Commissioners:  Chairman John Fitzsimmons, Vice Chairman Ralph Shaw, Mark Gurnee, Brad Sweet and John Rogers

Staff Present:  Drew McManus (Conservation Agent)

Call Meeting to Order:  5:55 p.m.

The meeting was called to order with a quorum by Chairman Fitzsimmons at 5:55 p.m.

Minutes:  Approval of the following minutes: May 9th, 2013

Motion made, seconded and unanimously carried to approve the minutes of May 9th, 2013.

29 Hamblin Pond Rd- Request to keep existing pool-
No one was present for this request.

Mashpee Land Stewardship Updates-
The Conservation Agent updated the Commissioners on the events of Americorp Week, 2013.  The Agent described the projects that took place, including the installation of 5 pollinator gardens and the construction of 7 kiosks for various conservation parcels.  The Agent described the week as very successful.

Tidewatch/Bayswater Update-
The Conservation Agent updated the Commissioners on the progress of the enforcement actions for New Seabury Properties and Tidewatch Condominiums.  The Agent informed the Commissioners that New Seabury had completed the removal of all boulders from the beach and had also implemented rubber spacers in between the wood piles along the coastal beach.  Tidewatch is in the process of preparing beach nourishment activities at the staging lot of New Seabury (108, 110 and 113 Shore Drive West)

HEARINGS

6:00  Vahagan, Victor Teresyan  (241 Hooppole Rd)  Permit replacement of existing grandfathered dock with new floating dock in the same footprint  (RDA)

Material Submitted:     Chapter 91 Plan of existing dock

Mr. Teresyan presented the project to the Commissioners.  Mr. Teresyan described the project as a replacement for an old dilapidated dock with a new floating dock in the same footprint on Johns Pond.  The Agent stated that the new floating dock must have the property address displayed from all removable sections of the dock as per Harbor Master requirements.   The Agent recommended a negative determination. No public comments

6:03  Mead Summers (30 Sand Dollar Ln)  Upgrade Existing Septic System (RDA)

Resource Area: Buffer zone to coastal bank/salt marsh
Material Submitted:  Plan of Septic Upgrade- Engineering Works

Mr. Summers presented his project to the Commissioners.  The project involved upgrading an existing septic system.  The Agent informed the commission that this is a straightforward project and there will be no impact to the wetland resource Areas.  The agent recommended a negative determination.

No comments from the public.  

Motion made, seconded and unanimously carried for a Negative Determination.

6:10 William Ferner and Diana Leccese (44 Barbary Circle)  To construct a 30; x 11; family room addition with an adjoining 20; x 8 deck; install 150 timber retaining wall along the top of the coastal bank; remove five trees; and to create and maintain in perpetuity a vista window.  (NOI)

Material Submitted:  Landscape Mitigation Plan (Vaccaro Environmental), Engineered plan of home addition (Falmouth Engineering)

Jack Vaccaro (Vaccaro Environmental Consulting) represented the homeowners.  Mr. Vaccaro described the various aspects of the project.  The addition will occupy a portion of the existing deck and the deck is proposed to extend out closer to the top of the coastal bank.  The homeowners are also requesting to take down some hazardous trees.  One large cedar tree is very close to the home while other trees present a hazard to the existing stairway to the dock and 2 other trees are dead and have fallen over at the bottom of the coastal bank.  Mr. Vaccaro also described the request to maintain an existing vista corridor in perpetuity.  Finally, Mr. Vaccaro presented his landscape mitigation plan that proposed cleaning up an area of landscape dumping near the top of the coastal bank and planting native vegetation in its place.  Commissioner Fitzsimmons asked for some clarification regarding the deck expansion and the Agent said it was going to occupy a previously disturbed portion of the yard.  Commissioner Gurnee asked about the request to remove the trees and Mr. Vaccaro explained the reasons for each tree removal and  that mitigation was being proposed to compensate for the loss of the trees.  The Agent recommended a close and issue.
