Landers-Cauley, line 5, after the word Mr. Silva, finish the rest of the sentence with the words is considering submitting the property to condominium law.
- Page 2, under NEW BUSINESS, 2. Approve Executive Session Minutes, line 2, after the word potential, add the words for litigation has passed.
- Page 3, under OLD BUSINESS, 1. Pelley, line 1, insert the word reportedly before the word sick.
- Page 4, under DISCUSSION, 1. Quashnet School Wellness Fair, line 4, delete the entire last sentence of the paragraph.
- Page 4, under DISCUSSION, 5. FYI – Scanning of BOH Plans, line 1, change the words has been hired for to is working in.

Approval of the minutes will be continued to the next BOH meeting with full Board attendance.
3. Request for Temporary Food Permit: Kiwanis Club for the Oktoberfest.
Burton Kaplan made a motion to approve the application for a temporary food permit from the Kiwanis Club for the Oktoberfest function on 10/11/08, from 10 AM to 5 PM, pending BOH inspection prior to the event. Kalliope Egloff seconded the motion. All approved.
OLD BUSINESS
1. Pelley, 171 Falmouth-Sandwich Road
Glen Harrington stated that he had reviewed the BOH letter to the Pelleys of July 31, 2008 which included the Board’s decision at the July 23, 2008 meeting, and he confirmed that the letter was received by the Pelleys on August 12, 2008. That letter had a 7-day deadline and a 30-day deadline. Both deadlines have now passed.
The Board of Health received an email from Jennifer Bowman, Director of Development for the ARC of Greater Boston, who stated that she is interested in pursuing Seashore Kennels in court. Jennifer Bowman stated that she adopted a puppy from Seashore Kennels on 6/03/08 that was suffering from an ear infection, and it also started vomiting within 24 hours after she took ownership. The puppy has not had one week of life without visiting the emergency room. The final diagnosis for the puppy was inflammatory bowel disease and lymphagiectasia, both being congenital, and will require a lifetime of treatment. Ms. Bowman wants to shut the Pelleys down, and asked for support from the Mashpee BOH.
Glen Harrington stated that Veronica Warden is continuing to monitor the Pelley property at 171 Falmouth-Sandwich Road, for any signs of activity. Kalliope Egloff stated that until the Pelleys sell the property, she felt that the BOH should continue to monitor the property. Should the Pelleys return to the property, retroactive action could, and should, be taken against the Pelleys.
2. Lakeside Estates Trailer Park – Update
Glen Harrington reported that one of the Lakeside Estates occupants called the BOH with the complaint that Mr. Haney would not allow the occupant to order a pumping company to pump his septic system. The occupant stated that his plumbing was not draining correctly. Glen Harrington stated that he went to the trailer park and explained to the occupant that they did not have the right to order his septic system pumped because they are not the owners of the property. Glen Harrington stated further that he advised the occupant to have a plumber come to investigate their drainage problem, and if it was found that the drainage problem was the result of septic backup, then Mr. Haney would be required to have the septic system pumped.
3. Tinder Box - Update
Glen Harrington stated that he has heard nothing from Tinder Box, and stated that the BOH-approved 30 day extension period for the completion of the Tinder Box exhaust system installation is good through the end of September.
4. Willowbend – 184-186 Quiniquisset Avenue – Update
Glen Harrington reported that all the utility meters have now been removed, and the oil tank is still there at the far end of the property. Glen Harrington stated that he is continuing to stay in touch with Randi Regan on progress at the property.
DISCUSSION
1. Town of Barnstable Restaurant Report Card – Cape Cod Times Article of 9/14/08
Glen Harrington stated that the Town of Barnstable restaurant report card, published in the Cape Cod Times on 9/14/08, was one method of enforcement of their BOH regulations. There are two Mashpee Health Agents who conduct unannounced periodic inspections; violations are noted and posted at the restaurants in violation of town regulations; and the BOH has a clear definition of action taken against violators, including fines, probation periods, and possible closures. The Board agreed to continue discussion of the topic until a full Board is present.
2. 2008 BOH Fee Schedule
Kalliope Egloff stated that she is interested in learning more about the Town of Brewster green burials and requested that Glen Harrington provide more information about it. The Board raised the question about the $5.00 burial fee. Glen Harrington explained that the Town Clerk charges a $5 fee for a burial permit. The BOH charges a $5 fee for reviewing the burial permit.
3. Draft Nail Salon Regulation
Glen Harrington stated that he has electronic forms of the regulation, the actual application for the facility and for the manicurists, and the inspection form for the facilities, and asked whether it is the Board’s intention to make a registration requirement as the Board did for massage therapists and facilities. If so, Glen Harrington stated that he has a good template for that. Burton Kaplan requested that further discussion of the issue be tabled until a full Board is present.
4. Recycling Regulation and Enforcement
Glen Harrington stated that he will be setting up a meeting with the DPW and the Recycling Committee to discuss the issue. The Town is looking at the costs involved to require curbside recycling. Kalliope Egloff and Burton Kaplan agreed that they are both in favor of curbside recycling, and felt that it would have a definite impact on the reduction of overhead costs to the Town. Kalliope Egloff cited the Town of Falmouth as a good example of a successful curbside recycling program.
5. FYI – Scanning of BOH Plans
Glen Harrington stated that he will investigate the possibility of obtaining CPA funds for the scanning of the BOH septic and architectural plans. Glen Harrington further stated that he would like to make a regulation to require the submittal of architectural and septic plans in TIF reviewable/read-only electronic form, making it reviewable but not accessible to the public to alter.
Semi-Annual Landfill Cap Inspection & Quarterly Landfill Gas Monitoring Report
A motion was made, seconded and passed to accept the semi-annual Landfill Cap Inspection and the Quarterly Landfill Gas Monitoring Reports from Weston & Sampson.
6. Emergency Preparedness
Glen Harrington distributed disks to the Board members of the FY 2007 BOH Emergency Preparedness Operations Plan, for their review.
As there was no further business, the meeting was adjourned at 8:30 PM.
