BOARD OF HEALTH – PUBLIC MEETING

Minutes of the Meeting of Wednesday, June 7, 2006

Vice Chairperson Lucy Burton called the meeting to order at 7:00 PM.

APPOINTMENTS

Cape & Islands Engineering – 29 Frog Pond Close.
Delineation of the water main on the street is not shown on the plans presented by Cape &Islands.

Glenn Santos moved that the BOH approve plans presented by Cape & Islands for the property at 29 Frog Pond Close, pending receipt of revised plans showing the location of the water main on the street, and meeting all the Title V requirements.   Lucy Burton seconded the motion.  All approved.

Shaw’s Supermarket – Consultant Scope of Services
Dennis Kwider, Director of Quality Assurance for Star Market, and Mike Zajko, Store Manager, introduced themselves to the Board.  Dennis Kwider stated that the consultant, Patron Associates, hired by Shaw’s, will begin next week.

Glenn Santos made a motion to approve the scope of services for Shaw’s Supermarket, as submitted by Patron Associates.  Lucy Burton seconded the motion.   All approved.

Bayview Condos – 381 Great Oak Road South - Septic Variance Request
Frank Leo, Chairman of the Bayview Condominium Association, introduced himself to the BOH.  
The Bayview Condominium leaching facility was found to be located underneath their paved tennis courts.  The BOH septic inspection regulation requires that risers be brought up to within six inches of grade.  The leaching facility consists of long rows of four x four galleys, each with a twenty inch cover that could be raised if any portions of the covers are not underneath the playing surface of the tennis court.  Glen Harrington stated that he asked Brad White, the septic inspector, if he could determine whether any portion of the covers were not under the tennis court playing surface.  If the entire leaching field is underneath the surface of the tennis court, then a video camera could be utilized to inspect the leaching field.  

Glenn Santos made a motion to continue the decision on the septic variance request by Bayview Condominium Association until the exact location of the covers of the leaching field can be determined.
If any of the covers for the four trenches are found to be outside of the playing area of the tennis courts, those trenches would meet the BOH requirements for inspection.  Those trenches that may fall 100% under the tennis court surface would be allowed to be inspected by camera.   Lucy Burton seconded the motion.  All approved.

BSS Design – 86 Summersea Road

Glenn Santos made a motion to deny the request from 86 Summersea Road for a Nitrogen Aggregation Plan, based on the fact that the proposed property is already being tied to another piece of property being used for the same purpose.  Lucy Burton seconded the motion.  All approved.




NEW BUSINESS
1.  Sign Warrants.  The Board members signed the warrants.

2.  Approve Minutes of 4/19/06, 5/17/06, and 5/22/06.  There were no additions or corrections to the minutes from the meetings held on 4/19/06 and 5/17/06.  There were corrections made to the minutes of 5/22/06.  Approval of the three sets of minutes was continued until the next BOH meeting when all Board members will be in attendance.

3.  Temporary Food Permits:  Community Picnic, July 6, 2006 – Five Vendors
Applications for a temporary food permit for the Community Picnic to be held on July 6, 2006 were received from the following five vendors:  
-       MHS Boosters Club
-       Children’s Museum
Kiwanis Club
Friends of the Mashpee Library
Vito Marotta

In the case of Vito Marotta, Glen Harrington recommended that all mobile units be inspected prior to the event.

Lucy Burton made a motion to aprove the above applications for temporary food permits, with the exception of the MHS Boosters Club.  The Boosters Club application will be approved, pending receipt of their Serv  Safe certification.  Glenn Santos seconded the motion.  All approved.

4.  Temporary Food Permits:  Mashpee Pow-Wow, July 1,2,3, 2006 – Ten Vendors
Veronica Warden reported that she had talked with Marita Scott who is working with Carol Turner on the event.  Veronica provided Marita Scott with her electrical outlet tester to ensure that all electrical posts were functioning.  The Tribe is requiring setup by all vendors one week prior to the event to ensure everything is functioning properly.   Glen Harrington reported that he had given Marita Scott a copy of the guidelines that lists all the items needed for temporary food stands.  There will be at least two Serv Safe  certified persons at the event:  Marita Scott and Fuzzy Hendricks.   There are other vendors as well who have their Serv Safe certification.  All vendors will be paying the required $25 fee for the temporary food permit.

