BOARD OF HEALTH – PUBLIC MEETING

Minutes of the Meeting of Wednesday, April 25, 2007

Chairman Steven Ball called the meeting to order at 7:00 PM.

APPOINTMENTS
7:15 pm – Christopher Newman – 126 S. Sandwich Road
Glen Harrington commented that a septic inspection was performed at 126 S. Sandwich Rd. as a result of a request by Mr. Newman for a proposed addition of an in-law apartment.  At the time of the inspection it was determined that there was a two-chair salon that had been built up into one bay of the existing garage.  Mr. Newman stated to Glen Harrington that the salon had been there for four years, and that dyes were used during the salon process.  Per Title V requirements, having a salon on the property requires 100 gallons per day per chair.  

The addition of an in-law apartment would bring the property up to four (4) bedrooms.  The septic capacity has been increased by 200 gallons per day, and is now sized for a 4-bedroom flow, per Title V requirements.  The issue now before the BOH is the illegality of the salon which has existed for the past four years.

Christopher Newman introduced himself to the Board. He stated that he had been unaware of the illegality of having the salon chairs on the property.  Mr. Newman stated that he would be removing the two salon chairs.  

Steven Ball made a motion that the BOH take no action on issuance of any fines to Christopher Newman, with the stipulations that (1)  the two salon chairs be removed from the property, and that (2) the septic tank and the leaching pit be pumped.  Lucy Burton seconded the motion.  All approved.

NEW BUSINESS
1.  Sign Warrants.  There were no warrants.

2.  Approve Minutes of 3/28/07 and 4/11/07

        3/28/07 Minutes.  Lucy Burton made a motion that the minutes from the 3/28/07 BOH       meeting be approved.  Steven Ball seconded the motion.  All approved.

        4/11/07 Minutes.  There were no corrections to the minutes.  Approval of the minutes    was continued until the next BOH meeting when a full Board is present.

3.  Board Review:  Discharge for S. Joseph DiMaggio of Landfill Contract
Glen Harrington commented that this was a release that was never done for one of the requirements for the 1991 issuance of the contract with Joe DiMaggio for the transfer station, to come up with $100,000.  Rather than do that with $100,000 in cash or a bond, Mr. DiMaggio put up property, which was approved in 1991.  The property was never released at the end of the contract.  The Board members signed the document releasing the property back to Mr. DiMaggio.

4.  Request for Temporary Food Permit:  Joyce Dente for Mashpee Commons Open Market Craft Fair
Glen Harrington commented that the permit is only for serving lemon and watermelon Italian Ice, and bottled water.  Italian ice is a frozen dessert packaged in small boxes, held in a freezer.  Each flavor of ice has its own scooper.  Scoops of the ices are placed in paper cups.  Wrapped straws are provided.  The permit request is for four dates only:  6/22/07, 7/06/07, 7/13/07, and 7/20/07.  Joyce Dente has her ServSafe Certification.  

Lucy Burton made a motion to approve the temporary food permit application for Joyce Dente for the Mashpee Commons Open Market Craft Fair for the dates 6 /22/07, 7/06/07, 7/13/07 and 7/20/07,  at a fee of $25 per day.  Steven Ball seconded the motion.  All approved.

5.  Request for Temporary Food Permit:  Vito Marotta for Motorcycle Event.
Glen Harrington commented that the Motorcycle Event is to be held on 5/05/07 from 8 AM to 4 PM at the Mashpee High School.   Mashpee Health Agents would do an inspection prior to the time of operation.  Vito and Rachel Marotta both have up-to-date ServSafe certifications.  Hot dogs, burgers, sausage, fries, breakfast sandwiches, and drinks would be served.  

Lucy Burton made a motion that the BOH approve the temporary food permit application for Vito Marotta for the Motorcycle Event on 5/05/07, pending inspection by the Health Agents prior to the time of operation.  Steven Ball seconded the motion.  All approved.

6.  Request for Temporary Food Permit:  2007 Popponesset Market Place Chowder Fest,
     (7 Vendors)
Glen Harrington commented that in view of the fact that seven (7) well known Mashpee restaurants are involved in this event, he recommends the event go through a site plan review so that other Town Departments are aware of the event, i.e., Fire and Police Departments, in anticipation of a large attendance  with potential crowd control and traffic problems.   Glen also recommended a pre-operation meeting with all seven (7) vendors, the day before the event.  Bob Weekes, manager of the Raw Bar, and Nancy Burden, Marketplace Property Manager, are co-sponsors of the event which is scheduled for Saturday, June 16, 2007.  Bob Weekes has a valid ServSafe certification.  Glen Harrington recommended that Bob Weekes be appointed as overseer of the event.  

Lucy Burton made a motion to approve the temporary food permit application for the 2007 Popponesset Market Place Chowder Fest scheduled for 6/16/07 with the following stipulations:
-       Site Plan Review prior to the event
-       Pre-Operation meeting with all 7 vendors the day before the event
-       Health Agent inspection prior to the day of the event
-       All 7 vendors applying individually for temporary food permit applications
-       Waiver of the permit fee for all 7 vendors
Steven Ball seconded the motion.  All approved.

OLD BUSINESS
1.  Septic Permit Extension Requests – 139 Tide Run and 24 Waterline Drive North
Glen Harrington commented that these extension requests were continued from the last BOH meeting because there was no information as to the reason for the requests.  In a letter received from Nicholas G. Tagaris to the Board of Health, dated 4/20/07, it was stated that due to recent health issues, Mr. Tagaris is not able to build on the two lots during the current permitting time frame.

Lucy Burton made a motion to grant a one-year, one-time-only extension request for septic permits at 24 Waterline Drive North and 139 Tide Run.  Steven Ball seconded the motion.  All approved.

DISCUSSION
1.  FYI – DPH Seminar:  “Personal Protective Equipment:  Protecting Yourself and Your Community from Infectious Disease – June 13, 2007

Glen Harrington commented that he will plan to attend only if it is determined that the seminar will cover the flu pandemic applicability.  

2.  Family Emergency Preparedness All Day Seminar – 4/28/07.
Glen Harrington stated that he plans to attend and encouraged Board members to attend if possible.  The seminar is sponsored by the County and is from 8 AM to 3 PM regarding many different aspects of emergency preparedness.  The seminar will be held at The Four Seas.  

3.   BOH Applicant – Dr. Lewis Mantel
Glen Harrington reported that Dr. Mantel plans to submit his application for consideration of appointment to the BOH by the end of the week.

NEXT MEETING
The next meeting of the Board of Health is scheduled for Wednesday, May 9, 2007.

As there was no further business, the meeting was adjourned at 7:45 PM.
