Minutes of the Meeting of Thursday, February 2, 2006

Chairman Glenn Santos called the meeting to order at 7:00 PM.
APPOINTMENTS
William and Anna Marie Crane – “Show Cause” Hearing
Glen Harrington stated that Mr. & Mrs. Crane were currently residing in Florida and therefore were unable to attend the BOH meeting tonight. They responded to the certified letter dated 1/11/06 from the BOH, saying that they would be happy to take care of removal of the garbage grinder located at 27 Prestwick Lane, Mashpee, and asked that they be given an extension of time to do so. The Cranes are seasonal residents and would like to remove the grinder upon their return to Mashpee in June 2006. Glen Harrington stated that since the residence is vacant and the grinder is not being used, there was no problem with extra solids going into the soil absorption system. Glen Harrington recommended that the Cranes be given a time frame in which to have the grinder removed, and suggested the date of June 30,
2006.
Steven Ball made a motion to give the Cranes an extension of time until no later than 6/30/06 to have the garbage grinder removed, with the stipulation that a fine of $100 per day would be levied for each day after 6/30/06 that the grinder has not been removed. Glenn Santos seconded the motion. All approved.
OLD BUSINESS
1. FYI – Revised Final Draft – “Cesspool Regulation”
The final draft of the Cesspool Regulation was reviewed. Glen Harrington noted that on page l, under REGULATION, item #2 had been included to cover the situation in which a home owner planned to sell the property and ordered an inspection, and after the inspection decided not to sell. In this case, the property owner is still required to upgrade to conform to the Title V regulation.
Steven Ball made a motion that the Board approve the final draft of the Cesspool Regulation as presented by Glen Harrington. Glenn Santos seconded the motion. All approved.
Glen Harrington stated that the new regulation would be advertised in the Mashpee Enterprise for two weeks. There would be one additional week before final signoff of the regulation by the Board of Health, to allow for comments to be received from Mashpee residents.
NEW BUSINESS
1. Sign Warrants. The Board members signed the warrants.
2. Approve Minutes of January 19, 2006. Approval of the minutes will be continued until the next meeting with full Board attendance.
3. FYI - Landfill Quarterly Environmental Monitoring Report – (Woodard & Curran)
The last received October 2005 quarterly report includes the recommendation to the Town to repair landfill gas well SGW-13, vent V-B and groundwater monitoring well W-13. Glen Harrington stated that the recommended repairs had all been completed before receipt of the report in January.
4. FYI - D.E.P. and M.H.O.A.’s Annual Board of Health Seminar – Wednesday, March 1, 2006
Glen Harrington stated that any of the Board members who are interested in attending the seminar should notify the BOH office in order to forward registration forms to reserve a seat. This year’s seminar is poised to foster an exchange of ideas between the DEP staff and BOH officials on the issues they face while enhancing and protecting the environment in the Southeast Region.
5. Request for 2006 Retail Food Permit – Hall Oil Company, Inc., d/b/a “Breakaway”
The Hall Oil Company, d/b/a Breakaway, is located at 23C Simons Road, to the right of the former Augat building. The Breakaway is selling barbecue grills with prepackaged condiments, and therefore is required to have a $15 Incidental Food Permit. The BOH will need to conduct an inspection of the premises prior to issuing the permit.
Steven Ball made a motion that the BOH approve the request by Hall Oil Company for issuance of an incidental food permit for The Breakaway, located at 23C Simons Road, pending an inspection of the premises by the BOH. Glenn Santos seconded the motion. All approved.
5. State Approvals Received for Deer Crossing
Glen Harrington reported that all three State approvals to install the pilot denite system for buildings A, B, and D at Deer Crossing have been received. The Board agreed that it was appropriate now to step up the pressure on Deer Crossing to complete the work.
6. Emergency Plan Update – Glen Harrington
Glen Harrington reported that he has met with Sean O’Brien, at the County Dept. of Public Health, and the contracted nurse who is assisting in the writing of the Mashpee emergency dispensing site plans, the continuity of operation plans, and emergency all hazards plan for public health. Glen also stated that he is going to be meeting with the police and fire departments and the school about using the high school as our emergency dispensing site. Glenn Santos recommended that the BOH meet with the Selectmen and the Town Manager to review the plans to get their final approval in order to avoid any future disagreements on the established chains of command. Glen Harrington stated that he plans to get a copy of the Fire Department’s pre-assigned chain of command to use as a guideline for the BOH emergency plan.
The next meeting of the Board of Health was scheduled for Thursday, February 16, 2006, 7 PM at Mashpee Town Hall, Conference Room 1. As there was no further business, the meeting was adjourned at 7:30 PM.
