Call Meeting To Order: 5:55 pm
The meeting was called to order with a quorum by Commissioner Brad Sweet at 5:55 pm.
There was no public comment.
Pre/Post Hearing Agenda:
- Minutes: Approval of the following minutes: N/A – Original quorum not available to approve the January 31, 2013 minutes.
- March 1st Vista Window cutting window extended to March 15th, 2013 due to the harsh winter conditions.
- Land Stewardship updates (Guest Lecture Series- Rick York recap)
Rick York gave his presentation on his plan for shellfish propagation and nitrogen remediation. Approximately 8-10 were present and it was also recorded for Mashpee TV.
- MACC- The annual conference is scheduled for Saturday, March 2nd in Worcester and will contain informational courses and workshops.

6:03 Michael Southwick (126 Shore Drive West) Remove a 44' wide pergola and a 44' x 15'6" pool deck. Install 6" crushed stone (drainage), a new second story wood deck and a 1st floor wood deck structure to replace concrete pool slab - RDA

[6:31] Michael LeBlanc from LeBlanc Builders is presenting for the owner. Mr. LeBlanc explains that the existing pool deck has been slumping towards the house most likely due to a defective return line. Mr. LeBlanc states that they are proposing to remove the second floor pergola, saw cut the existing deck and install 14 new sonotubes. The access used will be on the right side of the house which they would like to place ramps so that a mini-excavator can be brought in. Mr. LeBlanc states that they would like to put a 2nd floor 15’6” x 44’ deck with two sliders. They will remove the existing pavement and place crushed stone under the new decking. Agent
McManus states there is no adverse impact to the resource area and he does not have any issues with the landscape plan.
Motion made, seconded and unanimously carried for a Negative Determination
- Pirate’s Cove Association: Request to place mobile/seasonal kayak/boat rack at association beach on the Mashpee River. Jim Boutilier, President of Pirate’s Cove Association, explains some of the background of the two beaches owned by the association. Mr. Boutilier proposes to construct two kayak/boat racks at the Captain’s Row Bay Shore Beach area and one at the Orsinny Beach area. The material will be pressure treated, approximately 16’ long and seasonal.
Motion made, seconded and unanimously carried to approve the construction of the three kayak/boat racks for the Pirate’s Cove Association
- 387 Monomoscoy - move pool location/new footprint- determination of filing or admin approval

Frank Ferrari from Ferrari Pool & Patio Designs explains that there is no change within the parameter of the patio layout but he is proposing to have the option of moving the pool 3’ back and 5’ to the right to give the owner more deck area between the existing deck and the pool. Mr. Ferrari states that a water feature was added to the pool and they will be using travertine pavers. Mr. Ferrari would also like to replace the existing footings of the deck to larger footings to support the weight of the deck.
Motion made, seconded and unanimously carried to approve the administrative approval to revise the location of the pool and replacement of the deck footings.
- 76 Triton Way – Ken Mackin, owner of 76 Triton Way, explains that they purchased the property last year and he gives a little history regarding the revetment wall. Mr. Mackin states that the repair of the revetment wall included 857 cubic yards of sand fill. He is asking for a credit of 857 cubic yards of nourishment to be applied to the back-owed beach nourishment requirements that have accrued since 2008 and amounts to 2,472 cubic yards. Mr. Gurnee asks about the access for the beach nourishment and Mr. Mackin states that they are working on that issue for which they have three options; (1) third party location site; (2) preliminary discussions of an escrow account with the town for the town to use at other beach nourishment sites; and (3) a conveyor belt over the wall. Agent McManus states that as in most Order of
Conditions, it might be beneficial to coordinate beach nourishment activities with 108 Shore Drive West or other coastal/feeder beaches to maintain that profile.
Motion made, seconded and unanimously carried to approve credit of 857 cubic yards
Agent McManus would like to remind the Board of the Cape Cod Light Energy Conservation presentation on Tuesday March 5th.
