Chairman Glenn Santos called the meeting to order at 7:00 PM.
APPOINTMENTS
Atlantic Waste Systems North – Show Cause Hearing
William Robinson, General Manager of Waste Management, introduced himself to the Board.
Glen Harrington commented on the situation. On Sept. 8, 2005, Catherine Laurent, Assistant Director for the Mashpee DPW notified the BOH that Atlantic Waste Systems North was disposing of Mashpee refuse at the Bourne Landfill. This is in direct violation of the Mashpee BOH “Refuse Regulation”, which states that all haulers licensed by the BOH in Mashpee must transport their refuse loads to the Upper Cape Regional Transfer Station, a BOH-approved site or other facility approved by the BOH and, in the case of the Upper Cape Regional Transfer Station, must follow the route specified in the Upper Cape Regional Transfer Station rules and regulations. Therefore, the BOH issued an order to Mr. Robinson to appear before the BOH on 9/22/05 to “show cause” as to why Atlantic Waste Systems failed to comply with
the Mashpee BOH “Refuse Regulation”.
Mr. Robinson stated that he thought anything the DEP previously approved was okay, and that was his misunderstanding. Mr. Robinson further stated that, going forward, he will send one truck for Mashpee trash pickup, park it for the day, and send the truck to the Upper Cape Regional Transfer Station. He will put this plan in writing to the Board of Health.
Oak Hollow Condominium – Swimming Pool “Show Cause Hearing”
Greg Smith, Chairman of the Board of Directors of the Oak Hollow Condominium Association, introduced himself to the Board.
Glen Harrington commented that a fine had been levied for not being able to access the log sheet, and the fine had been paid prior to July 1st. Veronica Warden made an inspection that day prior to opening the pool, and found further violations. Glen Harrington made an inspection on Sept. 6th, and found the pool open, with the closed signs taken down. Thus, the Show Cause letter was sent out.
Greg Smith reported that the Condominium Association had fired the pool management company, having had many problems with the woman who had falsified the log records. Oceanside will be handling the pool management next year. The pool is now closed and covered for the season.
Veronica Warden suggested that prior to the pool opening next year, the Condominium Association contact the BOH to request an inspection, to keep the lines of communication going. Glenn Santos asked for a copy of the contract with the new pool management company, with a contact name, and outlining what is covered, i.e., first aid kits, etc. Glen Harrington asked that the Condominium Association pull the permit, not the First Property Management.
Steven Ball made a motion to revoke the pool license for 2005 and that no new contract is approved until a copy of the contract with Oceanside is received, with the name of a contact at the Condominium Association. A $200 fine per day will be levied if the pool is found open during the remaining 2005 season. Glenn Santos seconded the motion. All approved.
Waste Management of MA, Inc. – “Show Cause” Hearing.
Waste Management requested in writing a continuance of the Show Cause hearing to 10/06/05. Glenn Santos questioned whether the Board should send a letter before the 10/06/05 meeting, stating that the Board expects compliance immediately, and if the compliance is ignored, send a letter of noncompliance and levy a $100 per day fine.
After further discussion, Steven Ball moved that the Board approve continuation of the Show Cause hearing until 10/06/05. Glenn Santos seconded the motion. All approved.
Martin Keeley, Attorney for Waste Management, introduced himself to the Board. He asked for a list of approved trash collection facilities for Mashpee. He also stated that he feels there may be more complicated issues involved, i.e., Interstate Commerce regulations. Martin will contact Glen Harrington on this matter before the October 6th meeting.

NEW BUSINESS
Sign Warrants. There were no warrants.
Approval of Minutes
Approval of minutes of 8/25/05 and 9/08/05 were continued to the next meeting with all Board members in attendance.
Temporary Food Permits for Oktoberfest, 2005
Mashpee Public Library. Steven Ball moved that the Board approve the Mashpee Library temporary food permit application for the 2005 Oktoberfest. Glenn Santos seconded the motion. All approved.
Ashumet Farms. Steven Ball moved that the Board approve the Ashumet Farms temporary food permit application for the 2005 Oktoberfest pending inspection of the trailer, and validation of their Serv Save certification.
Kiwanis Club. Steven Ball moved that the Board approve the Kiwanis Club temporary food permit application for the 2005 Oktoberfest. Glenn Santos seconded the motion. All approved.
Children’s Museum. Steven Ball moved that the Board approve the Children’s Museum temporary food permit application for the 2005 Oktoberfest. Glenn Santos seconded the motion. All approved.
Mashpee Boosters Club. The Club already has a temporary food permit.
Mashpee Women’s Club. The Women’s Club is planning a bake sale for Oktoberfest. Glen Harrington stipulated that goods prepared must assure that no potentially hazardous materials are used in their preparation.
Glenn Santos moved that the Board approve the Mashpee Women’s Club temporary food permit application for the 2005 Oktoberfest with the stipulation that the Health Agent is given verification that baked goods prepared contain no hazardous materials, and that they are not prepared in residential kitchens. Steven Ball seconded the motion. All approved.
DISCUSSION
FYI – Mashpee Youth Soccer Organization. Glen Harrington reported receipt of a thank you letter from the Mashpee Youth Soccer Organization for waiver of fee for their 2005 food permit.
Emergency Dispensing Sites & Emergency Preparedness Update. Glenn Santos stated that, for the record, Glen Harrington has been spending a lot of time on this, trying to coordinate the whole emergency preparedness in Mashpee. Also Dr. Lewis has spent a lot of time on it, as a volunteer. Glen Harrington stated that a meeting was held on shelters with Joyce Mason, department heads, and Ernest Virgilio. Because of all the disasters that are happening around the world, Mashpee will have more access to Otis AFB.
Innovative/Alternative Septic System Enforcement/Penalties for Carmody Tracking Software
Glen Harrington asked for a continuation of this issue in order to have additional time to prepare additional background information for Glenn Santos to make the decision.
Flu Shot Clinic Dates
Glen Harrington reported two clinic dates: 11/01 /5 and 11/15/05. The 11/01/05 date is restricted to individuals 65 and over. The 11/15/05 date is for 50 and over, as well as for those with chronic illnesses. Glen stated that there is no shortage of flu vaccine this year.
The next meeting of the Board of Health was scheduled for Thursday, October 6, 2005, 7:00 PM at the Mashpee Town Hall BOH Office. As there was no further business, the meeting was adjourned at 8:04 PM.