Glen Harrington recommended that the BOH go out one day in advance of the event to check the refrigerators and freezers to ensure that all electrical systems are working properly.  Glen also asked that all rice dishes be discarded at the end of each day.   Glen noted that there are venison and buffalo dishes on their menus this year.  He  asked that the sources of these game meats be confirmed, in order to be aware of how they are being processed.

Glenn Santos made a motion to approve the following applications for a temporary food permit for the Mashpee Pow-Wow on July 1, 2,3, 2006,  with the stipulations that the source of the game meats is disclosed to the Health Agent, that there is a one day advance inspection prior to the event of the refrigerating and freezing units, and that all rice dishes be discarded at the end of the day:

Lucy Burton seconded the motion.  All approved.


5.  Request for Title V Variance – 62  Waterline Drive
Michael Grotzky, the designing engineer for this property, has left the country and is not available to issue a certificate of compliance for the installation at 62 Waterline Drive.   The BOH Agent has inspected the work and verified that the system was installed per plan.  

Glenn Santos made a motion to approve the Title V variance request for 62 Waterline Drive, without the designing engineer’s Certificate of Compliance.  Lucy Bu rton seconded the motion.  All approved.

6.  Request for Title V & BOH Septic Variances – 26 Little Neck Lane
Glen Harrington stated that he has not had time to review the details of the request.

Glenn Santos made a motion to continue discussion of the request for Title V and BOH septic variances at 26 Little Neck Lane to the next BOH meeting.  Lucy Burton seconded the motion.  All approved.

7.  Definitive Subdivision Plan Review:  Mercantile Way (Romar Drive)
Glenn Santos made a motion to approve the definitive subdivision plan for Mercantile Way (Romar Drive).  Lucy Burton seconded the motion.   All approved.

8.  Food Establishment Permit Application – Subway Mashpee
Veronica Warden reported that there has been a change of ownership in this establishment, with   no other changes made.  Carrie Tomkiewicz is the new owner.   

Glenn Santos made a motion to approve the food establishment permit for Carrie Tomkiewicz ,  new owner of the Subway Mashpee, pending proof of Serv Safe Certification.    Lucy Burton seconded the motion.  All approved.

9.  Commercial Site Plan & Title V Permit Application:  340-342 Main Street
Glen Harrington reported that the plans include a retail showroom area, offices, and a  warehouse.  They will have a 1500 gallon tank with a point 5 Fast unit, going out to a Bull Run valve
that goes out to a primary and reserve areas built out at the same time.  The flow is not over 600 gallons per day.  The entire property is in Zone 2.  They will want the credits with the denitratrification system for future additional units.  

Glenn Santos made a motion to approve the Commercial Site Plan and Title V permit application as submitted for 340-342 Main Street in Mashpee, dated 5/31/06, with the standard commercial building restrictions applyiing, including no automotive repair, no storage of hazardous wastes, and the standard O & M in place for the Fast System, and any change in ownership has to be approved by the BOH prior to the change in tenancy ownership.  Lucy Burton seconded the motion.   All approved.

10.  Request for Food Establishment Permit – David Burton.
The BOH received a  request from David Burton for a  food establishment permit for a hot dog cart.   The discussion will be continued until the next BOH meeting when more information is available about the request.

OLD BUSINESS

Deer Crossing Commercial Condominiums
Patrick Brady, Attorney for the Deer Crossing Commercial Condominiums, introduced himself to the Board.
Mr. Brady requested the initial installation of the denitrification units to begin after Labor Day due to businesses being affected by summer tourists.  New denitrification technology is proposed which will require new BOH approval.  Bortolotti will be doing the work.  

Glenn Santos made a motion to continue discussion of the issue to the next meeting, on June 21, 2006.  Lucy Burton seconded the motion.  All approved.

The next BOH meeting is scheduled for Wednesday, June 21, 2006, at 7:00 PM in the Board of Health office, Town Hall.  As there was no further business, the meeting was adjourned at 9:05 PM.
